This letter is written to protest the granting of a liquor license to America The Diner, a 24-hour
restaurant to be located at 814 Cherokee Road, Louisville, Kentucky. It is our understanding an
application was sent to your office March 4, 2015, and there is a 30-day grace period for
citizens to file a formal protest.
Here are the reasons for my concern about granting an alcohol license to America The Diner:
• Cherokee Road in Louisville is a residential, preservation neighborhood with no commercial
establishments. This restaurant with 24 hour, 7 days a week service, serving alcohol, is
wholly inappropriate for the neighborhood.
• The building at 814 Cherokee Road is less than 35 feet from the sanctuary of the Episcopal
Church of the Advent (with over 250 members), which has served the neighborhood for
over 135 years; and a 24-hour, alcohol-serving restaurant with outdoor seating will
disrupt the serenity of the Church’s worship on Sundays and Thursday evenings, as well
as many other church and neighborhood events, including weddings, funerals and AA
meetings, that provide solace and celebration for the community.
• The confluence of Cherokee Road, Baxter Avenue and Broadway, in addition to the entrance
into Cave Hill Cemetery, is already congested and confusing with the various traffic
patterns and turn signals, especially during rush hours. Increased traffic, along with the
risks of alcohol consumption, presents a serious danger to other drivers, pedestrians,
bicyclists and property.
• Visibility of the ingress and egress from Cherokee Road poses a danger to traffic and
pedestrians. The one-way alley entrance behind the proposed 4,300 square foot, 125
occupancy restaurant is difficult to turn into (east to west), and traffic coming from
Cherokee Road must navigate a ‘blind’ curve before it is possible to see ongoing/coming
turn signals and drivers. This blind curve already has been the site of many car
accidents, and alcohol consumption exacerbates this navigation.
• Patrons of the 24-hour restaurant will potentially use the Church of the Advent lawn, which
will cause damage, increased litter, and other public nuisances.
• Noise levels from alcohol usage, outdoor seating & live (or recorded) music are disruptive to
church services and residents of the area.

• There are fewer than 14 parking spaces behind the building of the proposed restaurant, and
it is our understanding that a minimum of 18 is required. Patrons of the restaurant will
potentially use the Church of the Advent’s limited parking spaces (4-6) behind the
church that are adjacent to the alley (on the church’s property) that are reserved for the
church’s ministers, other church leaders, and handicapped members.
We would ask that you give serious consideration to deny the alcohol license request from
America The Diner, 814 Cherokee Road, Louisville, Kentucky in order to preserve the sanctity of
the Church of the Advent’s worship, the residential atmosphere of the Cherokee Road
neighborhood, and the safety of pedestrians, bicyclists, and drivers at this busy intersection.
