THE HERALD • December 17, 2014 • Page 6 Obituaries HOWARD LAVAKE Howard E. Lavake, 88, passed away late Tuesday, Dec. 9, 2014, at the Hansford Manor in Spearman, Texas. Howard Eddie Lavake was born Nov. 4, 1926, in Stratford, Texas, to Avenell (Naugle) and Eddie Kay Lavake. He was stationed several places, including Montana and South Dakota. After retirement, Howard and Barbara spent many years traveling and parking their fifth wheel at Truth or Consequences, N.M., or LaVeta, Colo. Everywhere he went, Howard made friends and enjoyed visiting. He was a member of the American Legion, VFW and the First Baptist Church. Barbara passed away in Truth or Consequences on Nov. 13, 2004. Survivors include his three daughters, Glenda Hill of Guymon, Okla., Carolyn Johnson (Kerry) of Guymon, Okla., and Ronda Purvines (Jeff) of Gruver, Texas. Teresa was born on Aug. 22, 1952, in El Paso, Texas, to Alfredo and Corina (Limas) Galaviz Jr. She www.theheraldtorc.com spent most of her adult life in the Oregon and Washington area, where she retired from the phone company after 35 years. She moved to El Paso, Texas and the Truth or Consequences, N.M., area to be near family. While living in Truth or Consequences, she enjoyed working with the elderly in home health care, meeting new people and spending time with friends and family. Teresa was preceded in death by both sets of grandparents; Uncle Bobby; father, Alfredo; brothers, Andy, Bunny and Eddie; and, of course, her fur babies. She is survived by her mother and stepfather, Corina and Pete Garcia; sister and brother-in-law, Cathy and Terry Schade; brothers and sisters-in-law, Jimmy and Sandy Galaviz, and Ruben and Janice Galaviz; aunt, Petra Muro; dear friend of 40 years, Anita Nelson; and many more aunts, uncles, cousins, nieces and nephews, too numerous to mention. The ladies arrived in their Christmas finery. Lovely Christmas sweaters, blouses some even wore their Santa Hat. The dinning room was decorated with three lovely Christmas trees. One was a red tree with purple Ornaments. The registration table had a lovely red tablecloth and a garland of purple poinsettias entwined around a Christmas candle and a small gold foil tree. The door prize table this month was covered in toys that the ladies brought to donate to the children’s tree at the Bank of the Southwest. All the dinning tables had red and purple foil garland entwined down the middle. At each place setting was a Christmas napkin, Christmas candy in the shapes of Santa, Snowmen, Gingerbread men and Snowmen. Down the middle of the tables was small foil Christmas trees in colors of red, gold, silver and green. Gayle Hector had home made breads wrapped in Christmas paper that were also on the tables. Janet Frankland brought a red wagon full of houseplants. All of these goodies were to be given away later during the luncheon. Bobbi welcomed everyone and the birthday ladies were recognized. This month they were Linda Christopherson, Judy Holt and Juanita Silva. Everyone sang Happy Birthday to them and pictures were taken. Our Snow Swan this month was Judy Holt. Our lovely Pink Princesses were Tiffiny Asbell, Gracie Lynn Woolf, Felina Woolf and Melissa Woolf. After enjoying a delicious meal of Chicken cordon blu with basil crème sauce, steamed vegetables, basmati rice, garlic bread sticks and apple pie---yummy the ladies had a time of sharing. The ladies that shared things were Tiffiny Asbell, Linda Christopherson, Gayle Hector, Berniece Langner. Gracie Lynn Woolf and her sister Felina entertained everyone with two Christmas Carols. Bobbi then presented her faithful helpers Artis, Katly, Norma and Joyce with a thank you gift for always coming early and helping set up. Names were then drawn for the winners of 23 prizes of a foil Christmas tree, home made breads or houseplants. The 50/50 winner was Dee Myers. Januarys Sassy Red Hat Luncheon will be the annual Classic Black and White with a touch of Red. This will be the first Wednesday of the month January the 7th. Wheeler Attorney at Law Codicils have been used by attorneys over the years for the purpose of changing, or adding to, a pre-existing last will and testament. For the reasons stated below, I have avoided using codicils for such purposes. Instead, I recommend that the client simply do a new, updated last will and testament. Moreover, many lawyers who do wills in some volume for clientele, keep their client wills on a computer flash drive so that, when revisions are needed by an existing client, the old will can be downloaded from the flash drive for relatively easy changes. A more practical reason for avoiding codicils can be demonstrated by one of my court experiences. on Nov. 25, 2014. She retired to Sierra County from Southwestern Bell in El Paso, Texas. She moved to New Braunfels, Texas to spend her latter years with her daughter, Lanette, sonin-law, Frederick Castle and family. *** In one memorable case involving a decedent’s estate, the testator had done multiple codicils following the execution of the original will. Not all of the codicils were found. Those which remained left the testator’s intentions in a severe state of uncertainty. Competing heirs and their lawyers had a field day. Compromises were eventually reached, but the attorneys received substantially more from the estate than the decedent’s intended beneficiaries. Whoever the intended beneficiaries were under this will/codicil combination became a matter of conjecture and, unfortunately, one which resulted in an unhappy compromise by all to avoid endless litigation, which would have no foreseeable outcome. Everyone felt they had lost. Indeed, they did. My advice: avoid codicils. Simply do a new will. ~~~ Editor’s Note: John Wheeler practices elder law in Truth or Consequences.
