The Arbitrator, however, is charged with following the Agreement, not the
PWS between the Company and the Depot. And the Agreement clearly says in
Article IV(1) that seniority controls all layoffs.

OPINION AND AWARD
The Arbitrator, however, is charged with following the Agreement, not the
PWS between the Company and the Depot. And the Agreement clearly says in
Article IV(1) that seniority controls all layoffs.
AWARD
For the reasons set out above, the grievance is granted.
The Grievants are to be reinstated with full backpay and benefits.
The Company is permitted to setoff from backpay any interim wages
earned and unemployment benefits received.
For purposes of implementation of the remedy only, the Arbitrator
shall retain jurisdiction through December 6, 2013.
