List of TTIP documents – Explanatory note
The European Commission is publishing a table listing texts related to the on-going Trade and
Investment Transatlantic Partnership (TTIP) negotiations. The table includes all the texts prepared
by the Commission shared with the European Parliament and the Council since the start of the
negotiations.
The publication of this list is another step further to increase transparency around the negotiations
and is in line with the recommendations of the Ombudsman.
There are 3 main categories of documents, organised chronologically by the date they were
transmitted to the Council and the European Parliament:
i) EU legal texts – The European Union's initial proposals for legal text on topics in
TTIP. They were tabled for discussion with the US in negotiating rounds. The actual text
in the final agreement will be a result of negotiations between the EU and US.
ii) EU position papers - these describe the EU's general approach on a topic in the TTIP
negotiations. They were tabled for discussion with the US in negotiating rounds.

iii) all other EU documents – including drafts, non-papers, studies and other documents used
in the negotiations or provided to the European Parliament and the Member States.
Since the launch of the transparency initiative, the Commission has published documents including
for the first time 9 legal textual proposals and a number of TTIP position papers bringing their
total number up to 15. The Commission has also made a commitment to publish regularly textual
proposals and other related documents in areas of the negotiations covering regulatory and rules
issues, as soon as they have been shared with the US and, in the case of non-negotiating
documents, when they have been presented to the Member States and the European Parliament. A
reader’s guide outlining the approach taken by the European Commission on the publication of
TTIP negotiating documents is available.
As the legal texts are often complex, a number of fact sheets and other explanatory documents
explaining different aspects of the negotiations in a simple way have also been made public. In the
table below you can find links to the publically available information.
The number and scope of these papers reflect the EU process, in which the Commission prepares
drafts, studies, analyses, etc., share them with our co-legislators, i.e. representatives of EU
governments and Members of the European Parliament, we assess feedback received, finalise
documents, and present them to our US partners.
This approach explains the listing in the table of a number of documents with the same or similar
titles on the same subject. Only the final version of a given document is then published on the TTIP
website.
Democratic scrutiny
The Commission negotiates based on the negotiating directives set by the EU Member States in
the Council that is publicly available. The European Commission will make the text of an
agreement public if and when negotiations are concluded. Afterwards, the concluded text is
submitted to the Council and the European Parliament for approval and ratification.
