ENTIRE AGREEMENT: This agreement contains the entire understanding between Remember Me Photo Booths and the CLIENT. It
supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in
writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other
provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
CLIENT REPRESENTS: (1) There is adequate access to photo booth event area – exceptions only made after inspection by
Remember Me Photo Booths technician. (2) There is 120V electric outlet within 20 feet of the desired photo booth event area. (3)
CLIENT is responsible for any damage done to the photo booth caused by CLIENT or any of the CLIENT’S guests.
REMEMBER ME PHOTO BOOTHS OBLIGATIONS: (1) Provide an operational photo booth for the number of hours booked. CLIENT
acknowledges that the photo booth may require on-site maintenance and/or servicing during the photo booth event, and may be
inoperable for up to 20% of the contracted photo booth event time as a result of that maintenance and/or servicing. (2) Provide a
qualified technician, on-site, to maintain and/or service the photo booth during the photo booth event. (3) Set-up and take down the
photo booth in a timely manner before and after the photo booth event.
MAXIMUM LIABILITY: CLIENT and Remember Me Photo Booths agree that in the event of a mechanical failure, or any other
reason, Remember Me Photo Booths is unable to provide a functioning photo booth pursuant to this agreement; Remember Me
Photo Booths’ maximum liability is the return of any payments received. Remember Me Photo Booths will not be liable under any
contract, negligence, strict liability, or other theory for direct, indirect, incidental or consequential damages (including without
limitation damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this
agreement, the subject matter of this agreement, the services provided under this agreement or the property where these services
are being performed. If Remember Me Photo Booths is only able to provide partial services for any reason, the charges to the client
will be prorated subject to the 20% inoperable clause above.
PRE-EVENT CONSULTATION: The parties agree to a pre-event consultation at least 30 days before the event date in order to
finalize the details, locations, and CLIENT'S written request list (for specific requests). If applicable, the guests of honor agree to set
aside a 30-minute time frame in order to capture photo booth pictures to be displayed at the event. If the guests of honor do not
allocate for this time, Remember Me Photo Booths will not be held responsible.
IMAGES and COPYRIGHTS: Limited copyright ownership of the all of the images taken during the photo booth event will be
transferred to the CLIENT under the following conditions: (1) the proofs are the property of the CLIENT for personal use. (2)
Remember Me Photo Booths retains the right to use the photographs for marketing purposes and to otherwise promote its business.
EXHIBITION: Requests for specific proofs or slides to be used by Remember Me Photo Booths may be requested at a future time.
CLIENT grants Remember Me Photo Booths permission to display selected images resulting from this assignment as examples of
Remember Me Photo Booths work.
MODEL RELEASE: The CLIENT grants to Remember Me Photo Booths the right to use and publish photographs of the CLIENT or in
which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter
the same without restriction; and to copyright the same. The CLIENT releases Remember Me Photo Booths and its legal
representatives and assigns from all claims and liability relating to said photographs.
TRAVEL & DELIVERY: Travel and delivery are included in the rental agreement price up to 50 miles each way from downtown
Houston. Beyond 50 miles travel is paid at $1.00 per mile, each way.
SECURITY DEPOSIT: A deposit of $300.00 is required to hold the date. This deposit is non-refundable. The unpaid balance is
payable, in full, 14 days prior to the event. If balance due is not paid on time, the reservation will be canceled.
