HIGH TECH CEMENT
10-Year Program Customer Warranty
WARRANTIES:
High Tech Cement, LLC. warrants that all High Tech Cement floor leveling products manufactured and sold by High Tech Cement LLC and the installation work
performed by Customer, that is performed in a workmanlike manner in accordance with industry standards and practices that also include: (1) jobsite training
from High Tech Cement, (2) completion of a pre-installation checklist, and (3) completion of a post-installation report; shall be suitable for the specified project
and perform as described in our current literature, free of installation and manufacturing defects, for one (1) year from the date of installation.
High Tech Cement LLC also warrants that all High Tech Cement floor leveling products manufactured and sold by High Tech Cement LLC, as described in our
current literature, shall be free from manufacturing defects, whether patent or latent (effective from the date of installation). This warranty extends to
Customer, their contractors who install our products and all owners of the buildings within a 10-year warranty period from the date of installation.
EXCLUSIVE REMEDY
The High Tech Cement product(s) must be installed according to the above instructions, using approved materials as enumerated in High Tech Cement's
specifications, all applicable building code regulations and applicable industry standards. High Tech Cement product(s) must be used within their shelf life and be
installed in accordance with High Tech Cement’s written guidelines and specifications (obtainable through the website at www.high-techcement.com) in effect on the
date of installation. For any valid claim presented under this warranty, High Tech Cement will, at its option, (a) repair the affected materials (b) replace the affected
materials with the same product, design and color, or if not available, supply an equivalent product(s) of similar cost and quality of our choice, any cost that was not
part of the original contract will be the responsibility of Customer.
EXCLUSIONS
High Tech Cement is not responsible for structural failure or workmanship not in accordance with manufacturer’s instructions and the applicable industry standards.
Problems caused by structural movement, which result in any subsequent damage to flooring materials will not be covered. In particular, but not limited to, tile or
flooring damaged or disfigured by expansion joint movement, slabs cracking and/or slab movement or moisture barrier system damage. High Tech Cement is not
responsible for normal wear and tear resulting from usage. High Tech Cement is not liable for losses due to delays or any other consequential damages. This Warranty
is not transferable.
DISCLAIMER OF WARRANTY
This warranty is in place of all other warranties, expressed or implied to the extent of the law. High Tech Cement expressly disclaims all other warranties, including
warranties of merchantability and fitness for a particular purpose. Although High Tech Cement may have suggested the High Tech Cement product(s) or developed
the High Tech Cement product at the request of the owner/applicator, it is the responsibility of the owner/applicator to test and determine the suitability of the
product(s) for the intended use and purpose, and the owner/applicator assumes all risk and liability regarding such suitability.
LIMITATION OF REMEDIES AND DAMAGES
The repair/replacement policy stated in this warranty takes the place of all other policies against High Tech Cement. In no event will High Tech Cement be liable for
special, indirect, incidental or consequential damages including lost profit, arising from or connected to the High Tech Cement product (s), or any use or misuse of the
High Tech Cement product(s), regardless of any strict liability or negligence of High Tech Cement and regardless of the legal theory (contract, tort or other) used to
make a claim. In no event will High Tech Cement be obligated to pay damages in any amount exceeding the original price of the High Tech Cement product(s) shown
to be defective. High Tech Cement may at its sole discretion choose to make some efforts beyond its legal obligations. Such additional efforts will not in any way
change the limitations of policies and damages stated in this paragraph or extend or change this warranty. Prior to pursuing any legal action, claims, disputes,
differences or disagreements between High Tech Cement and the owner, arising out of or relating to this warranty, which cannot be amicably settled, shall be
submitted to arbitration under the rules of the American Arbitration Association in effect.
WARRANTY CLAIMS
Since successful repair in many circumstances is timely, notice must be given as promptly as is reasonable to do to so. If failure to report a specific occurrence
contributes to the product failure, coverage under the terms of our warranty may be voided. Please contact High Tech Cement, in writing, within 30 days of the
discovery of the alleged defect in the High Tech Cement products covered by this warranty. The owner will provide High Tech Cement with a reasonable opportunity
to review and investigate the alleged defect. For any warranty claim that is not valid, the owner will pay High Tech Cement reasonable charges, including travel and
labor, associated with investigation of such claim. In your correspondence, include a brief description of the problem, any sales receipts, invoices, and manufacturing
codes as labeled on packaging or any other evidence indicating the approximate time of installation.

COMPLETE AGREEMENT
This warranty completely replaces and supersedes any prior oral or written warranties, agreements or representations of High Tech Cement relative to the system (if
applicable), the High Tech Cement product(s) or the application of such High Tech Cement product(s). No one other than an Officer or General Manager of High Tech
Cement is authorized to change this warranty or any of its provisions. This warranty applies to installations that take place beginning on or after June 1, 2011.
