Executive Summary
The Federal Highway Beautification Act
(HBA) of 1965 mandated consistent regulation
and enforcement of non-accessory, outdoor
advertising signs along the National Highway
System and all federal and primary aid highways.
Each state was required to sign a Federal/State
Agreement affirming that they would uphold the
federal laws regulating size, lighting and spacing.
The Commonwealth of Pennsylvania, signed its
Federal/State Agreement in 1972.1
Based on Philadelphia’s desire to take
control of its outdoor advertisements, on June
10, 1974, Commonwealth Secretary of
Transportation Jacob Kassab certified to the
Federal Government that the City of Philadelphia
had “established and will enforce like regulations Figure 1: Although Philadelphia’s Sign Codes prohibit signs

thus signed the state/city agreement enabling
the City of Philadelphia to enforce and uphold the HBA . 2
This report examines whether the City of Philadelphia’s obligations with the Commonwealth of
Pennsylvania has been properly enforced and upheld as required by federal law.3 Prompting this study
was the City’s entrance into a settlement agreement, effective August of 2006, with multiple major
outdoor advertising companies, including Free Speech LLC, CBS Outdoor Inc., Clear Channel Outdoor,
Inc., and H.A. Steen Industries, which legalized certain signs that were and are located along Federal and
Primary Aid Highways.4
This 2006 Settlement Agreement was created under the auspices of addressing a challenge to
permit fees. In the process, however, the Agreement fails to enforce the HBA and the City’s own sign
code, all of which incorporated the terms of the state/city agreement and the state/federal agreement.
The 2006 Settlement Agreement certified all non-compliant billboards contained in the inventories
submitted by the companies to the City as being legal/compliant, despite the fact that many of these
signs had never been compliant, as the City has had laws in place that upheld the HBA since 1977. This
report shows that the bulk of the violations reported in the Pennsylvania Department of Transportation-

sponsored outdoor advertising inventory of 20065, authored by Michael Baker Jr., Inc., as well as those
violations that were self-reported by the companies, have not been legalized or corrected or removed
by the responsible parties.
The City’s failure to enforce the HBA is a violation of its agreement with the State and
jeopardizes the Commonwealth of Pennsylvania’s Federal Highway funding allocation. Based on the
findings of this report, it is recommended that the Federal Highway Administration conduct an audit
of the permits and licenses issued by the City of Philadelphia for outdoor advertising signage along
Federal Aid highways in order to determine whether the City/State agreement should be revoked.
Presently, the City of Philadelphia is preparing to enact new signage regulations. These new
proposed regulations fail to remove illegal billboards currently allowed under the 2005 Settlement
Agreement which terminates in August of 2014. There are hundreds of billboards incorporated in this
Agreement, many of which are located in violation along Federal and Primary Aid highways. This report
helps the City identify those billboards which should be removed or altered because of their
noncompliance.
Introduction
"Getting on the subject of beautification is like picking up a tangled skein of wool. All the threads are
interwoven -- recreation and pollution and mental health, and the crime rate, and rapid transit, and
highway beautification, and the war on poverty, and parks -- national, state and local. It is hard to hitch
the conversation into one straight line, because everything leads to something else." - Lady Bird Johnson,
in her diary in 1965 6
The Highway Beautification Act of 1965 began largely because of the vision of one woman, First
Lady “Lady Bird” Johnson, for a cleaner, safer, and more beautiful America. She was distraught by the
overgrown and trash-strewn lots, junkyards full of scrap materials, and the proliferation of billboards
that had become increasingly commonplace alongside the nation’s highways. She pressed her husband,
then-president Lyndon B. Johnson, to do something about it. The result was the 1965 Highway
Beautification Act. The Act stipulated in part that "the erection and maintenance of outdoor advertising
signs, displays, and devices in areas adjacent to the Interstate System and the Primary System should be
controlled in order to protect the public investment in such highways, to promote the safety and
recreational value of public travel, and to preserve natural beauty." 7
The Act controls signs within 660 feet of the edge of an interstate highway and those highways
that are designated as being part of the Primary System. It requires that non-accessory advertising
signage (billboards) be limited to industrial and commercially zoned areas, and that the sign’s size and
lighting be regulated. It also stipulates that the signs cannot be less than 500 feet apart along the

Interstate Highway and the Primary System. All states and municipalities are required to enact
regulations consistent with the federal regulations.
Since the law was passed in 1965, the Highway Beautification Act has been amended several
times. It has been a controversial and much-debated act of federal legislation. Scenic America, an
organization dedicated to preserving scenic beauty and protecting public space, contends that the Act is
“broken”. This contention is based on the continued violation of the Act. According to Scenic America’s
publication “The Highway Beautification Act: A Broken Law”, despite the original intentions to “protect
the public investment in highways, to promote the safety and recreational value of public travel, and to
preserve natural beauty”, illegal billboards continue to proliferate along the nation’s highways
destroying scenic views and degrading the public environment. 8
Background & History of Signage Regulation in Philadelphia
Philadelphia has a long
history regarding its attempts to
regulate outdoor advertising. The
first reference to outdoor
advertising was in the 1938
ordinance, which required a license
(renewable annually), to operate an
outdoor advertising firm. It also
required that billboards be
inspected for safety. A violation of
the ordinance resulted in a $50
fine.

The 1965 Highway Beautification Act (HBA) represented a landmark change in signage
regulation—before, it had been up to municipalities to decide individually how to regulate advertising.
The HBA allowed room for elaboration and expansion of regulations, but mandated several specific
requirements regarding size, lighting and placement of non-accessory billboards now called Outdoor
Advertising Devices (OAD). In 1972, the Commonwealth of Pennsylvania entered into an agreement
with the federal government, pledging to abide by the tenants of the HBA. Two years later, as a result
of an agreement with Philadelphia, the Pennsylvania Department of Transportation (Penn DOT) certified
to the Federal Highway Administration that the City of Philadelphia had agreed and would abide by state
and federal signage regulations. Below is a brief timeline of billboard regulation in Philadelphia, with a
summary of notable regulation requirements.9

Timeline of Billboard Regulation in Philadelphia
1938: Philadelphia enacts sign ordinance regulating outdoor advertising, setting an annual license fee,
exemptions and penalties for failure to comply.
1963: Philadelphia passes a sign ordinance setting distance requirements from residential districts
1965: Congress enacts the Federal Highway Beautification Act
1971: Pennsylvania passes the “Outdoor Advertising Control Act,” exercising the powers given to it
through the Federal Highway Beautification Act to control Outdoor Advertising Devices.
1972: Pennsylvania Transportation Secretary signed the State/Federal Agreement requiring the
Commonwealth to enforce federal standards governing the size, lighting and spacing or risk losing 10
percent of its Federal highway funding. The Commonwealth was and still is responsible for the
enforcement of this Agreement which applies to every city and municipality.
1974: Philadelphia is granted certification by the Commonwealth to enforce the Federal/State
Agreement controlling size, spacing and lighting within the City’s commercial and industrial areas. Under
the terms of this Agreement, Philadelphia must enforce the 1972 State/Federal Agreement’s controls
regulating size, spacing and lighting along its Federal and Primary Aid Highways.
1977: Philadelphia enacted Bill No. 436 which Amended section 14-102 of the Philadelphia Code relating
to definitions, by providing an expanded definition of a sign, and by providing additional definitions
dealing with various types of signs.
1977: Philadelphia enacted Bill No. 437-A which amended chapters 14-300 and 14-500 of the
Philadelphia Code relating to commercial districts and industrial districts by amending Sections 14-303,
14-304, 14-305, 14-306, 14-506, 14-507, 14-508, 14-509 and 15-510, relating to the C-2, C-3, C-4, C-5
Commercial Districts, L-4 Limited Industrial, G-2 Industrial, L-R Least Restricted Industrial and Port
Industrial Districts, by permitting outdoor advertising signs, under certain terms and conditions.
1977: Philadelphia passed Bill No. 438-A which amended chapter 14-1600 of the Philadelphia Code by
adding a new section relating to outdoor advertising or non-accessory signs and structures by providing
size, height, illumination and spacing requirements, established minimum distances from residential
properties, and established areas in the City in which such signs are prohibited, including those within
660 feet of the outward edge of the right-of-way lines of all bridges over the Schuylkill River. The City
also set spacing requirements, maximum sign area and number of structures and sign faces permitted
on any one lot, set limitations on illuminated, animated, flashing and revolving signs and height
restrictions of 25 feet from the bottom of the sign.

Clear Channel Outdoor, Inc., and H.A. Steen Industries addressing violations found by the Penn
DOT/Baker Inventory. The Settlement temporarily legalized previously un-permitted and illegal
billboards for specific billboard owners, removed requirements for safety inspection of billboard
structures and reduced annual license fees from 650 dollars to 50 dollars per sign face.
Conclusion
The results of this report show that a lack of enforcement of outdoor advertising regulations is
an ongoing problem in the city of Philadelphia. Many billboards that are not in compliance with
Philadelphia’s certification and, by extension, the Highway Beautification Act of 1965, have been
allowed to remain standing along Philadelphia’s highways. According to the Act, if the state of

Pennsylvania is found to be out of compliance with its agreement of 1972 with the U.S. Government
regarding the Highway Beautification Act, the state stands to lose 10% of its federal highway funding.10
The actions taken (or not taken) regarding enforcement of outdoor advertising regulations by the City of
Philadelphia could impact federal funding for the entire state.
Using the Federal regulations set forth in the 1965 Highway Beautification Act which have been
incorporated into the Philadelphia Zoning Code, this study shows for instance the number of outdoor
advertising signs along I-95 in Philadelphia that are not in compliance with local, state, and federal
regulations. Although not as
lengthy or extensive, this report
uses the 2006 Philadelphia
Outdoor Advertising Inventory,
developed by the Michael Baker
Corporation in partnership with
Penn DOT, as a model.11 This
report uses the same or similar
categories to those used in the
2006 study. It is important to
note that many of the signs

Philadelphia’s certification still
have not been brought into compliance, despite the fact that it has been six years since the study was
conducted and the information published. This report and the Baker study find 113 signs in common.
This report also contains billboards not found in the Baker inventory, and the Baker inventory contained
signs not included in this report (not through deliberate omission but perhaps because of differing
survey methodologies). Only 20 of the billboards that the two reports have in common were found to
be in compliance with all regulations, including having valid permits.
Appendix A: Compliance Study
Methodology
There were several different variables used to determine whether the outdoor advertising signs
surveyed fell into compliance with local, state, and federal signage regulations. The scope of this study
focused on OADs (outdoor advertising signs or “billboards”) along the I-95 corridor within the City limits;
along I-676, which runs through the heart of the City, and a sampling of signs along the Schuylkill
Expressway (I-76). In total, 183 signs within 660 feet of the highways were photographed, inventoried,
and analyzed for compliance with local, state, and federal laws.

The photos and best available address data from the survey were then compared with address
data using Google Maps. The address data was then researched in
the Office of Property Assessment’s (OPA) online database, and an
address was selected from that list based on a) whether or not the
OPA listing stated that the land was being utilized for a billboard, or
b) the closest possible geographical match. Permits for these signs
were then researched, based on the best available address data
found through OPA, utilizing Philadelphia’s Licenses and
Inspections’ online zoning archive. Permits found were then saved
in a file along with photographs taken of the sign during the survey.
Then, five variables were examined to determine the
compliance of these signs with the Highway Beautification Act, as
amended, and with state and local regulations. The variables were:
1. Whether or not a permit for the sign could be located.
2. The total area of the sign face of the billboard. Anything
over 1,200 square feet was considered a violation.
3. The height of the sign above the roadway that it was

4. The spacing between outdoor advertising structures. Any
OAD that was less than 500 feet away from another OAD was considered a violation.
5. Zoning compliance. According to the Highway Beautification Act, OADs can only be located in
areas zoned commercial or industrial. A sign located in any other zoning classification was
considered a violation of the Certification.*
Additionally, signs that were found by the 2006 Baker OAD Inventory to be in violation of one or
more tenants of Philadelphia’s certification and which have not been found to have been corrected in
the intervening 6 years since the study was published, were compared with this study. OADS discovered
during this survey that were not found in the Baker Study were left blank.12
Using the best available parcel information from OPA, the addresses were then entered into
Google Earth, and the distance between signs was measured using the “Ruler” tool. The “Ruler” tool
was also used to measure the size of the top of the sign face, and then proportions were used to
approximate the square footage of the sign face. Signs classified as a size violation were found to be
above the Philadelphia code’s square footage limit of 1,200 square feet. All signs that were classified as
a “distance between OADs” violation were measured to be less than 500 feet apart. Height violations
were also found using proportions from examining photographs. According to the Philadelphia Code
“the bottom edge of any outdoor advertising sign shall not be located more than 25 ft. above the road

surface from which the advertising message is visible,” so signs whose bottom edges were obviously
higher than 25 feet above the road surface were categorized as a height violation.13
A list of eighty-nine signs for which permits could not be located on the online database was
then taken to the office of Licenses and Inspections where an examiner was unable to locate the permits
for these signs.

Finally, compliance with zoning was examined using the Office of Property Assessment online
database which lists the zoning for the parcel. As previously mentioned, according to the Highway
Beautification Act and the Philadelphia Code, billboards are only allowed to be erected in areas zoned
commercial or industrial. Billboards found in areas not zoned commercial, industrial, or in some
combination thereof were listed as in violation.

This survey identified 183 sign structures, supporting 331 sign faces. Out of those 183 sign
structures, only 32 were in compliance with all local, state, and federal regulations, and had valid
permits.14 27 signs had some sort of permit, but it was either revoked, expired, difficult to read, or
difficult to discern the sign that the permit belonged to—those permits were categorized as
“questionable.” No permits could be located for the remaining 89 structures.

The Highway Beautification Act also stipulates that OADs along an Interstate Highway or Primary
Aid Highway can be no closer than 500 feet apart. The distances between OADs were measured, and 66
structures were found less than 500 feet apart and thus violated the distancing regulations of the
Philadelphia Code
Study Issues
Obtaining Accurate Parcel Address Information
Difficulty in obtaining accurate address data was one of the primary issues of this study. As
previously mentioned, addresses were located first by pinpointing the sign on Google Maps; then,
similar addresses to the one found were researched on the Office of Property Assessment’s online
database. The addresses were then cross checked again with Google Maps for accuracy of location. The
address found to be most accurate was then entered in a master table under “Alternate Address”. This

address was used to search for permits on the Department of Licenses and Inspections’ online database.
Although multiple measures were taken to ensure
accuracy, certain parcels were very difficult to locate,
particularly those along railroad right-of-ways or on very
large parcels of industrial land.

Inspections has for searching permits is set up in such a
way that it is difficult to find a permit if the address is not
exact. The search only returns one address at a time, so

stored offsite. As previously mentioned, a list of addresses where permits could not be found was
submitted to L&I for review. But with the inability to cross-check multiple addresses with other
information, it was difficult to search. Also, the permits viewed were scanned hard copies, and many
were torn, faded, or are generally difficult to read. Thus it was difficult to determine which signs they
pertain to - hence the category “Permit Questionable” in Table 1.
Photographing and Cataloging Signs
Signs along railroad right-of-ways, on large parcels, or blocked by buildings, foliage, etc., were
difficult or impossible to safely photograph. The first part of the inventory was done by finding outdoor
advertising signs located along side streets that run parallel to the Interstate Highways. Then, photos
were taken from the highway itself in an attempt to capture any signs that were missed previously.
However, the high speeds and volume of traffic made it difficult to take accurate photos. Therefore, it is
possible that some signs were missed in the inventory due to these difficulties.
Sign Measurement
The size of the OAD sign faces was estimated using the “Ruler” tool in Google Earth to measure
the top width of the sign, and then proportioned out using a frontal photograph. For example, a
standard 1,200 square foot sign face has a face width that is approximately three times the height of
the sign, making for a sign that measures roughly 60’ wide by x 20’ high. Any sign that appeared
significantly over these dimensions was recorded as a size violation; however, it is important to note
that this was a finding based on a best estimate.
Non-conforming Signs
The list of non-compliant signs (Appendix 2) includes a column for the date of the zoning permit,
if found. There are many signs that have no permits.

Non-accessory advertising signs built before 1972 were listed as “non-conforming signs.” In other
words, they did not have to adhere to the new regulations, if they had a permit. Based on the
information available, out of 151 non-compliant signs, only 13 were erected prior to 1972.
Non-conforming signs are those signs which are located in areas that no longer allow outdoor
advertising signs. These signs were permitted at the time that they were constructed, but as new laws
were passed, many areas no longer permit advertising signs. These non-conforming signs, according to
the Philadelphia Code, “shall be maintained in good condition,” but “shall not be structurally altered so
as to enlarge or extend the area or height of the sign,” and “shall not be reconstructed if for any reason
it becomes necessary to replace the entire sign.”16
Additionally, constructing a new OAD within 500 feet of a prohibited sign is not allowable under the
code, nor are any changes to the nonconforming sign allowed, including conversion to a digital sign.

Conclusion and Extension
Based on the results of this study, as well as the City’s actions subsequent to the settlement
agreement reached with Free Speech, LLC, CBS Outdoor Inc., Clear Channel Outdoor, Inc., and HA Steen
Industries in 2005, it appears that the City of Philadelphia has violated its agreement with the
Commonwealth of Pennsylvania. The City is bound by this agreement to enforce its laws, which were
originally created to protect the health, safety, and welfare of the City’s residents, as well as preserve

Philadelphia’s unique and beautiful natural resources and built environment for the enjoyment of
residents and visitors alike.
In addition, the proposed new signage code regulations to be added to Philadelphia’s newly
enacted zoning code do not address the hundreds of signs covered by the 2005 settlement agreement
that is set to expire in August of 2014. As a result of this study and the proposed new signage code
regulations, as well as the continued obvious violations of the Highway Beautification Act, the Federal
Highway Administration is being asked to perform an audit on the City’s compliance with the HBA.
Furthermore, in November of 2011, University of Pennsylvania graduate Jonathan Snyder
published a groundbreaking study revealing the negative impact of billboards on property values in
neighborhoods and communities. Not only did he find that properties located within 500 feet of a
billboard were worth on an average $30,826 less than their counterparts that were not in close
proximity to outdoor advertising signage, but that homes within a census tract where billboards were
present, even those not within 500 feet of a sign, experienced a decrease of $947 in property value for
every billboard in that tract.17 His research clearly supported the need for complying with sign control
regulations in a way that reaches beyond questions of aesthetics, and touches on an area that is
currently one of the primary concerns of local, state, and national government: economic stability and
prosperity.
Philadelphia has experienced something of a renaissance in the past several decades; however,
these non-complying outdoor advertising signs are a deterrent to further revitalization. In addition, two
years ago, architect and graduate of the University of Pennsylvania Gregory Young conducted a study on
the energy consumption of digital billboards. He found that these signs can consume up to 162,902
kilowatt hours per year. The average U.S. home consumes about 11,040 kilowatts per year. This means
that one digital billboard consumes nearly 15 times the energy of an average home.18 Digital billboards
are increasing in popularity with billboard companies, due to the fact that multiple messages can be
displayed on one sign, and the brightness and movement of the sign attracts more attention than a
regular billboard. If Philadelphia is striving to be the “greenest” city by 2015, the environmental impacts
of these signs must be considered.
There are many cities that prohibit billboards. In doing so, places like Sao Paolo, Brazil and
Houston, Texas have attracted more of the “creative class” and catalyzed additional economic
development in the process. If Philadelphia wants to compete with other cities in the U.S. for people,
jobs, and “creative capital,” it must emphasize the qualities that make Philadelphia such a unique and
wonderful place to live and work, and reject those elements, including illegal billboards, which block the
city’s iconic skyline and make it look more like “Anywhere, USA.”
