WARRANTY AGAINST DEFECTS
B.J McGill & M.J McGill T/A Kyoto Design and its successors and assigns (“the Seller”) provides the following limited warranty against
defects to:

WHAT THIS WARRANTY RELATES TO
Subject to clauses 4.1, the Seller warrants that the Goods shall be of a merchantable quality and fit for their purpose.
This warranty relates to any bloating, rotting and/or delaminating of the Goods (“Defect”).
The warranty is subject to and conditional upon:
(a) the Seller receiving written notice of the defect or failure within thirty (30) days of discovery of the defect or failure;
(b) the Goods not being painted;
(c) the Goods being stored flat, under cover and on timber bearers space at maximum centres of 600mm;
(d) the Goods being installed in accordance with the following requirements:
(i) framed construction: steel frames must be erected in accordance with the manufacturer’s requirements. Frames shall
be straight and true with studs at a maximum of 600mm centres. Timber frames should be seasoned. Allow a gap of at
least 2mm between screens when installing to allow for natural movement of the timber screens;
(ii) the Goods not to be used for load bearing or reinforcement. All installation should be onto an appropriate frame or
backing;
(iii) the Goods to be secured around all perimeters to a frame or backing at a minimum of 300mm centres, with fastenings
no less than 12mm from the edge of the screen. If preferred, the Goods can be glued to the frames and clamped until
cured, using a high grade, waterproof builder’s adhesive or gun nailed, screwed or even hand nailed no less than 12mm
of corners when installing without splitting or cracking. On larger Goods, no greater span than 600mm between
fastenings to a frame or backing;
(iv) the Goods to be installed a minimum of 225mm above bare ground/dirt/garden beds/water course, etc. Installation to be
at a minimum of 150mm above concrete paths or paving;
(v) the Goods not to be installed direct to brick or blockwork. Fix into a minimum 15mm thick batten attached to the brick or
blockwork wall, or a minimum 20mm thick spacer attached to the wall/fence;
(vi) the Goods to be mounted under normal outdoor ‘run-off’ conditions;
(vii) the Goods to be installed in a vertical plane;
(viii) the Goods not to be submerged or in constant contact with water.
DURATION OF WARRANTY
This warranty will cease from the date that is five (5) years after the Buyer takes delivery of the Goods/Services in accordance with
clause 5 of the Terms and Conditions of Trade.
If a Defect does not materialise in the Goods/Services prior to the date provided in clause 4.1, the Seller will have no liability to the
Buyer under this Warranty Against Defects and the Buyer releases the Seller from all claims for loss or damage in any way
connected with the Goods/Services from that date.
WHAT THE BUYER MUST DO TO CLAIM THE WARRANTY
To claim the benefit of the warranty, the Buyer will need to:
(a) present the defective Goods/Services to the Seller for inspection, including inspection for defective workmanship, or otherwise
provide evidence of the claimed Defect; and
(b) provide evidence of proof of purchase upon request by the Seller.
The claim listed in clause 3.1 may be made in person, or the claim may be sent to the address listed on this form, including the
particulars required under clauses 3.1(a) and 3.1(b).
The appropriate form for making a claim for warranty is attached and must be used whether the claim is being made in person, or
mailed to the address on this form.
WHAT THE SELLER WILL DO TO HONOUR THE WARRANTY
The liability of the Seller to the Buyer pursuant to clause 1 shall:
(a) for the first two (2) years of the warranty period be limited to the amount of the replacement or repair cost for each item the
subject of a warranty claim. At the option of the Seller, the Seller may repair or replace the item and will deliver such repaired
or replaced item to the Buyer promptly at the Seller’s cost;
(b) for the balance of the warranty period, be limited to ten percent (10%) of the amount of the replacement or repair cost for
each item the subject of a warranty claim.

RESPONSIBILITY FOR COSTS OF CLAIM
The Seller is responsible for the costs directly associated with repairing the Defect only.
Any works required to be completed which are in addition to those directly related to rectification of a Defect, will be at the cost of
the Buyer.
RIGHTS AT LAW
The benefits given to the Buyer under this warranty are in addition to other rights and remedies of the Buyer at law in relation to the
Goods/Services.
The Seller’s Goods/Services come with guarantees that cannot be excluded under the Australian Consumer Law. The Buyer is
entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
The Buyer is also entitled to have the Goods/Services repaired or replaced if the Goods/Services fail to be of acceptable quality and
the failure does not amount to a major failure.
