Judicial elections occur in odd-numbered years. Justices and judges are retained or re-elected by the voters, and may serve an unlimited number of terms until they reach the mandatory retirement age of 70. Vacancies that exist before an election may be filled by gubernatorial appointment until an election is held. These selections are subject to Senate confirmation. Do you agree with the plurality opinion’s interpretation of Article 1, Section 27 of the state constitution as stated in the Robinson Township case of December 2013? If not, why not? 2. Do you agree that the plain English language meaning of the amendment should be the basis for construing it? Editor’s Note: In the Robinson Township case, the Pennsylvania Supreme Court held unconstitutional most of Act 13 – a 2012 oil and gas law designed to facilitate the development of natural gas from the Marcellus Shale, by giving the Department of Environmental Protection the right to override local zoning laws in approving oil and gas operations. The basis for the decision in large part was Article I, Section 27 of Pennsylvania’s Constitution (commonly referred to as the Environmental Rights Amendment), which broadly creates rights for the people to a clean environment. This decision is viewed by many as having significant implications in future environmental litigation. TH E M U N I C I PAL P RI M ARY In Pennsylvania a primary election is held each spring, allowing voters registered as Republican or Democratic to select their party’s candidate for the regular election in the fall. In a primary election voters receive only the ballot for the party in which they are registered. This primary ballot lists all the candidates for each office who are seeking to become their party’s candidate in the fall election. It does not include candidates from any other party. Because Pennsylvania has a closed primary, voters cannot cast any ballot other than the one for the major party in which they are registered. In the primary, independent and third party voters do not receive any party’s ballot, and may vote only on a ballot question, if applicable. There are no ballot questions for this election. In this Voters Guide the nominees are listed by office. All those whose names appear on the official ballot for each office are listed together by party, with the nominees for the party of the governor appearing first. Within each party group they appear in the order in which they will appear on the official ballot. This publication contains important information for voters in all the municipalities of Union County, and is provided free of charge by members of the League of Women Voters of the Lewisburg Area. In addition to being the final court of appeals, it serves as administrator of the Unified Judicial System and is responsible for ensuring that all Pennsylvania courts perform their duties properly. The Supreme Court has several committees and boards responsible for writing and enforcing rules for judges, attorneys, and litigants to ensure an efficient and fair judicial review. Because the analysis is the basis of a three justice plurality decision and the author and one of the joining justices are no longer on the court on which I hope to serve, it would be improper for me to express my agreement or disagreement with the analysis. This is by definition an open question of the law which is likely to again be presented to the Supreme Court. 2) For the reasons stated in my first answer, I do not believe that I can respond to this question. I note, however that it is well established in the law that the “touchstone” of constitutional interpretation is the actual language of the constitution and it must be interpreted in its popular sense. Like so many other constructions in law, if we can give meaning to the wording as written, we should not look to outside sources for interpretation. Only if we were to determine that the amendment is ambiguous, would we look to outside sources for clarification. Answer to Questions: I agree with the plurality decision as I understand it. (This reservation is of no small moment. As intimated in the Opinion, it remains to be seen how broadly, and in what specific factual contexts the holding will be applied over time). I agree that as a general proposition, in the absence of indications to the contrary, constitutional and legislative language should be afforded its plain meaning, in order to carry out the collective will of the people. The constitutional language of Article I, Section 27 plainly creates a trust protecting the environment for the benefit of future Pennsylvanians. A huge volume of appeals flows to the Superior Court from the trial courts. Generally, appeals are heard by panels of three judges sitting in Philadelphia, Harrisburg or Pittsburgh. The court often is the final arbiter of legal disputes. Although the Supreme Court may grant a petition for review of a Superior Court decision, most such petitions are denied and the ruling of the Superior Court stands.
