TERMS AND CONDITIONS IN RESPECT OF Le French Marche Bakery WORKSHOPS

Applicable Activity
By participating in the activity organized by K11 Concepts Limited (“K11”) as set out in clause 2 below (the “Activity”), each participant is deemed to have read, understood and agreed to the terms and
conditions applicable to the Activity.
The Details of the Activity

To Participate in the Le French Marche Bakery Workshops (total 3 workshops and each shall be referred as a “Workshop” and collectively referred as the “Workshops”), from noon today to
2:45p.m. on 16 May 2015, anyone who spends Electronic Money at K11 Art Mall and obtains maximum two Eligible Receipt(s) with a total amount of HK$1,100 (KLUB 11 member: HK$800) or
more on the same day may enroll one person in a Workshop by presenting to K11 the said Eligible Receipt(s).

Dates, Times and Venue of the Workshops
Workshops will be held on 25 Apr, 26 Apr,3 May and 16 May 2015 between 3p.m. - 5p.m. on Atrium of K11 Art Mall. A person who signs up for the Workshops may choose to participate in any
Workshop on any one of the said dates (subject to availability).

Enrolling in the Workshops

Only persons aged 18 or above can enroll in the Workshops. For those who participate in the family workshop, such friend or relative must be aged between 6 and 12.
At the time of enrollment, a participant shall:

confirm the date and time of the Workshop selected;

provide his or her name, telephone number and the first four digits of his or her identification or travel document; and

pay an enrollment fee of HK$100 per participant enrolled (non-refundable) and no changes will be given..
K11 will gift a Crostini Gift Voucher of HK$100 (the “Gift Voucher”) on the same day to each of the persons who have completed the Workshop. K11 will not gift the Gift Voucher to
anyone who did not attend or complete the Workshop.

Official Receipt
The terms and conditions in relation to the official receipt of the Workshops (if any) shall form part of the Terms and Conditions herein.
Special Terms and Conditions applicable to the Workshops
(1)
Terms Used
(a)
Electronic Money
“Electronic Money” means credit cards, debit cards and Octopus cards.
(b)
Eligible Receipt
An “Eligible Receipt” means a machine-printed receipt issued by a merchant in K11 Art Mall on the day of enrollment in the Workshop for an Eligible Transaction together with the
relevant Electronic Money payment slip bearing the name of the person who enrolls in the Workshop, if applicable. K11 does not accept any photocopies or hand-written receipts and
reserves the right not to accept any receipts that K11 suspects to be invalid, forged, issued not for genuine transactions or on other grounds without any explanation.

Eligible Transaction
An “Eligible Transaction” means a consumer transaction paid by Electronic Money between anyone and a merchant at K11 Art Mall but excludes:
i. any purchase of cash vouchers, gift cards or coupons, stored value cards or pre-paid cards;
ii. adding value to Octopus cards, stored value cards or pre-paid cards;
iii. installment, partial, deposit or advance payments;
iv. any spending at Hyatt Regency Hotel;
v. charity donations;
vi. payment for membership;
vii. currency exchange; and
any bill payment (including but not limited to payment of telecommunication or utility bills).
Place of Enrollment
The enrollment shall take place at the Concierge on G/F of K11 Art Mall or any other counter as K11 may designate from time to time.
Copying Eligible Receipts
K11 has the right to make an electronic copy of each Eligible Receipt presented to K11 in the course of enrollment and to keep the electronic copies for audit purposes.
Marking on Receipts
K11 has the right to make any marks on each Eligible Receipt presented to K11 in the course of enrollment. The Eligible Receipt marked by K11 cannot be used for enrollment in the Workshop
or redeeming any other gifts or privileges in other promotional activities being held in K11 Art Mall again.
Limited Places
Each Workshop is limited to 10 people. No one can enroll in the Workshops more than once, irrespective of the Workshop date or time. Availability for the Workshop will be offered on a firstcome-first-served basis.
Interviews, Photographs and Videos of the Workshops
K11 is entitled to interview, photograph and video the participants of the Workshops during the Workshops, and the participants acknowledge that K11 shall have the right to use the photographs,
videos, audio-records and other information from the Workshops in any media and format throughout the world for promotion purposes.
No Exchange
The Workshops’ enrollment cannot be exchanged for cash or other gifts.
No Liability
The products and services of the Workshops are provided by the third party. K11 does not make any warranty in respect of such products and services and disclaims all liability in relation to such products and
services. The participant in the Activity shall waive all his or her rights and interest, if any, of any natures to pursue against K11.
Power to Terminate
K11 is entitled to terminate or cancel the Activity at any time without any prior notice. Should K11 terminate or cancel the Activity, the Deposits received will be returned to the persons who have paid the
Deposits.
Bad Weather Arrangements
(a)
If Hong Kong Observatory has hoisted, or has announced that it will hoist, a red rainstorm warning or above or typhoon signal no.8 or above within 3 hours before the start of the Activity, the Activity will
automatically be postponed without any prior notice. The participants will be notified of the re-schedule details in due course. If any participants elect not to participate in the re-scheduled Activity, K11
will arrange to refund the Deposit to such persons.
(b)
If during the Activity, the said warning/signal is hoisted, or the Activity is suddenly affected by weather or other circumstances, K11 is entitled to amend, vary, postpone or terminate the Activity without
other arrangements or any compensation to the participants. K11 will refund the Deposits to the persons who have attended the Activity.
(11)
Cancelled Transactions
If the transaction relating to the receipt used in enrollment in the Workshop is subsequently cancelled or reversed, and the actual spending amount under the Eligible Receipt falls below the requisite amount
to enroll in the Workshop, such participant is not entitled to the refund of the Deposit in any event (including but not limited to his or her own withdrawal).

Personal Data
All personal data collected from this Activity may be used by K11 for the purposes of communicating news and information, advertising, marketing, public relations and direct marketing (including joint marketing),
research and development, identification for provision of goods, services, benefits, offers and promotions, information and database administration, collection or recovery of any debt owed by a person to K11,
matters relating to a transfer of the business of or any shares in K11 or a change in the shareholdings of K11 or an amalgamation of K11 with another body, complying with any statutory or regulatory requirements
and other directly related purposes. A data subject has rights of access and correction for his personal data held by us by contacting our Personal Data Privacy Officer. Our Privacy Policy Statement set out at
http://www.k11concepts.com/en/others/privacy.aspx shall be applicable herein.
(13)
Exclusion of Related Persons
To ensure fairness, the employees of K11 or the merchants in K11 Art Mall cannot enroll in the Workshops.
General Terms and Conditions applicable to the Activity
(1)
Amendment
K11 has the right to amend any Terms and Conditions at any time without any prior notice.
(2)
Interpretation
K11 has the right to interpret these Terms and Conditions. In case of disputes, the decision of K11 shall be final and binding on all parties concerned.
(3)
English Version Prevails
The Chinese version of these Terms and Conditions is for reference only. In case of discrepancies between the provisions of the English version and the Chinese version, the English version shall prevail.
(4)
Governing Laws
These Terms and Conditions shall be governed by the laws of Hong Kong Special Administrative Region.
