Resolved That the Minutes of the meeting held on 4 March, 2015 be taken as read and confirmed with the addition of the words under Minute 3 (Appendix) Application 14/0561 – 6 Dolphin Street “that the Conservation Officer assist where possible to identify potential sources of funding to install acceptable windows. 2 Development Management Planning Application Schedule Resolved (1) That decisions be recorded as shown on the Planning Applications Schedule attached as Appendix A. (2) That the Development Services Manager be authorised to draft any amendments to/additional conditions or reasons for refusal in respect of the Planning Applications Schedule, attached. 3 Appeal Decisions Consideration was given to a report following recent appeals. Planning Appeal – Dismissed (a) Application 14/0810 – Variation of Condition 1 relating to planning permission 12/0508 to allow extension of opening hours of hot food takeaway – 32 Clytha Park Road (b) Application 12/1186 –Demolition of dwelling and ancillary building and erection of three dwellings and garage (outline) - The Meadows, Glasllwch Lane (c) Application 14/0188 – Restoration of barn and conversion to office/business use – Barn at Priory Farm, Chepstow Road, Langstone (d) Application 14/0151 – Change of use of former toilet block and store to a one bedroom residence – Land adjacent to Church House Inn, Church House Park, St Brides Wentlooge Resolved That the appeal decisions be accepted as a basis for informing future decisions of the Planning Committee 4 Planning Enforcement Schedule Consideration was given to a report detailing a breach of Condition 05 (mechanical ventilation and glazing specifications) of planning permission 11/0146 at land at the Glan Llyn development site. Issues in the report related to the noise attenuation barrier, mechanical ventilation and glazing. Reference was made to the discussions which had been held with the Developer and householders. Environmental Health had no objection to the revised glazing specification and considered that the glazing installed was adequate. With regard to the mechanical ventilation some occupiers had confirmed that they did not wish the ventilation to be installed retrospectively, others had not responded and one property was yet to be occupied. In accord with revised scheme approved relating to the noise barrier, remediation works were currently being undertaken. Late representations had been previously circulated. Resolved That no further action be taken upon the breach of Condition 05 (mechanical ventilation and glazing specifications) of planning permission 11/0146 at land at the Glan Llyn development site. (The glazing in the affected plots as detailed in the Report was considered adequate to ensure the compliance with Condition 05 of 11/0146 and it is not in the public interest to require the installation of mechanical ventilation in the constructed plots that had not been installed to date) (The Development Services Manager left the meeting during consideration of this matter – Minute 4 refers) Appendix PLANNING COMMITTEE – 1 APRIL, 2015 DECISION SCHEDULE No Site/Proposal 14/1275 Court Farm, Magor Road Proposed Development of Solar Photovoltaic Panels (10mwp) and associated works, access tracks, security fencing and cameras, affecting public right of way 394/59 and 394/60 Llanmartin (resubmission following refusal of 13/1203) Ward Additional Comments Decision Langstone HRIH referred to a previous application which had been refused and that this application had been submitted following the Planning Inspector decision in Monmouthshire to allow an appeal against a refusal to grant planning permission for the proposed development of solar photovoltaic panels etc. Refused Committee had previously visited the site. HRIH referred to the late representations previously circulated. Community Councillor E Jefferies spoke in objection to the proposal. Mr J Ayres on behalf of the Applicant spoke in support of the application. Councillor Atwell, Langstone Ward Member spoke objecting to the application. Councillor Kellaway, Llanwern Ward Member spoke objecting to the application. Officers were recommending approval of the application with conditions. (Councillor Mudd joined the meeting during consideration of this item and did not vote) Reason The proposal will result in the loss of best and most versatile agricultural land for a period of minimally 25 years without the applicant having demonstrated an overriding need for the proposal or that viable sites on land of Grade 3b or lower are not available to accommodate the proposal. This is contrary to National Policy stated at Paragraph 4.10.1 of Planning Policy Wales (Edition 7) and TAN 6. Having had regard to the Monmouthshire appeal decision, Committee Members felt that national planning policy should be weighed differently and that the previous reason for refusal still stood. 15/0078 Proposed New Raised Flood Defences comprising reinforced concrete walls, embankments and ground raising 0.2M- 1.5M above existing ground levels and associated works Shaftesbury Ms A Gray, on behalf of the Applicant spoke in support of the application. Granted with conditions Marshfield Mr P Irving spoke in objection to the application. Granted with conditions Crindau Pill Flood Alleviation Scheme, Evans Street 14/0908 Proposed Single Storey Rear Extension Marshfield Village Hall, Wellfield Road 14/1287 The Merry Miller, Monnow Way Councillor White, Marshfield Ward Member spoke in support of the application. Bettws Residential Development of 19 No Units and Associated External Works, including demolition of existing public house and betting office Councillor Delahaye, Bettws Ward Member spoke in support of the application. Officers clarified the position regarding the sewers at Bettws. Granted with conditions and subject to a Section 106 Legal Agreement with delegated power to refuse the application if the Section 106 Agreement is not signed within 6 months of the Council’s resolution to grant planning permission. (Councillor Linton left the meeting after consideration of this item) 15/0125 Rear of Unit 3, Port Road Retention of change of use from A1 (Retail) to B8 (Storage and Distribution) Pillgwenlly Councillor Ali, Pillgwenlly Ward Member spoke in support of the application. Granted with conditions 15/0064 22 Park View Gardens, Bassaleg Graig Officers were recommending refusal of the application. First Floor Side Extension (Councillor Mudd left the meeting after consideration of this item) Granted with conditions including the need for materials to match those of the existing property, no first floor windows in the side elevation and the provision of parking as shown on the submitted plans. Having had regard to the SPG, Committee Members felt that in the context of the street scene the proposed extension would not result in an unacceptable terracing effect.
