INSPECTION CONTRACT Contract for Inspection Services This agreement dated___________, by and between LEVEL HOME CONSULTANTS “LHC” and the “Client”_____________________________________ , for an inspection of the structure and premises located at:_____________________________________________________________________. LHC hereby agrees to conduct a visual inspection of the property on:___________@ __________. The Client agrees to pay LHC at the time of the inspection, Three Hundred Fifty Dollars ($350.00) for a pictorial inspection, plus any additional charges such as radon, septic, well, etc. Scope of the Inspection A limited visual inspection will be done to identify the general features, and major deficiencies of the property at the time of the inspection. Any area which is not exposed to view, is concealed, or is inaccessible because of soil, walls, floors, carpets, ceilings, furnishings or any other thing, is not included in this inspection. This inspection does not include any destructive testing, or dismantling. Client agrees to assume all of the risk, for all the conditions which are concealed from view at the time of the inspection. This is not a Home Warranty, Guarantee, Insurance Policy, or Real Estate Transfer Disclosure. Whether or not they are concealed, the following are outside the Scope of this Inspection: Building codes or zoning ordinance violations; geological stability or soil conditions; structural stability or engineering analysis, asbestos, radon, formaldehyde, or other environmental hazards; appraisal value; cost estimates; condition of detached buildings; pools, private water or sewage systems or any components thereof; swimming pools, spas, hot tubs, saunas, steam baths, or fixtures and equipment. Radio controlled devices, automatic gates; elevators, lifts or dumbwaiters; thermostatic and time clock controls, water softener systems, iron filters, solar systems heat exchangers, free standing appliances or other personal property. Your inspector is a Home Inspection Generalist, and is not a licensed engineer, or expert in every craft. If you inspector recommends consulting other specialized experts, client must do so at their own expense. Dispute Resolution and/or Arbitration Any dispute arising from this inspection and/or report, except for the inspection fee payment, shall be resolved informally, or by arbitration in accordance with the rules of the American Arbitration Assoc., except the parties shall select an arbitrator who is familiar with the Home Inspection Industry. 245 N. Limitation on Liability: The Inspectors liability for mistakes or omissions in this inspection and report is limited to a refund of the fee paid for the inspection. Client assumes the risk of all losses greater than the fee paid for the inspection. Client agrees to accept refund of the fee as full settlement of any or all claims which may arise from this inspection. Right of Re-inspection: If a component of the property inspected and reported by LHC as requiring repairs and/or replacement are found by someone else to be defective, the Client shall inform LHC and allow LHC to re-inspect the item before the Client repairs or replaces the item. If the Client repairs or replaces the item before LHC has an opportunity to re -inspect it, Client waives any/all actions against LHC for failure to adequately inspect said items. Distribution of the Inspection: LHC will supply one original / one copy to the client an maintain one for the LHC file. Any others are the sole responsibility of the client/agent.
