Roll Call. 4. Public Comments: This agenda item is for public comments on city related non-agenda items. In accordance with State law, the City Council and City Staff are not allowed to respond to any comments made. Preference will be given to Choctaw Citizens and NO formal action will be taken. Business Agenda: The following items are hereby designated for discussion and consideration which requires individual action. 6. 5.1 Electing two (2) members to the Board of Trustees for the Oklahoma Municipal Assurance Group for three-year terms commencing July 1, 2015. 5.2 A request by Choctaw High School Band for a ‘Special Event Permit’ to hold a Color Walk/Run at Choctaw Creek Park on Saturday, August 29th and request a waiver of the park fees. 5.3 Consideration of Resolution No. 15-04 beginning the condemnation process on property owned by Reno 260 east of Hiwassee and north of Reno. New Business: This item is listed to provide the opportunity for Council discussion on items which may arise within twenty-four (24) hours prior to this meeting, and therefore, qualify as new business under the Oklahoma Open Meeting Act. 8. Section 307(B)(4)] 9.3 Discussion, consideration and possible action re: confidential communications between the City and its Attorney concerning a pending investigation, claim, or action if the City, with the advice of its Attorney, determines that disclosure will seriously impair the ability of the City to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest; concerning Pointon Properties, Inc. vs. City of Choctaw, Case No. CIV-12-1107-M. [Authorized by Title 25 O.S. Section 307(B)(4)] 9.4 Discussion, consideration and possible action re: confidential communications between the City and its Attorney concerning a pending investigation, claim, or action if the City, with the advice of its Attorney, determines that disclosure will seriously impair the ability of the City to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest; concerning Darrick James vs. City of Choctaw, Case No. CIV-15391-D. [Authorized by Title 25 O.S. Section 307(B)(4)] Action Request: Motion to go into joint executive session with the Choctaw Utilities Authority, at the advice of the City Attorney and to recess to consider the above matter(s); and to reconvene in open session to take possible action. Proposed Action Request on Executive Session items: 10.1 Council to provide direction to the City Manager and City Attorney regarding Executive Session items. 11.
