First,thenum berofcom plaintsreceived by theFTC againstcntities ow ned orcontrolled @ by Defendantsand theresultsofthetelephonicsurvcy indicatethatDefendantsareengaged in unlawfulactivity. In m y exporience,842 com plaintsfound in one investigation isunusually * high.Though each casediffers,acasewith morethan 100 consum ercomplaintssuggeststhat deceptive or unfairacts exist. M oreover,mostvictim sofconsum erfraud do notcomplain to the FTC. Thus,itislikely thatthenum berofconsum ervictim s isgreaterthan the num berof * complaints. 189. Second,these com plaintsare very consistent. A side from the few com plaintsthatlack enough detailto determ inc the issue the consum erisaddressing,almosta1lofthe complainants * and survey respondents expressthatthey w erebilled orm oney w asrem oved from theiraccount w ithoutauthorization. The am ountofthe transaction isconsistentaswell. A lm osta1lofthe * consumersstatethatapproximately $30waswithdrawn from theiraccount.Theconsistencyof the consumers'accountsbolsterstheircredibility. M oreover, insidersw orking forldealand Focuscorroborate thatno consum ersauthorized the transactionsinitiated by D efcndaatsor * wanted theirproducts. 190. n ird,the D efendants'use oflargenum bers ofbilling descriptors suggestsan unfair billing schem e,especially becausetheirproductofferings were very sim ilar.
