Aurora to proceed with next steps in litigation process with
Minto Communities Inc. over Mavrinac property
AURORA, ON – Recent mediation between The Town of Aurora and Minto Communities Inc. regarding
the Town’s acquisition of the Mavrinac Blvd. property known as Block 208 ended without a resolution,
and the Town intends to proceed with the next steps in the litigation.
In 2002, as part of the initial subdivision development process, the 2.4-hectare property was identified by
the York Catholic District School Board (YCDSB) as a possible location for an elementary school,
subject to further determination and analysis by the YCDSB.
Minto and the Town executed a subdivision agreement in 2007, which confirmed that Block 208 could be
a potential school location for the YCDSB. Under the terms of the agreement, the Town also received
the right to acquire the property for municipal purposes if the YCDSB did not proceed with plans for a
school.
In June 2013, the YCDSB decided that Block 208 was not needed for a school and waived its right to
purchase the property. In November 2013, the Town exercised its right to acquire Block 208 from Minto
in accordance with the terms of the subdivision agreement. The Town and Minto have been involved in
litigation regarding this matter since January 2014.
As part of the litigation process, the Town and Minto engaged in mediation in March 2015 to determine if
a satisfactory resolution could be reached without the need for a trial. As the parties could not agree on a
mediated settlement, the matter appears set to proceed with the next steps in the litigation, towards an
eventual trial.
“Upholding the Town’s agreement with Minto and enforcing the Town’s rights regarding the property are
important to our Council and our residents,” said Mayor Geoffrey Dawe. “Town Council remains
committed to responding to resident concerns and protecting our rights in this important matter.”
As the matter is currently in litigation, no further comments will be provided from the Town or Council
regarding this matter at this time. The contents of the mediation discussions are also confidential.
