ORDINANCE NO. 3363-15 AN ORDINANCE AMENDING CHAPTER 126, SECTIONS 14, 17, 18, 20, 21 AND 24 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF RUTHERFORD, COUNTY OF BERGEN AND STATE OF NEW JERSEY RESPECTIVELY ENTITLED “PERMIT-ONLY PARKING AREAS ESTABLISHED”, “APPLICATION FOR PERMIT”, “FORM OF PERMIT”, “DURATION OF PERMIT; NONTRANSFERABILITY”, “PERMIT FEES”, AND “ZONES ESTABLISHED” BE IT ORDAINED by the Mayor and Council of the Borough of Rutherford, County of Bergen and State of New Jersey that Chapter 126, Sections 14, 17, 20, 21 and 24 of the Code of the Borough of Rutherford respectively entitled “Permit-only parking areas established”, “Application for permit”, “Duration of permit; nontransferability”, “Permit fees”, and “Zones established”, shall be amended and that those portions of the Ordinances set forth below are hereby amended as follows and that those portions of the Ordinances not set forth below shall remain unchanged (additions in italics; deletions in strikethrough): § 126-14. Permit-only parking areas established A. Erie Park and Ride Commuter Parking Lot (1) It shall be unlawful for any person to park a vehicle in the public parking lot on the northerly side of West Erie Avenue unless a permit to park has been secured before parking. (2) A permit shall not be necessary for any vehicle parking in the Erie Park and Ride Commuter parking lot between the hours of 9:00 p.m. and 6:00 a.m. (3) No vehicle shall be allowed to stand unmoved in the Erie Park and Ride Commuter parking lot for a period exceeding 120 hours. (4) Parking at the Erie Park and Ride parking lot is limited to motor vehicles registered as passenger vehicles and commercial vehicles not exceeding two (2) tons. … D. Erie Avenue permit-only parking area. (1) It is hereby established that the following areas on Erie Avenue shall be designated as areas where parking shall be prohibited by all motor vehicles unless a permit to park has been secured before parking. The designated permit-only parking areas are: (a) East Erie Avenue, north side, commencing 50 feet from the intersection of Hackensack Street and extending 340 feet westerly. (b) West Erie Avenue, south side, commencing 90 feet from the southeast corner of Chestnut Street and extending to Agnew Place. [Amended 7-26-2005 by Ord. No. 3084-05] (c) West Erie Avenue, north side, commencing 196 feet from the northwest corner of Park Avenue and extending 632 feet westerly. § 126-17. Application for permit. B. A copy of the valid driver’s license of the registered owner of the vehicle shall be required to be submitted. A copy of the valid motor vehicle registration for the permitted motor vehicle shall be required to be submitted. § 126-18. Form of permit. The permit shall be in the form of an identifiable placard or other paper prepared by the Borough Clerk, and it shall set forth the information contained in the application, the expiration date of the permit and the permit-only parking area for which the permit is issued. § 126-20. Duration of permit; nontransferability. A. The permits required under this article shall be issued for a time period as requested by the applicant so long as all fees are paid in full. All permits that are issued on an annual basis shall expire on May 31 of each and every year, and a new application shall be required. B. One permit shall be issued per motor vehicle. Permits shall not be transferable, sold or exchanged in any manner. Permits shall not be altered, copied or reproduced in any manner. § 126-21. Permit fees. A. Permit fees are nonrefundable. B. The fee for a permit for parking at Rutherford Avenue parking lot shall be $50 per year. B. The fee for a permit for parking at Ettrick Terrace parking lot shall be $50 per month. D. C. The fee for a permit for parking at the Kip Avenue parking lot shall be $50 per month and $5 per day. There shall be no fee for the permit known as the "Kip Avenue senior permit." E. D. The fee for a permit for parking at the Erie Avenue and Erie Park and Ride permitonly parking area shall be $100 per month for nonresidents and $50 per month for residents of the Borough of Rutherford. The Mayor and Council may, at their discretion, suspend or alter the fee for permit parking at the Kip Avenue parking lot set forth at Subsection D for special events. [Added 910-2013 by Ord. No. 3306-13] § 126-24. Zones established A. The establishment of zones, to be known as “parking meter zones,” in the following streets and parking lots is hereby authorized: (27) Public Park and Ride lot on the northerly side of West Erie Avenue, except that three spaces shall be designated without meters or a parking fee for the Rutherford Downtown Partnership which spaces shall be located at the entrance as shown on the Station Square Train Station site plan that is hereby made a part of this chapter, and the twenty-five (25) most westerly spaces shall be designated “Park and Ride permit holders only”. (28) West Erie Avenue, south side, from Union Avenue to Agnew Place [Added 7-262005 by Ord.
