Lower Your Tuition Membership Program Terms and Conditions
These terms and conditions (this "Agreement") govern the Lower Your Tuition Membership
Program. The Lower Your Tuition Membership Program is a benefit and educational program
brought to you by Americans for Affordable College Costs (AACC), provider of the Lower
Your Tuition Membership (collectively "we," "us," "our," "ours"). Purchase or use of any
membership in the Lower Your Tuition Membership Program ("Membership") at any time
subjects the purchaser or user ("you," "your," "yours," "Member," “Sponsor”) to the provisions
of this Agreement, as amended from time to time.
Benefits
The Lower Your Tuition Membership Program currently entitles Members to the following
benefits (benefits are subject to change in our sole discretion, but in such event we will make
reasonable commercial efforts to substitute or add benefits of equal or greater value than any
discontinued benefits):










An initial 1000 Tuition Rewards Points worth $1000 off tuition when you join the
Membership (each point is worth $1.00 off full tuition at all the colleges in the program;
you must opt-in to receive tuition discounts as part of your membership benefits; the
tuition discount benefit is free but opt-in is required when you enroll as a member or
when we present the opportunity for you to opt-in after Membership enrollment)
$250 in additional tuition discounts every month you remain an active member
A free financial coach who will create a Personal College Savings Roadmap for you, to
help your family achieve its college savings goals
A Panel of Experts to answer your questions on finding the right college, getting
accepted, affording tuition and related topics
Our Smart Savings monthly e-Newsletter with college savings advice and tips on
squeezing more savings out of a tight family budget
Our jobs and internship board for parents and students to find new employment and
work-experience opportunities
Our Member Forum, where members share advice and information with each other
A $7500 Accidental Death and Disability insurance policy
A Guarantee – if through your Membership you don’t receive total discounts off full
tuition of at least 10 times the dues you paid for Membership, we’ll refund 100% of
every penny you paid in dues – no questions asked! And all the member benefits
you’ve received are still yours to keep.
Periodic special promotions for Members
Certain Conditions

You will continue to earn Tuition Rewards for tuition discounts at participating
colleges for as long as you remain a dues-paying Member of Lower Your




Tuition.
You may cancel your Membership at any time for any reason by following our
standard cancellation procedures, and retain all Membership benefits you
received until the date of your cancellation. You may cancel your Membership
by calling 1-800-351-2468.
Your Membership is for your use only and is non-transferable. Attempting to
sell, transfer or give your membership to a third party is prohibited and may
result in loss of the tuition discounts and all other benefits you received in your
Membership.
We expect Members to submit and maintain accurate and current user
information in connection with their Memberships. Such information includes
name, address, email address, and telephone number. Periodically we may
utilize the National Change of Address (NCOA) system to update the mailing
address of accounts in our database, through information provided by the
United States Postal Service. Members can change their account information
by updating Member profile data online by logging in to their Membership
account at www.LowerYourTuition.org. We cannot assume any liability for
correspondence, mail or e-mail that is lost, delayed, or misdirected.
The terms and conditions governing your Tuition Discount Scholarship benefit
are specified in the section of this Agreement titled “Tuition Discount
Scholarship Terms and Conditions.”
Membership Fee
The Membership fee is currently $12.95 per month or $155.40 per year (annual).
Membership fees are subject to taxation in accordance with applicable federal or state law.
The monthly or annual Membership fee does not include applicable taxes. We may change
the Membership fee at any time although there are no plans to do so at this time.
Membership fees are not refundable. However, you may choose to cancel your Membership
at any time for any reason and in event of cancellation, you may keep and use all benefits,
including your tuition discounts, that you received prior to your date of cancellation.
Term; Automatic Renewal; Billing
You may choose to enroll as a Member for the Membership Term offered when you join;
currently the Membership Term offered may be either one month or one year, beginning on
the date of purchase. A Renewal or Automatic Renewal within a current Membership Term
extends the existing expiration date of the Membership by the duration of the prior
Membership Term; such renewal term begins the day after the current term ends. When an
expired Membership is renewed, the new Membership Term of one month or one year will
begin on the date of renewal.
Each Membership will automatically renew (referred to as "Automatic Renewal Membership")
for the selected Membership Term (each year for additional one-year periods or each month
for additional one-month periods) that commences on the day after the previous term ends
unless (i) you choose to cancel your membership or (ii) your Membership is cancelled or we
terminate your Membership.
Automatic Renewal Membership fees will be billed, annually or monthly as appropriate,
automatically to the credit or debit card you provided when you enrolled in Membership or the
form of payment we currently have on file for you, in the amount of the then current
Membership fee, approximately one month prior to your Membership expiration date.
When you enroll in Membership online at www.LowerYourTuition.org or another enrollment
website or Landing Page provided by us or our partners, and you do not cancel your
Membership prior to your renewal date, upon your next and subsequent renewals, the then
current Membership fee will be billed to: (i) the form of payment we currently have on file for
you that was active in your Membership account at the time of the enrollment or the renewal,
or (ii) the form of payment we currently have on file for you that you updated by logging into
your Membership account.
When you enroll in the Membership, upon your next and subsequent renewals, the then
current Membership fee will be billed to: (i) the form of payment we currently have on file for
you that was active in your Lower Your Tuition Membership account at the time of the
enrollment or the renewal, or (ii) the form of payment we currently have on file for you that
you updated online by logging in to your Membership account at www.LowerYourTuition.org.
UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO
NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR MEMBERSHIP WILL
AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU,
UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN APPLICABLE
MEMBERSHIP FEE AND ANY TAXES, USING ANY CREDIT CARD, DEBIT CARD OR ANY
OTHER FORM OF PAYMENT WE HAVE ON FILE FOR YOU.
Cancellation; Termination
(a) You have the right to cancel your Membership at any time. In the event of cancellation,
you will not be entitled to a refund of your Membership fee(s); however, you may keep and
use all benefits, including your tuition discounts, which you received prior to your date of
cancellation.
(b) We may terminate your Membership, including any associated accounts, without notice,
for any reason in our sole discretion, including without limitation our belief that continued use
of such Membership would violate any provisions of this Agreement, applicable law, or
otherwise be harmful to our interests. In the event of any such termination, you will not be
entitled to a refund of your Membership fee(s), and you may be subject to forfeiture of certain
Membership benefits you received prior to your date of termination.
(c) We may terminate any or all of the benefits available under the Lower Your Tuition
Membership Program at any time with or without notice. In the event of our termination of the
Membership, you may keep and use all benefits, which you received prior to your date of
termination.
Privacy Policy
As a Member, the information we capture will be subject to the Lower Your Tuition Privacy
Policy as amended from time to time in accordance with its terms. You may view the current
version of the Lower Your Tuition Privacy Policy at any time online at
http://loweryourtuition.org/privacy-policy/.
Disclaimers; Limitation of Liability
USE OF THE LOWER YOUR TUITION MEMBERSHIP PROGRAM AND ANY OF ITS
ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. THE MEMBERSHIP BENEFITS ARE
PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
AMERICANS FOR AFFORDABLE COLLEGE COSTS, LOWER YOUR TUITION, AND ALL
OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS AND AGENTS AND
CONTRACTED SUPPLIERS (COLLECTIVELY "MEMBERSHIP PROVIDERS") EXPRESSLY
DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
MEMBERSHIP PROVIDERS MAKE NO WARRANTY THAT (i) THE LOWER YOUR
TUITION MEMBERSHIP PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE
LOWER YOUR TUITION MEMBER PROGRAM WILL BE UNINTERRUPTED, TIMELY,
SECURE, OR ERROR-FREE, OR (iii) THE QUALITY OF ANY PRODUCTS, SERVICES,
INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM
YOUR USE OF THE LOWER YOUR TUITION MEMBERSHIP PROGRAM WILL MEET
YOUR EXPECTATIONS.
MEMBERSHIP PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT
LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER
INTANGIBLE LOSSES (EVEN IF MEMBERSHIP PROVIDERS HAVE BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE
INABILITY TO USE THE LOWER YOUR TUITION MEMBERSHIP PROGRAM OR ANY
BENEFITS THEREOF; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND
SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES
PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS
ENTERED VIA THE USE OF THE LOWER YOUR TUITION MEMBERSHIP PROGRAM; (iii)
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR LOWER YOUR TUITION
MEMBER PROGRAM DATA; OR (iv) ANY OTHER MATTER RELATING TO THE LOWER
YOUR TUITION MEMBERSHIP PROGRAM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES
OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL,
CONSEQUENTIAL OR OTHER DAMAGES. ACCORDINGLY, SOME OF THE ABOVE
LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
Governing Law
This Agreement, and the respective rights and obligations of the parties hereunder, shall be
governed by, and construed in accordance with, the laws of the State of Maryland, without
regard to conflict of law principles.
Binding Arbitration
Any controversy or claim arising out of or relating to this Agreement (including any breach
thereof) or the Lower Your Tuition Membership Program shall be settled by arbitration
administered by the American Arbitration Association under its Commercial Arbitration Rules
(including without limitation the Supplementary Procedures for Consumer-Related Disputes),
and judgment on the award rendered by the arbitrator(s) may be entered in any court having
jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis
and shall not be consolidated with any claim or controversy of any other party. The foregoing
shall not preclude the Membership Providers from seeking any injunctive relief in State or
Federal courts for protection of their respective intellectual property rights (including such
rights of their respective licensors).
Acknowledgement
This Agreement, including all documents referenced herein, represents the entire
understanding between us and any user of the Lower Your Tuition Membership Program with
respect to the Lower Your Tuition Membership Program and supersedes any other
agreements, statements or representations. Headings used in this Agreement are for
reference only and shall not affect the meaning of any terms. Any user of any portion of the
Lower Your Tuition Membership Program is deemed to have accepted the terms and
conditions of this Agreement.
Changes to This Agreement
We may change the terms of this Agreement at any time without notice or liability by posting
a revised Agreement on the Member Program website located at www.LowerYourTuition.org.
Any change shall take effect immediately, unless otherwise provided. You may view the
current version of this Agreement at any time online at www.LowerYourTuition.org. YOUR
CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR
ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU
MSUT CANCEL YOUR MEMBERSHIP.
Tuition Discount Scholarship Account Terms and Conditions
(1) Terms and Conditions
This Agreement contains details about the relationship between you and the Membership’s
Scholarship Administrator (the “SA”) relating to the Tuition Rewards program (the "Program").
You must accept the terms of this Agreement in order to participate in the Program. By
enrolling as a Tuition Rewards sponsor, you agree to these terms and conditions, as may be
amended from time to time. These terms and conditions, as well as other information on the
Program, including the listing of the SA member schools, can be obtained online at
http://loweryourtuition.org If you do not agree to all of the terms of this Agreement, then do
not complete the enrollment process.
(2) Eligibility for the Tuition Rewards
Multiple account holders ("sponsors") from the family (e.g., parents, grandparents, and other
family members, etc.) may earn Tuition Rewards to benefit one or more designated children.
Tuition Rewards are limited to full-time undergraduate tuition at member colleges beginning
with the freshman year. Students are eligible to be enrolled and designated as a student
beneficiary of a sponsor from birth until August 31st of the year that 11th grade starts.
The student ("beneficiary") must be a family member of the account holder. This includes
children, grandchildren, nieces and nephews (including "step" and "god" relations).
Sponsorship of one or more students by a group or organization is not permitted.
(3) Calculation of Rewards
The maximum Tuition Reward per student varies by school, but is typically one full year of
tuition - or as contractually agreed. Colleges may include Tuition Rewards as part of their
normal financial aid and scholarship packages. There is no limit on the amount of Tuition
Reward points that a Sponsor (parent, grandparent, aunt/uncle) can earn.
(3.1) Tracking of Rewards
Tuition Reward Points are typically accumulated on a quarterly, semi-annual or annual basis (i.e., new points earned are added to the previous balance). The Tuition Rewards are
accumulated in the Sponsor's account, and it is up to the account holder ("the sponsor") to
determine how to allocate his or her points to the listed student beneficiaries. No points can
be allocated to a student beneficiary after August 31st of the year that 12th grade begins.
(4) Redemption of Rewards
The account holder ("the sponsor") must, at the time of the application to the school, submit a
Tuition Reward statement to each member college to which a student beneficiary applies.
Failure to submit the Tuition Reward Statement at the time of application may invalidate the
use of the Tuition Rewards. The Tuition Reward Statement must be submitted electronically
by the means provided on www.tuitionrewards.com. No other method will be accepted. The
sponsor may submit multiple Tuition Reward statements with each application, as long as the
student is applying to the school.
(5) Use of Rewards
The Tuition Rewards will be remitted solely as a reduction from the member college's full
tuition bill and will not be awarded in cash.
Member colleges reserve the right to use the Tuition Reward as a part of ("blending"), or
separate from ("stacking"), any financial aid packages, including, but not limited to, grants,
institutional discounts, institutional or non-institutional scholarships, or "named" scholarships
(such as a "Presidential Scholarship").
The Tuition Reward must be applied evenly over four years of undergraduate education. If a
student completes undergraduate education in other than 4 years, it is up to the college to
determine how the reductions will be applied per year.
Member colleges reserve the right to impose reasonable academic performance guidelines or
other restrictions on the use of Tuition Rewards consistent with those that may be in effect to
maintain scholarships, grants and/or other institutional or non-institutional financial aid.
All colleges participating in the program, including colleges newly added in the future and
those that may discontinue participation, have agreed to honor Tuition Rewards of all
students enrolled in the program as long as the students were in the program at some point
concurrent with the colleges' participation. If a school discontinues participation, it agrees to
honor points earned until the discontinuation date.
No SA member college has ever failed to honor its commitment to provide a non-need based
tuition discount at least equal to its Tuition Rewards obligation. In the unlikely event that a
school participating in the Tuition Rewards program does not honor its contractual obligation
to a student sponsored in the Program by offering a scholarship at least equal to the student's
Tuition Rewards, the SA will negotiate that student's financial aid package with the school on
behalf of the student and his/her family, provided that the family submitted the student's
statement of Tuition Rewards to the school as described in these Terms and Conditions.
(6) Reporting of Tuition Rewards and Information
Sponsors will have access to their Tuition Rewards via a protected web-based internet site
provided by the Lower Your Tuition Membership Program. The SA will also provide member
schools with access to the accumulated Tuition Rewards for all students in 9th grade and
older in the Program.
(7) College Information, Admission and Transfers
Students must apply to and be accepted through a college's normal admissions procedures
to qualify for Tuition Rewards at a member college. Eligibility for a Tuition Reward neither
helps nor hurts in the admissions process. If a student transfers from a participating or nonparticipating college to a participating college, the college accepting the student has the right
to decide whether it will honor the remaining Tuition Reward points. Students need not select
a college for Tuition Rewards prior to college application.
(8) Expiration of Rewards
Student-specific Tuition Rewards, or Tuition Rewards that have been allocated to a student
by an account holder, if unused by the student, will expire three years after that student's date
of high school graduation. However, a sponsor can request that non-student-specific reward
points be returned to the sponsor account within that time frame. From there they can then be
transferred to a younger eligible student.
(9) Transfer of Rewards
Sponsors are free to transfer points to and from listed students until August 31st at the start
of a student's senior year in high school. After that date, the student's account is locked. If a
student matriculates to a non-participating school, the sponsor may request that the Tuition
Reward points allocated to that student be moved to another eligible student listed on the
sponsor's account. Proof of matriculation to a non-participating school may be requested.
(10) New School Membership
In the event that a student whom you sponsor in the Program is already attending or has
already applied to a college or university that, at the student's time of application, is not a
member of the Program, but which later joins the Tuition Rewards consortium, that school is
under no obligation to alter existing financial aid awards to reduce tuition by the amount of
any Tuition Rewards points associated with matriculated or applied students.
(11) Access to Information and Privacy
Member schools will have access to the following student information, provided by you to the
SA, when a student begins his or her freshman year in high school: Name, mailing address,
phone number, date of birth, high school graduation date, e-mail address (if provided by
sponsor), any optional information as provided by the sponsor (GPA, SAT, ACT, etc.) and the
total allocated or student-specific Tuition Reward points.
The Program may make sponsor registration information (name, address, phone and e-mail
address, as well as any optional information provided) to both member colleges and
universities.
(12) E-mails We Send
You may opt out of certain e-mail announcements, including updates on new member
schools. However, to remain enrolled in the Program, you may not opt out of receiving emails that pertain to your account balance and important reminders, such as deadlines to
submit Tuition Rewards to member schools.
It is the sole responsibility of the account holder to verify that he or she can receive e-mails
from the Lower Your Tuition Membership Program and/or the SA - and to maintain an
accurate and working e-mail address in our system. Furthermore, the Lower Your Tuition
Membership Program and the SA are not responsible for any junk e-mail, SPAM filtering or
other e-mail filtering you or your e-mail provider may have in place.
(13) Responsibilities
Member colleges are exclusively responsible for providing all Tuition Rewards. Member
colleges may individually impose reasonable rules and regulations, neither substantially
inconsistent with this application, nor with the individual colleges' normal conditions imposed
upon their institutional financial aid award, governing the use of Tuition Rewards. Colleges
have the right to impose reasonable academic performance guidelines or other restrictions on
participating students in regards to the continuation of the original financial aid award, of
which Tuition Rewards may be a part.
Each sponsor enrolling in the Program, both on his/her own behalf and on behalf of each
designated student as a third-party beneficiary, hereby acknowledges and agrees that the
SA, the Lower Your Tuition Membership Program, and any of its affiliates, subcontractors,
and any officers, directors, employees, or agents of these entities (collectively "partners")
have no responsibility or liability whatsoever for any Tuition Reward provided pursuant to the
Program, and further agrees to hold harmless the SA and the Lower Your Tuition
Membership Program, in the event of the failure of any member school(s) to provide a Tuition
Reward.
By enrolling in the Program you agree to be legally bound by the terms and conditions of the
Program. Furthermore, you certify that the information you provided to the SA and the Lower
Your Tuition Membership Program is true and correct to the best of your knowledge.
(14) Lower Your Tuition Membership Program and SA Disclaimer
The Lower Your Tuition Membership Program and the SA make available the information and
services contained herein in furtherance of our goal to inform and educate. While the Lower
Your Tuition Membership Program and the SA make every effort to present accurate and
reliable information on this web site, the Lower Your Tuition Membership Program and the SA
do not endorse, approve or certify such information, nor do we guarantee the accuracy,
completeness, efficacy or timeliness of such information.
The Lower Your Tuition Membership Program and the SA do not endorse, approve, certify, or
control the external sites to which we link and we do not guarantee the accuracy,
completeness, efficacy or timeliness of information located at such sites.
The Lower Your Tuition Membership Program and the SA assume no responsibility for
consequences resulting from use of the information contained herein, or from use of the
information obtained at linked sites, or in any respect for the content of such information. The
Lower Your Tuition Membership Program and the SA are not responsible for, and expressly
disclaims all liability for, damages of any kind arising out of use, reference to, reliance on, or
performance of such information.
The Lower Your Tuition Membership Program and the SA do not offer accounting, tax, legal,
investment or other financial advice, and nothing contained in the service is intended to
constitute professional advice for any financial decisions. Advice received via the Lower Your
Tuition Membership Program and the SA should not be relied upon for legal, tax, accounting,
investment or other financial decisions. You should always seek the advice of a lawyer,
accountant, financial planner or other qualified financial provider prior to making any financial
decisions.
