Student Housing Lease Agreement Dated: ________________ 1. PARTIES: The parties to this agreement are Freedom Plaza L.L.C. dba Central Plaza, herein called the “Owner” or “Landlord”, and the person below signed, hereinafter called “Student” or “Resident”. 2. LOCATION: Central Plaza, 930 E. Second Street, Edmond, OK, 73034 hereafter called “Premises” or “Leased Premises”. These terms may throughout this Lease Agreement also include the “Student’s Room”. 3. TERM : Select all that apply a. ____ Summer Session 2015, move-in begins May 18, 2015. Move-out on or before July 31, 2015. If you lease a room at Central Plaza for the Fall Semester, you do not have to move out. b. ____ Academic Year (2 semesters), move-in begins August 8, 2015. Move-out on or before May 15, 2016. c. ____ Other, beginning date_____________________ and ending date _______________________. 4. RENT: Rent is payable according to the Payment Schedule Addendum included in this Lease Agreement. Select the one that applies: a.____ Double Room: $5250 per Student, per Academic Year (2 semesters), based on 2 Students per room. b.____ Triple Room: $3900 per Student, per Academic Year (2 semesters), based on 3 Students per room. c.____ Summer Session: $1050 per Student, based on 2 Students per Double Room. d. ____ Other: __________________________________ 5. LATE CHARGE: A late charge of $5 per day will be assessed for each day the rent is late. 6. OCCUPANCY: Upon receipt of all of the following: a) first installment payment, b) this completed and signed lease, and c) Parental Guarantee form, the student will be issued a key and will have the right to occupy the premises during the period outlined in the Term Section. 7. COLLECTION FEES: In the event the rent is delinquent, the parent will be responsible for past due rents. In addition, if the account is turned over to a collection agency Student agrees to pay all fees associated with collecting the delinquent rent, including reasonable attorney’s fees. 8. FAILURE TO MOVE-IN OR VACATES: If a Student fails to move into the Premises, rent will not be refunded. If a Student vacates the Premises, rent will not be refunded. 9. CONDITION OF PREMISES. Student stipulates, represents and warrants that Student has examined the Premises within three days of move-in and that the Premises are at that time in good order, repair, and in a safe, clean and tenantable condition. INSURANCE: Student assumes all risk of loss or damage to Student’s property within the Premises which may be caused by water leakage, fire, windstorm, explosion, tornado, earthquake, acts of God or other cause or by the act or omission of any other Student at the Premises, its guests and invitees. Student shall be responsible for insurance of all Student’s personal property located or stored upon the Premises against the risks of damage, destruction, or loss resulting from theft, fire, storm, or all other hazards and casualties. The Owner will not be responsible for the loss of said property. 11. DAMAGES AND REIMBURSEMENT: Student shall promptly reimburse the Owner any money spent by Owner due to Student’s intentional acts or neglect. Student is responsible for all intentional acts or neglect by the Student or any of the Student’s family, friends, and others who use the Leased Premises. Owner shall not be liable for injury or damage caused by water, rain, snow, earthquake, tornado or other natural disaster. 12. CARE OF LEASED PREMISES: The Leased Premises and other areas reserved for Student’s private use must be kept clean. Trash must be disposed of at least weekly in the receptacles located on the Premises. Owner may exclude from the Premises guests or others who, in Owner’s judgment, have been violating the law, violating this Lease Agreement or any rules, or disturbing other residents, neighbors, visitors, or Owner representatives. Students shall be responsible for the prevention of growth and accumulation of mold within the Student’s room. Student is advised to keep the Leased Premises clean and free of visible moisture and/or mold on any surface within the Premises. Should a water leak or any other water damage occur within the Premises, the Student is required to notify the Owner immediately so that repairs can be made to avoid any further damage which could result in mold accumulation. Students will be held responsible for any physical or monetary damages that develop in the Premises as a result of student negligence. Owner is not liable for any injuries (physical or otherwise) sustained by the Student, their family or guests, which result from water damage or mold accumulation for which the Student is responsible. 13. PARKING: This Lease Agreement includes one parking space as long as the Student has registered a vehicle with the Leasing Office and has displayed a valid parking sticker on said vehicle. The parking space allotted the Student will be used for one “Vehicle” described as a car, SUV, pickup truck, or motorcycle. If the Student does not have a registered vehicle, the Student forfeits his/her rights to a parking space and Student cannot assign the forfeited space to any other person. 14. CASUALTY LOSS: Student agrees to release, indemnify and defend Owner and Owner’s agents from and against liability for injury to the person of the Student, Student’s agents, Guests or invitees, or to any members of Student’s household resulting from any cause whatsoever, except only such personal injury caused solely by the negligent or intentional acts of the Owner or its agents or employees. 15. ANIMALS: No animals including, but not limited to, mammals, reptiles, birds, fish, rodents, and insects are allowed, even temporarily, anywhere on said Premises, including the Student’s room. If Student or any guest or occupant violates animal restrictions (with or without Student’s knowledge), Student will be subject to charges, damages, eviction, and other remedies provided in this Lease Agreement. If an animal has been in the leased Premises at any time during Student’s term of occupancy Owner will charge Student for any de-fleaing, deodorizing, and shampooing. Owner may keep or kennel the animal or turn it over to a humane society or local animal control agents. This does not apply to service dogs (see Rules Addendum, Animals). 16. EARLY TERMINATION OF LEASE: If a Student willfully moves out in the middle of the Lease Term, the Student must pay the remaining balance of the Lease Payments. Page 2 of 8 17. USE OF PROPERTY: Student will use the property only for residential purposes and agrees to abide by all rules set forth in the Rules Addendum contained within this Lease Agreement. The use of all tobacco products, alcohol, and drugs are prohibited on the Premises, including the Student’s room or any room of another Student. 18. CRIMINAL ACTIVITY: ANY CRIMINAL ACTIVITY COMMITTED BY A STUDENT OR BY ANY MEMBER OF THE STUDENT’S HOUSEHOLD OR ANY GUEST OR OTHER PERSON UNDER THAT STUDENT’S CONTROL IN OR AROUND THE PREMISES, SHALL BE GROUNDS FOR IMMEDIATE TERMINATION OF THE LEASE AGREEMENT. 19. UTILITIES: Utilities (water, gas, electricity, wi-fi) are included in the Student’s rent. Cable TV and phone service are not provided in the student’s room and is NOT INCLUDED in the utilities. Cable TV in the common areas will be provided by the Owner. 20. END OF LEASE (STUDENT HOLD-OVER): Student agrees to move out of the Leased Premises at the end of the Lease Term set forth herein. Student understands that once the lease has ended, the Student cannot remain in the Leased Premises, which includes the Student’s room. If the Student does not move out at the end of the Lease, Student will agree to pay $50 per day plus any and all costs incurred by the Owner due to the Student’s unlawful occupation and failure to move out of the Leased Premises on the agreed upon end date of this lease. Such hold-over shall not constitute a new lease nor any renewal or modification of the terminated lease. 21. ABANDONMENT: Any of the Student’s personal property or possessions remaining on the Premises after the Student moves out will be considered to be abandoned property. Student waives and gives up all rights to the abandoned property. The Owner will have the right to remove, without notice to the Student, and dispose of any abandoned property in any manner determined by the Owner. If at any time during the term of this Lease the Student abandons the Premises, the Owner may, at the Owner’s option, obtain possession of the Premises in the manner provided by law, and without becoming liable to Student for damages or for any payment of any kind whatever, the Owner may, at the Owner’s discretion, as agent for Student, re-let the Student’s room for the whole or any part of the then unexpired term of this lease, and may receive and collect all rent payable by virtue of such re-letting, and, at the Owner’s option, hold Student liable for any difference between the rent that would have been payable under this agreement during the balance of the unexpired term, if this agreement had continued in force, and the net rent for such period realized by the Owner by means of such re-letting. 22. SURRENDER OF PREMISES: Upon the expiration of the term hereof, Student shall surrender the Premises in as good a state and condition as they were at the commencement of this agreement, reasonable use and wear and tear thereof and damages by the elements excepted. 23. OWNER’S RIGHT OF ENTRY: Owner reserves the right to enter the Student’s room at reasonable times to determine if cleaning and/or repairs are needed or to show the Student’s room to a prospective Student. Before entering a Student room, the management will make every effort to contact the student in advance. Landlord may enter the property at any time without advanced notice when there is reasonable cause to believe that an emergency exists, a lease violation is occurring, or to perform routine or emergency maintenance, whether or not requested by the Student. For example, if there is a disturbance reported by a Student, Resident Assistant, or agent of the owner, the building Manager has the right to call the police and enter Student’s room. Another example, if the sound of an animal is coming from your room, the Owner or its agents can enter without notice because having a pet is a violation of this Lease Agreement. Whenever possible, a 24-hour notice will be given to the Student prior to the owner or owner’s agents entering the Student room. Owner, or owner’s agents, will perform periodic inspections of the Student’s room to insure that it is being maintained in a safe and sanitary condition. Student understands that the Owner may photograph or videotape the Page 3 of 8 Lease Premises before move-in, during periodic inspections, and following move-out to document room damage and Condition. 24. TERMINATION: In the event of a violation by the Student occupying the Premises or by their guests of any Provision of this Lease, the Owner reserves the right to terminate the Lease. 25. CAUTION: This Lease is a binding legal obligation. The Student is signing this Lease for the term set forth on Page 1 of this Agreement, which means the Student is legally liable for the entire rental fee. If you have questions, consult the Leasing Office. At Student’s expense, the Student may also consult with an attorney about the terms of this Lease Agreement. 26. ATTORNEY’S FEES: Should it become necessary for Owner to employ an attorney to enforce any of the conditions or covenants hereof, including the collection of lease payments or gaining possession of the Premises, Student agrees to pay all expenses so incurred, including a reasonable attorney’s fee. 27. MOVE-IN INSTRUCTIONS: Before the Student moves in, all Rent/Student loan award letters must be received along with the Parental Guarantee form. No keys will be given out to the Student until all paperwork is complete and rents are collected. 29. FURNISHINGS PROVIDED: A Double Room is equipped with 2 Queen Beds, 2 desks, 2 chairs, 2 Chests with three drawers, a Wardrobe and Closet, and nightstand. Two Students will occupy a Double Room. A Triple Room is equipped with 3 extra-long twin beds, 3 desks, 3 chairs, 3 chests with three drawers, two wardrobes and closet, and nightstand. Three Students will occupy a Triple Room. I UNDERSTAND THAT CENTRAL PLAZA is an off-campus private housing facility and that it is not affiliated with the University of Central Oklahoma or any other college or university. ONE LEASE AGREEMENT IS REQUIRED PER STUDENT: This Lease Agreement is binding only on the Student signing it. The Student’s roommate(s) must sign a separate Lease Agreement for the same rented Student Room. PARENT GUARANTEES: At least one parent of the Student signing this Lease Agreement is required to sign a Parental Guarantee form included in the Addendum section of this lease. Parental Guarantee must be received before any Student is allowed to move in. Guarantors will be notified in the event fines are issued or disruptive conduct notices are given. Owner is not responsible for lost, damaged, or stolen property. Fire Safety Fireworks and explosive devices are prohibited in or around the Premises. Residents can help keep their rooms and their neighbors safe from fire by adhering to housing regulations regarding these appliances: Microwave, less than 700 watts, one per room Refrigerator, less than 4 cubic feet, one per room Coffeemaker, must have automatic shut-off Iron, must have automatic shut-off NO HALOGEN LAMPS! NO CANDLES. NO CANDLEWARMERS. NO SPACE HEATERS. Fire-fighting equipment shall not be used except in the case of fire. Students should keep in mind that misuse of fire alarms and fire safety equipment is a violation of Oklahoma Law. Anyone found responsible for setting a false alarm will be subject to dismissal from Central Plaza. Hours There are no set hours when residents are required to be in the halls. All exterior doors are secured and each resident will have access to the exterior doors of the building. Residents assume responsibility for their keycard and for maintaining the security of the building when entering or leaving. Residents under 18, along with their parents, are advised to reach an agreement as to the hours the resident will keep. Central Plaza does not assume responsibility for residents when they are away from the facility overnight. No Alcohol Possession or consumption of alcoholic beverages is prohibited in and around the residence halls. No exceptions. No Smoking No smoking is permitted in or within 100 feet of Central Plaza. Overnight Guests Arrangements for registered overnight guests shall be made in advance with the Leasing Office. The Student will be responsible for the conduct of guests. The Student must get the permission of their roommate in advance. No guest of the opposite sex will be allowed overnight under any condition. No guest may stay for any combination of stays of more than 3 days in any given 30 day period. Page 7 of 8 Animals Due to the need for pest control, the potential for disruption, and safety and medical reasons, animals are not permitted in Central Plaza at any time. Guests are not permitted to bring pets. Individuals in violation may be assessed an associated cleaning and fumigation fee, mandatory removal of the pet and possibly disciplinary action. This policy does not apply to service and assistance animals approved as reasonable accommodation for people with disabilities. For information on accommodation, please contact the Central Plaza management. Quiet Hours It is expected that residents and their guests will respect the rights of others by maintaining a reasonable limit of noise at all times. What's loud? Loud is any level of noise that disturbs any other resident. Roof Residents are not allowed on the roof of Central Plaza. Violators will be subject to dismissal from the Premises and may be subject to a fine. Revoking a Lease Central Plaza management, by giving reasonable notice, may terminate a lease for one or more of the following reasons: a. b. c. d. disorderly, unethical, vicious or immoral conduct in or near the residence halls; misuse, abuse, theft or destruction of residence hall property; possession or consumption of alcoholic beverages; sale or knowing possession of dangerous drugs, restricted dangerous drugs or narcotics, as those terms are used in the Oklahoma statutes, except when lawfully prescribed pursuant to medical or dental care; e. possession or use of highly flammable materials, firearms, ammunition, fireworks, explosives, dangerous weapons or any other material or instrument which, in the opinion of the management, poses an unreasonable risk of damage or injury; f. general behavior in the residence halls, over a period of time, which indicates that the resident is not able to adjust to the requirements of group living; or g. failure to meet a specific payment schedule. Residents removed from Central Plaza may still be held financially responsible for the balance of the lease payments. Space Availability In the event that bed space becomes unavailable as the result of enrollment trends or conditions not reasonably foreseen at the time the lease agreement is made, Central Plaza reserves the right to reallocate space and reassign a resident to another room. Conditions include, but are not limited to, damage caused by floods, fires, earthquakes, or other natural disasters. Keys Your mailbox key will be issued to you when you check into your room. If you lose your mailbox key, obtain a replacement at the Leasing Office. The key replacement charge is $50. All students reside in a keycard access building, and if you lose your keycard, go to the Leasing Office for a replacement. A fee determined by Central Plaza will be charged. Central Plaza management reserves the right to change and/or supplement the rules. Residents will be notified when changes are made. Page 8 of 8
