NORMS SET FOR THE DISCHARGE OF FUNCTIONS
TECHNICAL MATTERS
The Punjab Pollution Control Board, has formulated siting
guidelines for the industries to stop haphazard growth of industry and to
effectively implement the provisions of various pollution control laws. These
siting guidelines are helpful in control of pollution and protection of the society
from all the effects of pollution from the industries/development projects. The
siting guidelines have been broadly categorized as under. The officers of the
Board follow the following guidelines while discharge their duties:


4.1.1
General Guidelines
The Board has issued office order vide No. GPC/NIP/F-10/2010/4
dated 17/2/2010 for the Policy guidelines regarding categorization of industries &
procedure for Consent Management mechanism and validity period for various
categories of industries as under:
The Punjab Pollution Control Board in its 145th meeting held on
30/11/2009 and 146th meeting held on 12/1/2010 considered the matter cited
above and decided to categorize the industries into red, orange & green
category. The industries categorized as Red & Orange are as per Annexure- 1
&2
respectively. The industries, which are not covered under the list of Red &

Orange category, may be termed as green category. The Board further decided

NOTE:
 Cases of all categories of large and medium scale industries will be routed
through Member Secretary of the Board. Directions u/s 33-A of the Water
(Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air
(Prevention & Control of Pollution) Act, 1981 of all large and medium scale
red category industries will be signed by the Member Secretary and of all
other categories will be signed by the Senior Environmental Engineers.
B.
Siting criteria:
 All Red/Orange/Green category of industries will only be allowed to set up
in
the
designated
industries
zones
in
the
cities/towns
where
statutory/non-statutory Master Plan/Local Planning area have been
prepared/notified by the Town & Country Planning Department, Punjab
and designated industrial areas /FEZ declared by the Govt. of Punjab,
Department of Industries/PSIEC/PSIDC/any other Govt. Authority.
 All Red/Orange/Green categories of industries will only be allowed to set
within the Local Planning area, where the statutory/non-statutory Master
Plan of the said area is yet to be prepared/notified, after getting change

of land use/NOC from the Town & Country Planning Department,
Punjab/Competent Authority of the State. Furthermore, in case, any
existing industry of red/orange/green category within the municipal
limits/local planning area intends to carryout expansion/ modification,
where
the
statutory/non-statutory
master
plans
have
not
been
prepared/notified by the Town and Country Planning Department, Punjab,
after getting change of land use/NOC from the Town and Country
Planning Department, Punjab/Competent Authority of the State.
 All Red/Orange/Green category of industries, where statutory/nonstatutory Master Plans/Local Planning area have not been prepared/
notified by the Town & Country Planning Department, Punjab, will be
allowed to set up at a distance of 100m outside the Municipal Council
limits/ phirni of village/ designated residential area approved by the
Competent Authority of the State.
NOTE
 Office order No. 198 dated 21/11/1995 stands omitted.
 Clause no. 1, 2, 4 & 5 of the Office Order No. GPC/1999-2000/Gen434/F-1 dated 16/08/2000 as amended from time to time will remain
operative as far as Red and Green category of industries are concerned
and clause number 3 of the said order stands omitted. A copy of the
said Office Order is annexed herewith as Annexure-3.
 Orange category of industries will be treated at par with Red category of
industries as far as siting criteria/shifting of industries from nondesignated area to designated industrial area is concerned. As such, all
circulars/office orders/notifications/clarifications issued by the Board for
siting criteria for Red category of industries, will be applicable to Orange
category of industries.
 The
siting
guidelines

plants/cement plants including cement grinding units/hot mix plant/brick
kilns/stone
crushers
will
remain
operative
and
implemented
independently from the aforesaid siting criteria.

Consent Fee:

Red/Orange/ Green category of industries will be charged as specified by
the Board vide office order No. Admn./SA-2/F.No.563/2009/6 dated
22/10/2009 (Annexure-4).
b) Criteria for calculating the consent to operate fee prior
22/10/2009.
 The credit of consent fee already deposited prior to 1/10/2004 under the
Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention
& Control of Pollution) Act, 1981 for 15 years will be calculated by using
the following formula:
A – A (1 X T/15)
Where
T is time period from the date of deposit of consent fee for 15
years upto 30/9/2004.
A is the Amount of Consent fee deposited for 15 years prior to
30/9/2004.
 In case any industry had not deposited consent fee for 15 years prior to
30/9/2004, then for calculating the consent fee of such industry, yearly
consent fee applicable to the industry as per slab will be taken into
account. Similarly, consent to operate fee will be charged on yearly basis
for the period 1/10/2004 to 22/10/2009.
 In case consent to any industry is refused/revoked/cancelled due to
violation of the provisions of the Water (Prevention & Control of Pollution)
Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, the
consent fee will be deducted from already deposited amount or the
industry will deposit the fee equal to the amount applicable to the industry
for one year, if the industry applies for the same afresh within one year.
In case, the industry applies for obtaining the said consent after the
elapse of one year but before the elapse of two years, then such amount
will be equal to the double the yearly fee applicable to the industry and so
on.
 The consent fee for the period 1/4/1992 to 9/10/1994 will be calculated
as per fee criteria given in Annexure-5. The consent fee for the period

10/10/1994 to 30/9/2004 will be calculated as per fee criteria given in
Annexure-6 and consent fee for the period 1/10/2004 to 21/10/2009 will
be calculated as per fee criteria given in Annexure-7.

D.
Application form for consent to establish/operate & the
procedure for processing the cases:
 The application form presently prescribed for Red category of industries
for consent to establish/operate will be applicable for Red and Orange
category of industries. All Green category of industries, irrespective of
their scale, will apply for consent to establish/operate on the proforma
presently prescribed for small scale Green category of industries.
 The application for consent to establish/operate/clearance certificate
under the Water (Prevention & Control of Pollution) Act, 1974 & the Air
(Prevention & Control of Pollution) Act, 1981 shall be attached with
documents as mentioned in Board's letter no. 4441-51 dated 3/5/2002
(Annexure-8). The case will be processed by all the Regional
Offices/Nodal Office as per circular no. 14442-52
dated 26/11/1999
(Annexure-9).
 Restoration cases of supply of electricity will be processed as per Board's
circular no. 975-96 dated 9/3/2000 as amended on 3/5/2001. A copy of
these circulars is annexed herewith as Annexure -10 & 11.
 Circular no. CSA/03/21st meet/10149-63 dated 8/3/2005 (Annexure-12)
for grant of NOC from pollution angle to the industries, which are covered
under the Factories Act, 1948, will remain operative.

Validity period of consent to operate:
The validity period of consent to operate under the Water
(Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control
of Pollution) Act, 1981 for various categories of industries is as under:

The consent to operate alongwith clearance certificate irrespective of
category of industries shall be initially granted for 6 months and shall be
extended after commissioning/expansion/modernization of the industrial unit

under the Water (Prevention & Control of Pollution) Act, 1974 & the Air
(Prevention & Control of Pollution) Act, 1981 for the period as mentioned above,
only after assessing the adequacy of the pollution control devices within the
validity period of 6 months.

The Board's order no. EE-I/Gen-214/F-2 dated 31/8/2000 as
partially amended vide office order no. 2 dated 16/9/2002 will remain operative
as far as exemption of 95 category of tiny small industries are concerned, a list
of which is annexed herewith as Annexure 13 & 14.
H.
Procedure for power load to the existing industries:

The existing industries may be permitted an extension in power load upto
25% of

the sanctioned load for the purpose of modernization/expansion as per
procedure laid down in circular no. Gen./F. No. GEN-192/2001/3001-3100
dated 10/8/2001 & no. 5558-68 dated 24/7/2002. A copy of the said
circulars is enclosed herewith as Annexure-15 & 16.
The circular no. GPC/Gen/F. No. 434/2005/173 dated 7/3/2005 for power
load to green category of industries located in non-designated areas, will
remain operative. A copy of the said circular is enclosed herewith as
Annexure-17.

For increase in the power load for running of effluent treatment plants/ air
pollution control devices, each industry shall apply for consent to establish
(NOC)/ clearance certificate at Regional Office of the Board containing
information in respect of following points:
i)
Detail of the existing power load with each component of the
effluent treatment plant/ air pollution control device.
ii)
Additional components of the effluent treatment plant/ air pollution
control device installed and detail of power load for each
component.
iii)
Completion certificate of the consultant regarding upgradation/
installation of the effluent treatment plant/ air pollution control
device.
iv)
An undertaking to the effect that the industry will not utilize this
electric load for any other purposes except for running of effluent
treatment plant/ air pollution control devices and its standby
motors meant for this purpose only.
The Regional Office will examine the case thoroughly and
the case will be decided by the respective Competent Authority of the
Board as per delegation of powers given in Para-A above.
I.
Period prescribed for grant of consent to establish/ operate
The Govt. of Punjab has prescribed the following time period for
deciding the application for consent to establish/ operate under the Water
(Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of
Pollution) Act, 1981 under the Punjab Industrial Facilitation Act, 2005:

All Regional Offices will ensure that the application for consent to
establish/ operate under the Water (Prevention & Control of Pollution) Act, 1974

& the Air (Prevention & Control of Pollution) Act, 1981 and clearance certificate
will be processed within the time frame prescribed vide Office Order no. 21 dated
12/6/2003. A copy of which is enclosed as Annexure-18.
Provided the aspects which are not covered under paragraph A to I of
this
order
above,
with
regard
to
any
specific
parameter/condition/procedure etc., provided for orange category of
industries, will be treated at par with that of Red category of industry.
The Office Order No. Admn./A-2/F.No. 178/94/93 dated 26/5/1994,
Office Order no. GPC/GEN/2004/214/8 dated 11/10/1994 & Office Order no.
Admn/A-2/F.No. 178/94/176 dated 9/11/1994 stands superseded by the present
order.
This order will take immediate effect.

Industry specific siting guidelines
The Board has laid down industry specific sitting guidelines & code
of practices for the following categories of industries.

4.1.2.1
Siting guidelines for Stone Crushing Units
The guidelines for siting of the stone crushing as prescribed by the
Govt. of Punjab vide its notification No.3/7/96-STE (5) dated 17/3/1998 are given
as under:
(1)
Quantitative standard for the SPM: The suspended particulate matter
measured between 3 & 10 meters from any process equipment of a stone
crushing unit shall not exceed 600 gm/Nm3.

Code of Practice & Siting guidelines:
For New Stone Crushers (Established after 17.3.1998):
No new stone crushing unit shall be allowed to be installed and
operated within the limits of:
A.
(i)
500 meters on National Highway/State Highway/Scheduled Roads in
plain areas and 250 meters in sub-mountainous areas.
(ii)
5 Km of the city limit of metropolitan cities/Municipal Corporation.
(iii) 2 Km. of the city limits of A-class Towns.
(iv) 1.5 Km of the city limits of B-Class Towns.
(v)
1.0 Km of other Cities/Towns.
(vi) 500 meters of Village Phirni/Lal Lakir/Approved Residential colony
(vii) 300 meters of Historical Places/Educational Institutions/Zoological
Parks/Wild Life Sanctuaries/Protected Monuments.
(viii) 100 meters of link roads and other district roads.
(ix) 300 meters of all major district roads in plain areas and 150 meters
in sub-mountainous areas.
B.
Stone crushers shall be located in a minimum area of o.4 hectare which
should be owned by the stone crusher unit or by taking land on lease
either owned by the panchayats or in the private sector.

For Existing Stone Crushers (Established before 17.3.1998):
The existing stone crushers meeting the guidelines given below
along with standards notified under Environment (Protection) Act, 1986 and the
code of practice for pollution prevention as specified hereinafter should be
allowed to operate:
-
No dust emitting point within 100 meters from right of way of scheduled
roads
within
the
Chandigarh
Capital
Periphery
Control
Area/Communication Zone.
-
No dust emitting point within 30 meters from the right of way of
Highways/Scheduled Roads in other parts of the State.
-
250 meters from Municipal / Notified Area Committee Limit / Village Lal
Lakir/ approved Residential Colonies / Historical Places / Zoological Parks /
Wild Life Sanctuaries / Protected Monuments.
NOTE:

(i)
Those units which are not conforming to the above guidelines should be
shifted from the present site.
(ii)
The Environment Impact of existing stone crushers may be studied and
their further continuation reviewed after a period of five years.

For New Clusters of Stone Crushers
In addition to the guidelines for new stone crushers recommended
above, the following criteria will be adopted where stone crushers are set up in
clusters:
(i)
A green belt of width as specified by the Punjab Pollution Control Board
will be provided all around the cluster.
(ii)
Only one approach from National Highway/Scheduled Road will be
provided to the cluster.
(iii)
The approach road leading to a cluster of five or more stone crushers shall
not pass through the village.
(iv)
All new clusters of stone crushers shall get the layout plan approved from
the Town and Country Planning Department, Punjab.

For Existing Clusters of Stone Crushers:
The approach road leading to a cluster of five or more stone
crushers shall not pass through any village.

Code of Practice for Pollution Prevention
All the stone crushers shall take the following pollution control
measures:
(i)
All the dust emitting points like Jaw/Roller Crushers, screens/classifiers
should be properly enclosed / covered.
(ii)
Conveyor belts should be of proper quality material instead of used tyres.
(iii)
The ends of conveyor belts should be covered with telescopic chute.
(iv)
Regular water spray should be carried out at all dust emitting points and
transfer points.
(v)
Water spray should be done on the boundary as per requirement.
(vi)
Regular cleaning of approach roads should be carried out.

(vii)
All the approach roads and ramps should be metalled.
(viii)
A green belt consisting of three rows of trees of which one of tall leaved
trees and two rows of medium leaved dense trees should be provided
along the periphery.
(ix)
Annual health survey of the workers should be conducted.
(x)
The openings of the housing for the movement of mechanical drives,
conveyor belts etc. should be properly sealed with flexible rubber flaps.
(xi)
The process waste i.e. file material should not be dumped along with
roadside and should be used for filling up of low lying areas.
(xii)
The water spray system should be interlocked with the main crushing
operation.
(xiii)
The stone crushers should conform to the emission standards laid down
by the Board.
The existing stone crushers meeting the guidelines for existing
stone crushers, but not conforming to the guidelines for new stone crushers
shall, in addition to the above pollution control measures, provide a 10 ft. brick
wall as boundary/wind breaking wall facing the road as well as towards
residential area with a well defined single entry point from the road.

Each stone crusher shall install suitable pollution control measures to the
satisfaction of the Board and shall obtain 'No Objection Certificate' from
the Board as well as from the Town and Country Planning Department,
Punjab and also conform to the other statutory regulations, if any.

The stone crusher unit hence forth would be permitted anywhere subject
to the restrictions of the Department of Town and Country Planning,
Punjab and the Punjab Pollution Control Board.

Existing stone crusher units which are not conforming to the parameters,
as detailed above, shall shift to sites conforming to the above parameters
within the time frame given by the Punjab Pollution Control Board to them
but not later than three months.

NOTE:
Existing stone crushers means those stone crushing units, which were
in operation on 17.3.1998. All stone crushers which were established
or came in operation after 17.3.1998 shall be considered as new stone
crushers.
4.1.2.2
The Siting guidelines for Rice Shellers, Saila Plants have
been prescribed by the Govt. of Punjab vide its office order
dated 11.9.2006 as per annexure 19.

The guidelines for siting of the Brick Kilns, Cement
Plants/Grinding Units as prescribed by the Board are as
under:


Code of Practice for Brick Kilns:
Approach road within the premises of brick kiln area should be
pucca/ stabilized with brick bats etc.

They should use crushed coal for better burning efficiency.

Bricks should be laid in a staggered manner for baking to entrap

maximum particulate matter at the source itself.

They should use a properly designed gravity chamber.

Height of chimney / stack should be at least 30m.


Provision of Green Belt
The industry should plant three rows of spreading crown & fast
growing varieties of evergreen broad-leaf trees all along the boundary.
NOTE:

Distance shall be measured from the edge of the metalled road to
the nearest stack of the hot mix plant.

4.1.3
Capital Periphery Control Act/Free Enterprise Zone (FEZ)
As per the Capital Periphery Control Act and Sub-Regional plan of
Punjab State, no industrial activity can be undertaken within periphery of
Chandigarh and its sub-Region except the following areas which have been
exempted through notifications mentioned as under:

4.1.4
Self Monitoring of Pollution Load
The industries discharging the following pollutants in their effluents
and/or emissions beyond the levels mentioned below are required to carry out self
monitoring of their emissions. Such industries are required to make arrangements to
monitor their effluents/emissions daily by providing sample collection and analysis
facilities or utilizing the facilities provided by other units/laboratories. The data
collected by the industries shall be maintained by the industries on daily basis and
shall be submitted to the Board by the 5th of the following month.

Environmental Statement
Every person carrying on an industry, operation or process and
requiring consent under section 25/26 of the Water (Prevention & Control of
Pollution) Act, 1974 and or u/s 21 of the Air(Prevention & Control of Pollution)
Act, 1981 or both or authorisation under the Hazardous Wastes (Management &
Handling) rules, 1989 as amended from time to time shall submit an
environmental statement for the financial year ending 31st March on prescribed
performa on or before of September every year beginning 1993. Prescribed
performa can be obtained from the concerned Regional Office of the Board and
the statement shall be submitted to the same office.
4.1.6
Sample Testing Laboratories
The Board has set up its Central Laboratory at Patiala and Zonal
Laboratories at Ludhiana and Jalandhar for analysis of effluent/emission samples.
In addition, the Board has also authorised some private laboratories to analyse
effluent/emissions samples for monitoring and consent purposes. The industry
can get its samples tested and performance study carried out from any of these
laboratories.

Administrative Functions
As per business rules 1977 to perform the functions of the Board, the
meetings of the Board have to be held after 3 months and minimum 4 times in a
year, so the meetings of the Board are held as per norms laid down in the rules. As
regarding norms for personnel matters are concerned, the norms prescribed by the
Government are followed in the day by day functioning of the Board.
Laboratory Functions
For Biological Parameters the water samples should reach in the
Laboratory within 24 hrs from the collection of samples.

Samples received in the Laboratory should be preserved for different
parameters as per I.S.I. Data of samples received in the laboratory is entered
in the sample receipt register.

The sample is analysed for the parameters mentioned in the sample
collection Data Sheet.

After completion of analysis, the report has been prepared, entered into
report sending register and is released after duly signed by the concerned
officers.

Generally the analysis report for Water and air emission samples are released
within ten days and seven days respectively after receipt of the samples in
the laboratory, but if there is heavy rush of work, the analysis report may get
delayed.

In partial modification of the Board notification No. Admn./A-2/F.No.178/98/1 dated
20.01.1998. Punjab Pollution Control Board in its 107th meeting held on 7.7.2000
decided that the cases of the industries for grant of "Consent to establish"/"Consent to
Operate" in non-designated areas of the State shall be decided as per the following
policy:1.
No new industry of any category shall be allowed in the approved residential
area of any town of the State of Punjab. The approved residential area shall be
designated either by PUDA, Municipal Corporation / Improvement Trust or any
other designated authority of the State and its should be duly reflected in the
Master Plan.
2.
No red category industry shall be given consent to establish within the municipal
limits except in the designated industrial area of the State.
3.
The Board may continue to grant "Consent to establish" to green category of
industries which are proposed to be located in mixed category areas or
predominantly industrial areas within the municipal limit of a Town/City after
classification of the area by CTP/STP/DTP.
4.
The Board may grant "Consent to Operate" to the entire existing green category
of industries in mixed category areas or predominantly industrial areas.
5.
The Board may grant "Consent to Operate" to old red category of industries
operating in approved residential areas or mixed areas but required to be shifted,
if they have installed adequate Effluent Treatment Plants and Air Pollution
Control Devices as per below:
i)
Initial consent to operate shall be for a period of one year with the
condition that it will shift to the designated industrial area within
stipulated period.
ii)
The Board may further extend this period on merit after the expiry of one
year in the rarest of the cases subject to the approval of the Board of
Directors.

OFFICE ORDER
The sub section 2 of section 25 of the Water (Prevention & Control of
Pollution) Act, 1974 states that every industry covered under the said Act, is required to file
an application for 'consent to establish / operate' as required under sub section 1 of section
25 of the said Act alongwith such fee prescribed by the Board. There is similar provision for
obtaining 'consent to establish / operate' under sub section 2 of section 21 of the Air
(Prevention & Control of Pollution) Act, 1981, also Punjab Pollution Control Board is charging
the application fee for processing the consent applications filed by the industries and other
establishments for 'consent to establish' and 'consent to operate' which was prescribed by
the Board since its inception in 1975.
Keeping in view the changing financial scenario, increase in the expenditure
of the Board and the Board is in the process of introducing a new category namely orange
category, it has been felt necessary to go in for a revision of the 'consent to establish' and
'consent to operate' fees for the processing of the application etc. Accordingly, the matter
for 'consent to establish / operate' fee was placed before the Board in its 144th meeting held
on 20/8/2009 and accorded its sanction.
In pursuance of the decision taken by the Board in its 144th meeting held on
20/08/2009, the 'consent to establish' and 'consent to operate' fees for the processing of
application under the Water (Prevention & Control of Pollution) Act, 1974 and the Air
(Prevention & Control of Pollution) Act, 1981 etc. will now be charged as under:

Inspection reports of the industry to be submitted by the
Regional Offices for release / restoration of Power
Connection / grant of Consents.
It has been observed that while forwarding cases to the Head office,
regarding installation of effluent treatment plants / Air Pollution Control Devices, the
Regional Office recommendations are very criptive and arbitratory. Similarly the
recommendations for issue of directions for closure of the industries under section 33-A
of the Water Act, 1974 and 31-A of the Air Act, 1981, u/s 5 of the Environment
(Protection) Act, 1986 and grant / refusal revocation of consent / authorization under
various statutes are without supporting facts which could substantiate the action
recommended.
On perusal of certain cases submitted for consideration to the Competent
Authority, it has been observed that most of the reports submitted are non-descriptive
and devoid of facts which leads of wastage of the time which, on turn, breeds
discontentment among the public. Hence all the recommendations made shall be
accompanied by inspection report from the R.O. The inspection report shall be self

explanatory and supported by necessary documents, duly authenticated by him. The
report should broadly cover as to why action recommended is necessitated.
In the case of recommendations for:
1.
Release of electric connection.
2.
Restoration of the electric connection.
3.
Grant of consents to operate.
4.
Issue of authorization HWM.
The report should cover.
1.
Compliance of conditions of consent to establish be given in clear terms and
the use of terms like 'complied & noted' be avoided, remarks / observation
should be descriptive as to complete facts on record.
a)
Drawing of the factory lay out indicating ETP/APCD plant and
HWM storage positions.
b)
The completion drawings of APCD/ETP both plan and sectional
view.
c)
Installation of electrical; and mechanical equipment supported by
bills and vouchers in claim of the installations.
d)
The lay out of the various channels pipe / sewers duly marked on
the layout plan of the industry –fresh water (blue Colour), effluent
channel (red Colour), recirculation water channel (green Colour),
storm water (orange Colour) & domestic sewer (dotted black line).
e)
In case the effluent is used for irrigation the following details be
given.
 Land under irrigation in hectare.
 Land under irrigation marked on the location map of the
industry.
 Whether land is adequate for consuming whole of effluent
without causing any environment pollution problem.
f)
If the Hazardous waste generating industries, details of the
arrangement made for storage of Hazardous Waste.

In the absence of these information, it is advise to the concerned consent
management authority not to accept any such case till the recommendations are
complete.
It is further mentioned that in following case Environmental Engineer,
Regional Office will personally prepare report.
i.
Power release clearance of all large and medium scale units.
ii.
Power restoration cases after directions u/s 33-A of the Water Act, 31-A
of the Air Act irrespective of the scale of industry.
iii.
Random check shall be made by Environmental Engineer, Regional Office.
Sample size for random check shall be his prerogative. He will certify that
the recommendations are in an order if they are proposed by his
subordinates / team members.
In view of the above, it has been decided that Environmental Engineer or
other Competent Officer, as the case may be, will inspect the industry personally and
Environmental Engineer shall authenticate all relevant records, viz site drawings, details
of plant machinery installed, its supporting information for purchases and other relevant
aspects, which confirms that the system is in order.
The other information regarding the arrangements for the storage of the
Hazardous sludge, record regarding use of chemicals / nutrients for treatment of the
effluent, log book for running and maintaining of ETP/APCD giving details of back
washing of filter, changing of filter bed material etc., shall also be provided while making
recommendations for renewal of consent / authorization etc.
The above instructions are applicable with immediate effect.

It has been decided that in future there should be a uniform policy for the
permanent restoration of power supply and filing of directions issued u/s 33-A of

Temporary power connection may be restored for two months for assessing the
adequacy of pollution control devices installed once the report as per circular
dated 25/11/99 is received. Regional Offices may retain the consent application
for such a period till the performance study of pollution control devices is
received.

Regional
Offices
should
send
the
consent
application
alongwith
the
recommendations for permanent power connection.
3.
Consent application should be decided simultaneously along with the permanent
power connection case and dropping of action u/s 31-A of the Air Act, 1981 or
u/s 33-A of the Water Act, 1974 and consents should be issued before the orders
for permanent power connection are issued.
The above instructions are application with immediate effect.

Grant of NOC from pollution angle to industries, which are
covered under Factories Act and require site clearance by
Site Appraisal Committee.
The Board, in its 121st meeting held on 15.12.2003 had decided
that NOC/clearance to such industries which are required to obtain site clearance from
Site Appraisal Committee, under the Factories Act, 1948, should be issued only after the
site clearance has been granted. The decision of the Board was conveyed to all the
Zonal Offices and Regional Offices vide letter No. 43-57 dated 2.1.2004.
Following queries were received from the field offices.
"Some industries which were required to obtain site clearance but had been
established and are in operation before 2.1.2004, without obtaining site
clearance/NOC/consent to operate, from the Board. Now these industries
are applying for consent to operate from the Board. Whether consent to
operate to such industries should be granted or these industries should be

asked to obtain site clearance from Site Appraisal Committee before the
grant of consent to operate."
The matter was placed before the Board for consideration. The
Board in its 125th meeting held on 25.02.2005 decided as under:"That the consent to such industries, which have been established before
or after 2.1.2004, without obtaining site clearance from Site Appraisal
Committee (SAC) and/or NOC from pollution angle from the Board, shall
not be granted NOC/consent till such time the industry obtains site
clearance from the SAC so as to check haphazard growth of such
industries."

Punjab Pollution Control Board, Patiala in its 107th meeting held on
07.07.2000 has decided to exempt 32 additional types of tiny/small scale industries in
addition to 63 types of tiny small scale industries already exempted by the Board vide
above referred notification. Accordingly, 95 industries under tiny/small scale sector as
per Annexure-I are exempted from obtaining consent of the Board under the provisions
of the Water (Prevention & Control of Pollution)Act, 1974 and Air (Prevention & Control
of Pollution) Act, 1981 and Hazardous Waste (Management & Handling) Rules, 1989,
subject to the respective industry satisfying the following conditions:
1.
That the industry is established/being established in the State demarcated
Industrial Estates/Zones classified by the State authorities viz PSIEC, Department
of Industries, PUDA, Chief Town Planner under draft master plan or any other
authority appointed under the statute of the State for the development of
industrial experts and shall not be applicable to the category of industries
established/being established in predominantly residential areas and approved
residential areas.
2.
That the investment of the industry is not more than Rs. 25 lacs on plant and
machinery.
3.
That there will not be any discharge of trade effluent from the industry into
stream or well or sewer or onto land or/and that the industry will not discharge
any air pollution including noise into the atmosphere.
4.
That the industry will not discharge any toxic/hazardous wastes and will not
handle any toxic/hazardous chemical.
In case the industry is found to create conditions that generate any type of pollution or if, there is any objection from the
surrounding community and if on verification, it is found that such objection has some substance, the Board shall be free
to take legal action under the provisions of the Water (Prevention & Control of Pollution)Act, 1974 and Air (Prevention &
Control of Pollution)Act, 1981 or Environment (Protection) Act, 1986 as considered appropriate.

modernization/expansion based on the affidavit as follows:
"That there will be no addition of plant and machinery generating
pollution load. Consequent upon the increase in power load upto
25% of the existing load at the same location there will be no
increase in pollution load either on modernization or by expansion."

Ludhiana is an industrial hub of State of Punjab and there are approximately more
than, 20,000 nos. of industries operating in the city of Ludhiana. Out of which 200
nos. are large and medium scale industries, 2500 nos. are small scale industries of
red category and approximately more than 17,500 nos. of industries are of green
category. So more than 80% of total industries operating in Ludhiana are small scale
tiny units of Green category mainly engaged in manufacturing Hosiery Garments,
Machining of sewing machine parts, cycle parts auto parts, hand tools etc.
Punjab Pollution Control Board has mainly laid stress in pollution control in red
category of industries. The Board has laid down the policy for red category of
industries operating in non-designated area and as per the policy, the industries are
required to be shifted to designated area. The time period has been extended in the
past few years and recently the time period has been extended by the Board upto
30.6.2005. The main motive behind the policy of the Board in not to allow the
establishment of any new industry or allow expansion of any type in existing
industries operating in non-designated area of five highly polluting towns of the
State of Punjab, Ludhiana city is one of them. The main stress of the Board was on
red category of industries but the policy was implemented in totality in all type of
industries, which included Green Category of industries also.
The Board has been receiving large number of representative from
various Industrial Associations of Ludhiana and also from the office of Chairman, PSEB
to allow extension in electric connection to existing Green category of Industries in
Ludhiana.
The process involved in existing Hosiery units are knitting on flat knit
machine and stitching of garments. The trade in the International market has been

opened to all. The hosiery units in particular when go in for modernization/expansion,
has to purchase computerized knitting machinery which cost them 1 crore to 5 crore of
investment in plant and machinery and also required enhancement of electric connection
to operate these machinery so that they can compete the product manufactured at
international level. Further due to the addition of such type of computerized knitting
machine there is neither any increase in pollution load of water or air.
A letter has been received from PSEB vide which is it has been intimated
that a large number of green category industries are operating particularly in Ludhiana
in non-designated area but predominantly residential area, the industries are operating
in over load thus causing revenue loss to PSEB. The PSEB has requested to release one
time 100% load to such industries with certain conditions, which will not cause any
increase in pollution load.
The Board vide its notification no.178/98/1 dated 20.1.1998 decided the
marginally polluting industries as per Schedule-I which cater to the daily need of the
community shall be permitted to be sent up within commercial and other than
residential area of the town after obtaining consent to establish from the Punjab
Pollution Control Board under green category and in municipal areas other than
residential and commercial, consent to establish will be granted on merit after assessing
the suitability in each individual case. Though the Board in pressurizing to shift the
industries from the residential area, however, till date there is no such concrete policy to
shift the existing industries from the non-designated area to designated area. The main
green category industry in Ludhiana is relating to hosiery goods manufacturing. Due to
modernization to improve the quality of the product the latest machinery is being
installed and for which additional electric load is required. With this modernization or
increase in production there will be no increase in pollution load.
In view of the above, it has now been decided that the existing Green
category of Industries located in non-designated areas may be permitted an extension in
power load upto 100% of their existing available sanctioned load for the purpose of
modernization/expansion/regularization of over load subject to the following conditions:1.
The industry will submit an affidavit that there will be no additional of plant
and machinery generated pollution load consequent upon the increase in
power load upto 100% of the existing sanctioned load at the same located

and there will be no increase or additional in pollution load either on
modernization or by expansion.
2.
That the industry must have either valid consent to operate of the Board or
should have applied for the consent to operate of the Board for the existing
unit.
3.
That the industry shall apply for the ‘consent to establish’ on simplified Green
category prescribed proforma and shall deposit the requisite consent to
establish fee as applicable for the expansion/modernization of the project
irrespective of cost. The industry shall submit details of plant and machinery
to be installed with tentative extension in electric load.
4.
That this facility will be extended to the existing green category of industries
operating in non-designated area.
5.
That this relaxation in applicable only for modernization/expansion of the
industry restricted as one time benefit only.
6.
That this facility will not be extended for the establishment of new green
category of industries in non-designated area.
7.
This benefit of power load extension would be extended to small scale units
only and subject to the notification of Govt. of India no.477 (E) dated
25.7.1991.
8.
The industry shall shift its premises to designated area as and when the
Govt. formulates the policy of shifting of industries in future.
9.
The NOC shall not be any ground for not shifting the industry to the
designated area as and when Govt. frames the policy of shifting of industries.
These orders shall come into effect immediately.

Senior Environmental Engineer will issue of show cause notice, if any, needed
within 3 days from the date of receipt of the application. The show cause
notice must contain all the observations including discrepancies in the
feasibility report.

Application of the unit falling in the small scale category/competency of the
Senior Environmental Engineer, must be decided within the time period
prescribed.
7.
In case of the consent to establish application falls within the competency of
the HO complete case may be sent to the HO within 10 days of the date of
receipt of the application in the Regional Office. Such complete cases must
contain
the
recommendations
of
the
Regional
Office
and
Senior
Environmental Engineer including discrepancies in the feasibility report
submitted by the industry to contain pollution shall be handed over to the
concerned Environmental Engineer in the HO directly. He shall be responsible
to get it diaried and get it decided form the competent authority. In case of
show cause notice has to be issued, the same should be issued within 10
days of the date of receipt of the application in the Regional Office,
otherwise, such cases shall be finalized within the stipulated period of one
month from the date of its receipt in the Regional Office.
The existing procedure of sending the status of NOC application received
by the Regional Office to the Head Office will remain the same.
Any deviation from the above said instructions shall be viewed seriously.

ORDER
Whereas it is necessary and expedient to take immediate steps under
section 5 & 7 of Environment(Protection)Act, 1986 and rules framed there under
to maintain ecological balance in the State to prevent environmental degradation
and to avoid traffic and human health hazard.
And whereas Rice Shellers and Saila Plants in the State of Punjab have
been causing grave air pollution and causing hazard to traffic and human health,
and Appellate Authority constituted by the State Government under the provisions
of Water(Prevention & Control of Pollution)Act, 1974 and Air(Prevention &
Control of Pollution)Act, 1981 while considering the appeals of five rice mills
established in violation to the siting guidelines, issued an order directing the
Board to review the siting criteria.
And whereas to abate air pollution created by the Rice sheller and Saila
Plant units, Punjab Pollution Control Board has recommended siting guidelines,
emission standards and code of practices to be followed in respect of these units
in the State of Punjab.
Now, therefore, in supersession of orders issued vide endst. No.
10/48/2004/STE-4/1692-1708, dated 2.6.2005 and No. 10/48/2004/STE-4/250420, dated 23.6.2006 and in exercise of powers conferred under section 5 of
Environment(Protection)Act., 1986 read with Government of India, Ministry of
Environment and Forest, Department of Environment, Forests and wild life
Notification No. S.O. 289(E) dated the 14th April 1988 and in pursuance of the
provisions of section 7 of the said Act and Rule 4 of the of
Environment(Protection)Act., 1986 the Governor of Punjab, is pleased to issue
following revised siting guidelines for the New Rice shellers and Saila Plants in
the State as under:-

A)
New Rice Shellers and saila plants in the State of Punjab should be
located at :i)
In Focal Point and in designated Industrial Land use Zones,
ii) In rural zone of Master Plan (Statutory /Non-Statutory), rural zone
of Local Planning Area and in the agriculture land outside the rural
zone of Master Plan and Local Planning Area but shall be at a
distance of 500 meters from urbanisable limits of Master Plan and
2 Kms. from Local Body limits where the master plan are yet to be
prepared.
iii) 500 meters away from the bye-pass, National Highway, State
Highway and Scheduled Road.
[Point No.(i) to (ii) to be certified by D.T.P.]
iv) 500 meters away from the village Lal Dora/Phirni, Wild Life
Sanctuary, Zoo, residential area*, educational institution,
historical, religious places and protected monuments.
* The residential areas means the area under a scheme notified
by Punjab Urban Planning & Development Authority
(PUDA), Municipal Corporation, Municipal Council,
Improvement Trust or ay other authority/agency in the State.
(Point No. (iv) to be certified by Revenue Authority)
v)
Punjab Pollution Control Board will ask for certificate from
the District Town Planner/Revenue authorities within 15 days
failing which Board will be at liberty to issue NOC and the rice
millers will not have to approach the concerned authorities for
obtaining the requisite certificate. The requisite fee to be
charged by the Town & Country Planning Department will be
deposited by the industry as a separate Bank Draft alongwith
NOC fee of Punjab Pollution Control Board with the Board and
Punjab Pollution Control Board will forward the fee of
Planning Department to the DTP with the request to
report/comment regarding issues contained in A (i to iii) as
mentioned above, within 15 days failing which Board will be at
liberty to issue NOC.
vi)
All the rice Mils located outside the Municipal limits of towns
and cities and in the designated areas within the cities
established with NOC of Punjab Pollution Control Board will
be allowed to expand (only dry process i.e. no generation of
trade effluent)/modernize within their existing premises, if
pollution load of existing unit has been effectively taken care
of by the industry and no specific approval of District Town
Planner will be required.

(i) No new sheller shall be allowed between interaction of the
municipal committees having distance less than 2
kilometers.
(ii) Right of the way will be accepted as per revenue records
and minimum width of 15 ft. to 16 ft. of passage may be
provided for easy transportation instead of 22 ft.
(iii)The parking will be provided within the site.
(iv) All distances shall be measured from right of the way upto
pollution control device chimney.
(v) All these siting criteria specified above will be applicable
in toto and not in piece meal.

point. At this exhaust point, dust coming here will be passed through a dust
control system and air will be emitted through a stack of height 3 meters above
the roof of the building.

Policy of Punjab Pollution Control Board regarding
Consent Management/Authorization
After the enactment of the Water (Prevention and Control of Pollution) Act, 1974
and the Air (Prevention and Control of Pollution) Act, 1981, the Punjab Pollution
Control Board had framed policies / guidelines for consent management from
time to time as per the prevailing situations. Lastly, the Punjab Pollution Control
Board vide office order no. 4 dated 17/2/2010 has framed a comprehensive
policy for consent management so as to streamline the procedure for grant of
various statutory clearances viz-a-viz hassle free clearance to the entrepreneurs
to encourage industrial growth in the State. In order to have a sustainable
industrial growth in the State of Punjab, it was felt to review the policy/
guidelines of the State. Furthermore, the State of Punjab is in the process of
implementing the administrative reforms so as to achieve sustainable
development of the State.
Consent management Models of various State
Pollution Control Boards such as Tamilnadu, Gujarat and Haryana studied in
detail. The revised policy / consent management for grant of various statutory
clearances under the Pollution Control Laws, Environment (Protection) Act, 1986
and Rules framed thereunder, is encapsulated below:
A.
Categorization of industries
PPCB has categorized all existing as well as new industries into three
categories namely Red, Orange and Green keeping in view their
pollution
potential.
List

these
categories
is
attached
as
Annexure-1, 2 & 3.
However, if any additional category of industry is left out of the above
scheme, then a Committee comprising of Senior Environmental Engineer

(HQ-2), Senior Scientific Officer and Environmental Engineer (HO) will
decide the said category of industry as per its pollution potential.
B.
Consent to establish
No industrial plant, activity, operation, process, any construction project
including New Township, Industrial Township, Settlement Colonies,
Commercial
Complexes,
Hotel
Complexes,
Hospitals
and
Office
Complexes, Industrial Estates/Industrial Area can be established or
expansion of any existing industry/project can be carried out in the State
of Punjab except the industries exempted from consent management of
the Board, without obtaining 'consent to establish' under the Water
(Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control
of Pollution) Act, 1981. All the prospective entrepreneurs, who intend to
establish such projects as above are required to obtain consent to
establish of the Board u/s 25 of the Water act, 1974 and u/s 21 of the Air
Act, 1981.
The PPCB has evolved a common application form for
large, medium and small scale industries for consent management
and authorization, though the consent/ authorization would be
granted separately, which is available on the website of the Punjab
Pollution Control Board i.e. www.ppcb.gov.in The application to be filed by
the entrepreneur for ‘consent to establish’ shall be accompanied with
requisite documents, which are given as per Annexure-4 alongwith fee
prescribed by the Board, which is given as per Annexure-5.
The Punjab Pollution Control Board (PPCB) is accepting application
for consent management/ authorization of all large, medium and
small scale of industries for obtaining consent to establish (NOC)/
operate in the State thorough ‘Online Consent Management and
Monitoring System.’ However, small scale industries will have the
option to submit the hard copy as well.

Since the PPCB endeavours to become fully paperless, it does not
encourage the industries to submit offline consent application.
However, for the purpose of record, the Board accepts
one hard
copy of the application alongwith required documents duly signed by
the authorized signatory.
PPCB has adopted payment gateway system for all charges payable
to it with effect from 1.4.2013.
The Punjab Pollution Control Board will decide the applications for consent
to establish (NOC) of all industries to be set up in designated/
approved areas such as Industrial Area/ Industrial Estate/ Industrial
Focal Point/ approved Industrial Park/ Industrial Zone of the Master
Plan. However, the site clearance u/s 41 (A) of the Factories Act,
1948 will not be necessary for grant of consent to establish / operate/
authorization by the Board.
A copy of the NOC granted to the entrepreneur by the Board will be
endorsed to the Deptt. of Factories, Punjab. Also, a condition will be
imposed in the said ‘consent to establish’ to the effect that the
entrepreneur / industry shall obtain necessary statutory permissions /
clearances from all other concerned departments. Accordingly, the letter
no. CSA/04/P-48/7084-98 dated 22.06.2006 (Annexure-6) of the Board
stands omitted. However, Press Note 17 (1984 series) relating to site
clearance from environmental angle for the industries will remain
operative.
For industries to be set up in areas other than the area such as
designated / approved areas such as Industrial Area / Industrial
Estate/ Industrial Focal Point / approved Industrial Park / Industrial
Zone of the Master Plan, site clearance u/s 41 of the Factories Act,

1948 will be necessary before grant of consent to establish/
authorization by the Board.
In cases, where an industrial plot is allotted by any of the agencies
of the Government/ statutory bodies or by a project developer whose
project
of
industrial
park
has
been
approved
by
the
State
Government, certificate of allotment/ sale of plot by such an agency
will be considered for grant of consent to establish (NOC)/
authorization by the Board.
The PPCB will continue to grant consent to establish to any category
of
industries,
which
are
permissible
in
the
mixed
land
use
areas/zones as per by-laws of the notified Master Plan / draft master
plan. The Officers of the Board shall check the permissibility of
establishment of such industry in the mixed land use from the bye laws of the Master Plan.
In cases, where the site of the project is located in the area other
than areas such as designated/ approved areas such as Industrial
Area/ Industrial Estate/ Industrial Focal Point/ approved Industrial
Park / Industrial Zone of the Master Plan, certificate of its
location/situation from the nearest village lal lakir/ phirni/ MC limits
from the Revenue Authorities such as

Additional Deputy Commissioner or the Sub-Divisional Magistrate
would be required for grant of consent to establish (NOC)/
authorization by the Board.
PPCB will grant NOC to new industries of all categories, which are
proposed to be located in the designated Industrial zones/areas of
the notified/draft Master Plan on the basis of undertaking submitted

by the entrepreneur to the effect that the proposed site of the
project/industry is located in the designated Industrial zone/area o f
the notified Master Plan or draft Master Plan in which the
establishment
of
such
industry/project
is
permissible.
The
undertaking to be submitted by the entrepreneur should clearly
indicate the revenue entries i.e Hadbast Number, khewat / khatauni
number and Khasra numbers. A copy of the said NOC alongwith
undertaking and location plan of the industry clearly indicating the
category of industry (red/orange/green) would be sent by the
concerned Senior Environmental Engineer/ Environmental Engineer
to the concerned District Town Planner of the Department of Town &
Country Planning, Punjab / Local Body / Development Authority (also
an intimation in this regard will be sent through e-mail) with the
request
to
intimate
the
applicant
(project
proponent)
under
intimation to the Punjab Pollution Control Board within 15 days, if
the said authority has any objection to the location of the project at
proposed site. In the said endorsement, it would be mentioned that
in case no reply is received from the aforesaid Authority within 15
days, then, it would be presumed that the proposed site is suitable
for the project from the point of view of above referred Competent
Authority. However, in case of any objection to the location of the
project by the above referred Competent Authority or if any of the
undertakings or documents are found wrong, the NOC granted to the
project would be deemed to have been cancelled and the Board
would not be responsible for the cost incurred by the project
proponent on the basis of the said NOC. In addition, a condition
would be imposed to the effect that in case any change/ amendment
in the draft Master Plan are required, then the continuance of the
project would be subject to such changes / amendments in the draft
Master Plan by the Competent Authority.

As per Office Memorandum dated 21.11.2006 of the Ministry of
Environment and Forests, there is no link of consent to establish
(NOC) of the new industries/ projects/ activities to be granted by the
Board under the Water Act,1974 and Air Act, 1981 with the
environmental clearance under EIA Notification No. 1533 (E) dated
14.9.2006.
The feasibility report to be submitted along-with the application for NOC
shall be prepared by a consultant having acquired at least Bachelor’s
Degree/AMIE in Environmental Engineering/ Chemical Engineering/Civil
Engineering from a recognized Institution/University or from the institution
having degree courses in Environment / Chemical/Civil Engineering field.
Besides the above, Charted Engineers to be approved by the Board will
also be competent to prepare a feasibility report. Such consultant/Charted
Engineer/Institution will append an undertaking to such an effect with the
feasibility report relating to the above mentioned qualification.
C.
Revalidation of Consent to establish (N.O.C)
Every entrepreneur is expected to complete the construction of industrial
unit/ project and the installation of the pollution control equipments within
the validity period of the N.O.C. But in case the industry/ project promoter
fails to implement the project within the validity period of the N.O.C, then,
the industry/project promoter will be required to get the NOC revalidated.
For this purpose, the industry is required to submit the progress made
regarding the installation of Pollution control devices viz-a-viz main project
to the concerned Regional Office of the Board. Such request shall be
acceded to only if the progress made by the industry regarding installation
of pollution control devices is commensurate with the main project both in
physical as well as financial terms. For extension in the validity of NOC for
a further period of one year/part of year, the industry/project promoter

shall be required to pay 50% of the normal fee applicable for one year.
The fee will be charged on yearly basis and for a fraction of the year, the
consent fee will be charged for full year. For extension in the validity of
NOC, the industry/project promoter shall apply on the prescribed
proforma.
The validity of ‘consent to establish’ (NOC) can not be extended beyond
five years from the date of issuance of the same, in any case. In case, any
industry/project promoter applies for extension in the validity of NOC
beyond the period of 5 years, then, such industry/project promoter must
be asked to apply afresh for NOC from pollution angle and the same will
be dealt/processed/decided as per the policies/guidelines prevailing at
that time.
D.
Consent to operate to new units/projects/activities

Before putting into operation any industrial plant /project/ activity,
the entrepreneur is required to obtain consent of the Board to
operate an outlet u/s 25 of the Water (Prevention & Control of
Pollution) Act, 1974 and to operate an industrial plant u/s 21 of the
Air (Prevention & Control of Pollution) Act, 1981.
The Punjab
Pollution Control Board has prescribed a composite proforma for
obtaining consent to operate of the Board for all category of
industries/projects, which is available on the website of the Punjab
Pollution Control Board i.e.www.ppcb.gov.in. The entrepreneurs
shall file a Composite Application Form for obtaining consent to
operate u/s 25/26 of the Water Act, 1974 & u/s 21 of the Air Act,
1981 and authorization under rule 5 of the Hazardous Wastes
(Management, Handling & Transboundary Movement) Rules, 2008.
On the said application, separate consents and authorization will be
issued by the Competent Authority. The application to be filed by
the entrepreneur for consent to operate shall be accompanied with

the requisite documents, which are given in Annexure-7 and fee
prescribed by the Board, which is given in Annexure-5.

In case any existing industry/project promoter expands its
industrial activities / modernize its industrial plant / make any
technological changes in the manufacturing process resulting into
increase in the air / water pollution load, the industry/ project
promoter is required to obtain varied consent under the provisions
of the Water Act, 1974 and Air Act, 1981. The entrepreneur is also
required to file an application for renewal of the ‘consent to
operate’ after the expiry of the same. The requisite documents
required for renewal/varied consent and the prescribed consent fee
are given in Annexure-8 & 5, respectively.

The
Board
will
grant
consent
to
operate
to
all
the
industries/projects/establishments in the areas / zones, where such
industry/project/establishment is allowed to establish.

The project proponents / industries are required to submit a
building plan prepared and duly authenticated by the Director of
Factories/Chartered Architect/Chartered Engineer as may be
authorized to do so under the provisions of section 3-A of the
Punjab Factory Rules, 1952. List of Chartered Architects notified by
the Department of Factories is available on the website of
Department of Factories.

e-governance system for authorization/consent management has
been implemented by the Board and all requisite details will need
to be submitted by the applicant online and he will be able to
down-load the certificate of consent/ authorization of the Board
soon after the approval of the competent authority.

The MoEF vide notification No. S.O 23(E) dated 08.01.1997 has
delegated the powers vested in the Central Govt. u/s 5 of the
Environment (Protection) Act, 1986 to the Chairman of the State
Pollution Control Boards to issue directions to any industry or any
local or other authority for the violations of the standards and rules
relating to hazardous wastes notified under the Environment
(Protection) Act, 1986. Furthermore, the MoEF vide notification No.
S.O 327(E) dated 10.04.2001 has delegated the powers vested in
the Central Govt. u/s 5 of the Environment (Protection) Act, 1986
to the Chairman of the State Pollution Control Boards to issue
directions to any industry or any local or other authority for the
violations of the standards and rules relating to Bio-Medical Waste,
Hazardous Chemicals, Industrial Solid Waste and Municipal Solid
Waste including Plastic Wastes notified under the Environment
(Protection)Act,1986.


residential area of any town/city of the State of Punjab and no
red/orange category of industry shall be given consent to establish

industries, which are permissible in the mixed land use areas/zones as
per by-laws of the notified Master Plan / draft master plan.




to all industries not having any hazardous process, existing and
operating in non-designated industrial areas prior to the date of
notification of Master Plan provided the industry complies with the
prescribed norms for the discharge of effluent/ emissions.

The project proponents/ industries will be required to submit a building
plan prepared and duly authenticated by the Director of Factories/
Chartered Architect/ Chartered Engineer as may be authorized to do so
under the provisions of section 3-A of the Punjab Factory Rules, 1952.
List of Chartered Architects notified by the Department of Factories is
available on the website of the Department of Factories.


I.
Consent Fee:

Consent

22/10/2009 (Annexure-5). The consent fee for the period 22/10/2009
upto the period for which the consent is to be granted, shall be charged
as per the said annexure.

The consent fee for the period 1/4/1992 to 9/10/1994 will be calculated
as per fee criteria given in Annexure-18. The consent fee for the period
10/10/1994 to 30/9/2004 will be calculated as per fee criteria given in
Annexure-19 and consent fee for the period 1/10/2004 to 21/10/2009
will be calculated as per fee criteria given in Annexure-20.

For clarification, illustrative examples as to how the consent to
establish/operate fee is to be calculated are given in Annexure 21, 22 &

J.
Procedure for processing the cases for restoration of power
supply / release of Bank Guarantee/withdrawal of
directions.
 Temporary restoration shall be granted for a period of six month in the
first instance and samples will be collected with a minimum gap of 45
days and maximum gap of 55 days during the temporary restoration of six
months. Case for temporary restoration, grant of consent for temporary
period shall be approved by the competent authority on a case to case
basis as per competency. Thereafter, the case will be considered for
permanent restoration. Accordingly, Board's circular no. 14442 dated
26.01.1999 (Annexure-24) and no. 975-96 dated 9/3/2000 (Annexure25) as amended on 3/5/2001 (Annexure-26) relating to temporary
restoration of electricity shall remain in force with aforesaid amendment.
 The industries to whom notice/directions for closure have been/are to be
issued for violation of environmental statutes will be visited and inspected
by the Env. Engineer of the concerned Regional Office. However, the Env.
Engineer may get the assistance of any officer/official posted in the
Regional Office for conducting the visit. Therefore, the Office Order No.

(i)
Consent to establish
The validity period of consent to establish under the provisions of
the Water (Prevention & Control of Pollution) Act, 1974, the Air
(Prevention & Control of Pollution) Act, 1981 will be for one year.

After obtaining the consent of the Board, the industry will intimate
the concerned Regional Office of the Board that its ETP/ APCD has
stabilized and shall make a request to the said Office within 3
months to carryout performance study / sampling of pollution
control devices. If, the industry does not convey to the Board, then
it will be the responsibility of the Regional Office to visit the
industry for carrying out monitoring after 3 months but not later
than 6 months. In case, the industry is found violating the
conditions of consent, the industry would be liable for action under
the
provisions
of

Frequency of visit / sampling of the units shall be in accordance with the
guidelines issued by the CPCB, a copy of which is enclosed herewith as

PPCB has prepared a list of 131 industries for exemption from its
consent management, which has been submitted to Central Pollution
Control Board for approval. Since the CPCB has not conveyed any
objection to the proposed list, PPCB will grant exemption to all these
industries. A list of the industries exempted from the consent
management under the Water Act, 1974 and Air Act, 1981 is appended
as Annexure-29.

The Board's order no. EE-I/Gen-214/F-2 dated 31/8/2000 (Annexure30) and as partially amended vide office order no. 2 dated 16/9/2002
(Annexure-31) stands omitted.

The Board vide Office Order No. GPC/Hosiery/Inds/F.203/2010/2 dated
27.1.2010 (Annexure-32) raised the investment limit from Rs.25
Lacs to Rs.1 Crore relating to hosiery manufacturing as mentioned at


The Board vide Office Order No. GPC/Inf.Tech/F.53/2010/3 dated
16.02.2010 (Annexure-33) has exempted 'Information Technology'
industry/Knowledge Industry from the Consent Management of the
Board under the provisions of the Water (Prevention & Control of
Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act,
1981 for five years subject to certain stipulations. Subsequently, the
Board vide Office Order No. GPC/Inf.Tech/F.53/2010/268 dated
04.10.2011 (Annexure-34) has made amendment in Office Order
No. GPC/Inf.Tech/F.53/2010/3
dated 16.02.2010
in
respect of
condition No. 4. Both these Office Orders will remain operative.

The Board vide Office Order no. HQ-2/Solar PV/F-322/2010/08 dated
05.01.2011 (Annexure-77) has exempted the solar photovoltaic
plants
having
capacity
less
than
5MW
from
the
consent
management system of the Board under the Water Act, 1974 and Air
Act, 1981 for five years subject to certain stipulations. This Office
Order will remain operative.

The Govt. of Punjab has prescribed the following time period for deciding
the application for consent to establish / operate under the Water
(Prevention & Control of Pollution) Act, 1974 & the Air (Prevention &
Control of Pollution) Act, 1981 under the Punjab Industrial Facilitation Act,

Miscellaneous

In order to encourage self-discipline amongst all industries,
PPCB will accept environment audit reports from the Chartered
Engineers. The Board would notify a panel of Chartered
Engineers to facilitate the industries to select any one of them
for environment audit and the same will be circulated to all

monitoring
the
intensity
of
pollution
and
online
surveillance of highly polluting industries, PPCB will facilitate
installation of CCTV cameras.

PPCB will endeavour to take snap shots of industrial emissions
at any point of time and maintain a record of industries for
one month through digital video recorder (DVR). The said
snaps would be used as an evidence to take action against the
defaulting industries.

