I do consent and duly authorise the Construction Industry Council and/or its authorised agents to conduct ant enquiries or investigations to verify the truthfulness of the statements, documents and the general information submitted in connection to this application, and to seek clarification from our bankers and clients regarding any financial and technical aspects of the application. This letter of application will also serve as authorisation to any individual or authorised representative of any institution referred to in the supporting information, to provide information deemed necessary and as would be requested by yourselves (Construction Industry Council or your Agents) to verify statements and information provided in this application, such as the resources, experience and compliance of the Applicant. Page 2 REGISTRATION OF CONSTRUCTION FIRMS AND SPECIALIST WORKS CONTRACTORS PROCEDURE, RULES, TERMS & CONDITIONS FOR REGISTRATION 1) Procedure for registration: The construction firm shall submit an application in the prescribed proforma to the Construction Industry Council (CIC) together with necessary documents in support of application. The CIC will take action to verify the credentials and antecedents of the construction firm and issue a “Registration Certificate” to the construction firm in the eligible Category and for the work discipline applied for. (a) Work Discipline The registration of construction firms will be done for the following Items of work: i. General building works; ii. General civil works; iii. Electrical contracting works iv. Mechanical contracting works; v. Specialist works; vi. Individual artisan works. (b) Categories for Registration The categories for Registration will be accorded as detailed below : i. General Building works will be registered as either B1, B2, B3, B4, B5 or B6. ii. General Civil works will be registered as either C1, C2, C3, C4, C5 or C6. iii. Electrical contracting works will be registered as either E1, E2, E3 or E4. iv. Mechanical contracting works will be registered as either M1, M2. M3 or M4. The categories for registration B6, C6, E5 and M5 refer to entry point of contractors while B1, C1, E1 and M1 refer to the largest construction firm in that category. v. Foreign construction firms shall be registered as BF, CF, EF or MF (F standing for foreign); and joint ventures shall be registered as BFS, CFS, EFS or MFS for those between a Foreigner and Swazi (F for foreign and S for Swazi, and BSS, CSS, ESS or MSS for those between two Swazi construction firms. contractors..Joint ventures consisting of foreign construction firms will be registered as BFF, CFF, ESS or MSS. vi. Foreign specialists will be required to pay double the amount. Form CICF1 Page 8 REGISTRATION OF CONSTRUCTION FIRMS AND SPECIALIST WORKS CONTRACTORS (d) Conditions for Categorization of Contractors: There shall be a categorization of construction firms as, determined by the Council Board every three years and the Council Board shall consider the following factors in the categorization process: i. Capacity (30%) - maximum annual turnover in any one year during the past 3 years (certified and/or invoiced) - fixed and moveable assets. - Directorship qualifications - professional staff (for larger construction firms - engineers, quantity surveyors, architect). - technical staff (technicians i.e. diploma related construction field). - skilled staff (artisans or on-job training) - Financial/Accountants - member of professional association. - bookkeeper (accounting diploma or on-job trained bookkeeper/clerk) - financial statements ii. Ownership (20%) - no. of shares held by Swazi citizens. iii. Management (20%) - no. of management staff made up of Swazi citizens. iv. Investment (10%) - existence of permanent offices in Swaziland. v. Experience (10%) - determined by previous projects undertaken. vi. Workload (10%) - current work being undertaken. (e) Processing Time Applications for registration shall be open from the 16th January to the 15th March of each and every year. Thereafter registration certificates shall be issued and a list of registered contractors shall be published at the end of March of every year. After this process, registration certificates shall be issued and a list of further registered construction firms shall be published at the end of September of each year, with the exception of new applicants. 2) Rules for registration: The Registration of construction firms and specialists shall be done at the Construction Industry Council (CIC) offices. a) Building, Civil, Electrical, Mechanical and Specialist Works to be registered into the contractor’s registry shall lodge an application with the CIC in form CICF1. b) In the case of any changes in the Partners/Directors, the construction firm shall be required to report to the CIC within one month of the date of such change. Form CICF1 Page 9 REGISTRATION OF CONSTRUCTION FIRMS AND SPECIALIST WORKS CONTRACTORS c) The name, address and other particulars of the Firm/Company should exactly match with those mentioned in all the License/Registrations/Certificates issued by various authorities. It is construction firm’s responsibility to keep all the Licences/Registrations/Certificates issued by various authorities up to date. A construction firm should produce all the renewed Licences/Registrations/Certificates to the CIC well before their expiry. d) A construction firm may not be disqualified from registration in the event that the required documentation is either incomplete or not submitted. In this instance, a construction firm will be allowed time to correct or submit the required documentation. e) Construction firms should be registered with Ministry responsible for company registration either as a limited liability company, partnership or sole proprietorship. f) A construction firm should have permanent staff that is qualified and experienced. Part-time employees and consultants cannot be considered as personnel resources for the registration process. g) It is mandatory for a construction firm to have a Technical Director as a requirement for registration. The Technical director shall be a shareholder, partner or sole-proprietor with certain minimum technical qualifications in the requisite field of application. For purposes of verification, the contractor will have to submit the necessary academic and professional certificates, Memorandum and Articles of Association in the case of limited liability companies. h) Construction firms who own plant and equipment will be required to produce proof of ownership such as blue books and/or invoices in their company or personal names to prove ownership. i) Construction firms will be required to have operational facilities. Construction firms must have successfully completed at least 3 construction works within their categories for eligibity to be considered for a higher category.. j) New applicants applying for registration shall be assessed on the basis of experience and capacity. k) Construction firms should demonstrate that they have sufficient resources to undertake a project. l) A construction firm that wishes change categories is free to apply to the Council, and the Council shall grade the construction firm to determine eligibility at the prescribed registration intervals. m) In the event that a construction firm is not satisfied with their new category as decided by Council in the grading process, the construction firm will be allowed to appeal to the Minister responsible for Public Works. n) Late renewal by contractors will carry a penalty of 20% of the renewal fees. 3) Information required for registration The following information must be provided: a) Certified copy of company registration.
