Effective January 1, 2009, several states
have changed the requirements for
titling and registering vehicles. The
changes are as follows:
New Jersey: 2009 model year and
newer with a GVW rating of 8500lbs
or less must now meet California
emission requirements.
Connecticut: 2006 and older model
vehicles now require an emissions test,
and 2007 and older vehicles must now
have VIN verification. Previously, 2005
vehicles and older needed the VIN
verification.
Pennsylvania: Customers registering
and titling vehicles in PA must now
also provide a photocopy of the back
of their Pennsylvania license as well as
the front.

Refinance or Lease Buyout-How to
Tell the Difference
Balloon financing became a popular choice for New York buyers when leasing
was not available. However, several banks refer to the balloon contracts as
leases, which can be confusing to both customers and dealers.
Here’s how to determine if you are processing a refinance deal for your
customer:
If the title is in the customer’s name who is obtaining the financing, the
contract was a retail contract and the refinance paperwork will be as
follows:
1. DO NOT have the customer sign the title over to your dealership –
doing so signifies change of ownership, and makes the vehicle eligible
for the Lemon Law Warranty. There is no need for the customer to sign
the title as he already owns the vehicle.
2. If you are merely helping the customer to finance the final payment or
payments, there is no need to stock the vehicle into your police book.
You are NOT issuing an MV50 and therefore would not be able to take
the vehicle out of the police book.
3.Attach an original MV901 and an original MV900 to the original title
for processing. You are simply replacing the lienholder, not changing the
name on the title.
4. Attach a check in the amount of $5.00 made payable to the Commissioner
of Motor Vehicles.
5.There will be no sales tax due on the vehicle as the customer paid tax
on the full amount of the vehicle at the time of original purchase. Your
dealership is not selling the vehicle, merely helping the customer to
obtain financing.
6.A title listing the current lienholder will be forwarded to the customer.

DMV Lists Most Common Violations
In response to a request from GNYADA, the Department
of Motor Vehicles has compiled a list of the most common
violations they find at franchised new car dealerships.
Because the original list was generated based on the section
numbers cited in violation notices, understanding the list
required comments and analysis by DMV staff throughout
the state. The following list is based on their feedback:
1.Failure to submit the Certificate of Sale and ownership
document within five calendar days after delivery of the
vehicle 15 NYCRR 78.11(f )
2.Failure to properly maintain the book of registry 15
NYCRR 78.25(a)(1)
3.Failure to have possession of the required documents
necessary for registration and titling before issuing a
temporary registration 15 NYCRR 78.23(d)(2)
4.Fraud or fraudulent practice or dishonest or misleading
advertising VTL 415-9(c) (Note: This reflects a number
of different acts or practices that could rise to the level
of an alleged violation; it does not reflect a single action
or type of action that constitutes a violation.)
5.Failure to properly secure dealer demonstration plates

6.Issuing more than one Temporary Certificate of
Registration to same person for the same vehicle 15
NYCRR 78.20(d)
7.Failure to give purchaser the customer copy of MV50

8.Falsely certifying that the motor vehicle is in condition
and repair to render, under normal use, satisfactory and
adequate service VTL 417
9.Failure to follow procedures for preparation and use
of Certificates of Sale (Form MV-50) as required 15

10.Failure to inspect all vehicles except motorcycles prior
to delivery for the items set forth in regulation and
ensuring that these items meet the required standards

ALTERED MV-50s
Certificate of Sales certificates (MV-50s) containing minor
alterations may be accepted by the DMV. However,
certificates with alterations occurring in the following areas
will NOT be accepted:

the plates for accuracy.

Registering a vehicle to a corporation is
nothing new. But have you ever come across
a registration involving an unincorporated
organization? Examples of unincorporated
organizations are labor unions, lodges,
social clubs, churches, political parties,
limited liability companies and some large
trade and professional associations. Use the
following chart to secure the proper proof
to register a vehicle for an unincorporated
organization.
