Waterloo, Iowa March 31, 2015
The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the
Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to
adjournment. The meeting was called to order and on roll call there were present: Tom Little, Chair; Frank Magsamen, John Miller
and Craig White.
Absent: Laylin.
Unless otherwise noted, all actions were approved unanimously, Laylin absent.
Moved by Magsamen, seconded by White that the AGENDA be received and place on file with the County Auditor as
approved. Motion carried.
PUBLIC COMMENTS. Bernadette Hite suggested to the Board that the space formerly occupied by the courthouse Law
Library be partially transformed into a reading room with books, maps and other materials pertaining to the history of Black
Hawk County or to county departments. She showed the Board some examples.
Miller moved the following resolution seconded by White.
BE IT HEREBY RESOLVED by the Board of Supervisors of Black Hawk County, that the Board of Supervisors APPROVE
EXPENDITURES, and that the County Auditor be authorized and directed to ISSUE CHECKS, against the various settlement of such

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said
that there have been a few frost boils showing up on gravel roads, where the ice is twelve to eighteen inches in the ground. That
the Dysart Road project has resumed, with the portion between Orange and Schrock Roads being closed with a detour. That work
is beginning on the US 218/C57 interchange, and C57 will be closed on both sides of Highway 218 on April 1. She said detour
routes are posted and maps are available in her office. She recognized Jan Hix, her budget administrator, who is retiring after
twenty years on the job. Little thanked her and also recognized Lois Matt of the Treasurer’s Office for organizing a peanut butter
drive for the Northeast Iowa Food Bank that raised $470 and sixty-four pounds of peanut butter. He also recognized Jon McNamee
of the Health Department for receiving the Iowa Environmental Health Distinguished Service Award.
Moved by Magsamen, seconded by White that the MINUTES of the Board Meeting held March 24, 2015 be and are hereby
approved as submitted. Motion carried.

8. The UNDERGROUND WORK PERMIT for Windstream Communications, Inc., Little Rock, Arkansas to replace cable
by plowing and boring in the north right-of-way of West Cedar Wapsi Road from Waverly Road east along West
Cedar Wapsi Road in Sections 11 and 12 of T90N R14W to accommodate the road grading for the Iowa DOT Hwy
218 interchange project as recommended by County Engineer, Catherine Nicholas.

Brian Delagardelle d/b/a Urban Services, Inc. gave his February Washburn Sanitary Sewer System update. He said there
were no locate requests and he replaced two pumps. That his pump inventory is two Extremes, one 2000 and fourteen rebuilds.
That a two-pump lift station went down in January, and while he made temporary repairs at the time, with the improved weather
he’ll have an end loader pull the station out and he’ll determine where the roots are coming from.
White moved the following resolution seconded by Magsamen.
BE IT HEREBY RESOLVED to AUTHORIZE and direct the Chair to sign the Fiscal Year 2016 Iowa Department of
Transportation Secondary Road Budget and Construction Program as recommended by Catherine Nicholas, County Engineer.

BE IT HEREBY RESOLVED that the BEST BID received from Liddle’s Eco Water Systems, Waterloo, Iowa for the water
softener project at the Jail in the amount of $37,536 (Option B) be approved and direct the Chair to sign for same as recommended
by Rory Geving, Maintenance Superintendent.
Geving said the funding is from the Jail Room and Board Fund. That the existing system is original to the building, and to
repair it would be 50% of the cost of a new system, while still retaining some original components subject to failure, so he felt total
replacement was wiser.

Moved by Miller, seconded by White to direct the County Auditor to ADVERTISE FOR A PUBLIC HEARING/BID OPENING to
be held at 9:05 on Tuesday, April 14, 2015 in Room 201 of the Black Hawk County Courthouse, 316 E., 5th Street, Waterloo, Iowa to
consider bids for Project LFM-1506--7X-07 Jesup Road Precast Reinforced Box Culvert in Black Hawk County, Iowa located on
Jesup Road .5 miles north of Brandon Road along the northerly line of Section 14, Township 87 North, Range 11 West. Motion
carried.
At Nine-twenty-five o’clock (9:25) a.m., a public hearing was held as provided by law in the Board Room 201 of the Black
Hawk County Courthouse, Waterloo, Iowa at which time all interested persons could appear to file objections on the proposed
Ordinance No. 136 “An Ordinance adding Title 4, Assessments to the Black Hawk County Cord of Ordinances for Wind Energy
Conversion Property” and if approved would become effective on April 24, 2015.
The Board of Supervisors examined proof of publication of notice and determined that the notice had been published
March 20, 2015 in the Courier in accordance with the requirements of the Code of Iowa.
Moved by Magsamen, seconded by White to receive and place on file proof of publication of notice of public hearing.
Motion carried.
Moved by Magsamen, seconded by White to waive the first reading. Motion carried.
There were no oral or written objections.
Kirk Kraft of RPMAccess Company said the proposed ordinance is the same as those found in twelve or thirteen other
counties. Miller said that he has heard concerns about long-range consequences like what happens if the wind turbine is
abandoned, and questions about the effects on the application of herbicides and pesticides to crops, and about aesthetics. Mr.
Kraft said that the turbines will only be erected with the consent of the landowner, and the agreement with the landowner
provides for RPMAccess Company to start putting money in an escrow account in year ten of the agreement for dismantling the
turbines. He noted that the county’s zoning ordinance requires that the turbines be removed at the end of their useful lives. He
said his company is on the hook for tile repair for the life of the project and beyond.
Moved by White, seconded by Magsamen to recess the public hearing until 9:05 a.m. on April 7, 2015 after oral and written
comments are received and filed. Motion carried.
