MARK KANTOR SUITE 311B 110 MARYLAND AVENUE, N.E. WASHINGTON, D.C. 20002 TEL. 202-544-4953 FAX. 202-318-9170 [email protected] HOW TO BREAK INTO ARBITRATION: USEFUL RESOURCES FOR STUDENTS AND YOUNG PRACTITIONERS By Mark Kantor1 There are excellent resources for students and young practitioners interested in arbitration, but they are scattered across the Web. This list is intended to be a one-stop detailed reference, and includes links to young arbitration groups; arbitration websites; publications and podcasts; moots; Who's Who lists; law firm newsletters; law schools with specialized international arbitration programs; arbitration blogs and online discussion groups; and arbitration centres and events. The list focuses on international arbitration, not more general dispute resolution, and we have limited inclusion accordingly. The list cannot be exhaustive, although we have tried hard. We apologize in advance for inadvertent omissions, and we invite any organization to contact us about inclusion of inadvertently omitted links. This resource is the product of a collaborative effort between students of the Georgetown International Arbitration Society (“GIAS”) and members of the DC Bar International Dispute Resolution Committee. GIAS is a non-profit association at the Georgetown University Law Center of students and lawyers who are dedicated to the promotion of international arbitration and dispute settlement, created in 2008 to facilitate discussion between students, academics and practitioners on issues concerning international arbitration. To learn more, e-mail the leadership at ([email protected]). You should also consider attending events sponsored by the DC Bar’s International Dispute Resolution Committee. You can be added to the distribution list for further events by sending an email to co-chairs Jean Kalicki ([email protected]) Prof. Marsha Echols ([email protected]) or Mark Kantor ([email protected]). Young Arbitration Groups 1 Grateful thanks to Cody D. Constable and Vik Kapoor of GIAS for doing all the hard work on this list. Investment Treaty News (http://www.investmenttreatynews.org) - This periodic e-mail briefing covers cases and treaty developments in the area of investment treaty arbitration. It is a service of the International Institute for Sustainable Development (IISD). IISD is an NGO that is often very critical of the system of investment and trade treaties, 3 including investment arbitration. Its weekly update is an excellent (if mildly biased) source of news. Investment Arbitration Reporter (http://www.iareporter.com) is a “by subscription” specialised news publication tracking developments in the area of international investment law. You can sign up for free “breaking news” email alerts. At Transnational Dispute Management (http://www.transnational-disputemanagement.com/members/articles/welcome.asp), an online journal, you can sign up for free e-mail alerts and news digests (http://www.transnational-disputemanagement.com/news/tdmnewsdigest.htm). In addition, you can learn about OGEMID and YOUNG-OGEMID, very active e-mail discussion lists. YOUNG-OGEMID is aimed in particular at young professionals. You can join (http://www.ciarb.org/joining-us) as an associate, which is not the same as a member, but Associate-level participation is being rethought right now to make it more accessible to young lawyers. The CIArb runs a number of easily accessible London-based events. CIArb has a number of regional branches (see http://www.ciarb.org/branches/), some of which also have their own websites. For example, the North American Branch website is here http://www.internationalarbitrators.org/. Institute for Transnational Arbitration (http://www.cailaw.org/ita/publications.html). National Law School of India University International Arbitration Moot Court Competition (http://www.nls.ac.in/interarbimootcourt.htm) The Willem C. Vis International Commercial Arbitration Moot – The Willem C. Vis International Commercial Arbitration Moot is the premier arbitration competition for law 5 students. Year 2009-10 marked the seventeenth year for Vienna (http://www.cisg.law. pace.edu/vis.html) and the 7th year in Hong Kong. (http://www.cisgmoot.org). Teams from law schools from all countries are eligible. The Vis Moot involves a dispute arising out of a contract of sale between two countries that are party to the United Nations Convention on Contracts for the International Sale of Goods. The contract provides that any dispute that might arise is to be settled by arbitration in "Danubia", a country that has enacted the UNCITRAL Model Law on International Commercial Arbitration and is a party to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards. The arbitral rules to be applied rotate yearly among the arbitration rules of co-sponsors of the Moot. Participants in the Vis can later become members of the Moot Alumni Association (the MAA). (http://www.maa.net). The MAA publishes the Vindobona Journal, provides members of the Board of the CISG review, sponsors conferences, has observer status at UNCITRAL for the ongoing revisions to the UNCITRAL Arbitration Rules and throws great parties. The Foundation for International Arbitration Advocacy (www.fiaa.com) runs a series of hands-on advocacy training workshops in Switzerland, on topics including witness examination, cross-examination, oral argument and written advocacy. The Centre of Arbitration and Conciliation of the Chamber of Commerce of Bogotá offers a Specialized Course on International Arbitration as part of its School of International Arbitration (http://www.cacccb.org.co/ingles/contenido/contenido.aspx?catID=165&conID=530) . The Specialized Course on International Arbitration is aimed at Latin American lawyers between the ages of 30 and 45 years with an interest and experience in the area of international commercial arbitration. La Competencia Internacional de Arbitraje Comercial (http://www.urosario.edu.co/jurisprudencia/IIICompetencia_Internacional_de_Arbitraje/ur/Presentacion.aspx) is an international arbitration moot competition organized jointly by the law schools of the University of Buenos Aires (Argentina) and the Universidad del Rosario (Colombia). Almost thirty teams from different countries (including Argentina, Colombia, Perú, Chile and Uruguay, among others) participated in 2009's competition, and the organizers expect the event will continue growing. The competition is similar to the Vis Moot. The written memoranda and the oral hearings are conducted in Spanish. We welcome suggestions about other law school international arbitration programs to include. Of course, there are a large number of extraordinary LL.M and other legal education programs worldwide where students can obtain a valuable education covering inter alia 9 international arbitration, even without specialized programs in the field. See, for example, the programs listed at LLM Guide: Master of Laws Programs Worldwide (http://www.llm-guide.com/) , LLMStudy.com (http://www.llmstudy.com/) , LLM Uniiks (http://llm.uniiks.com/) and the ABA Section on International Law Student Headquarters (http://www.abanet.org/intlaw/students/llm.html). By no means are we suggesting that a program specializing in international arbitration is a requisite for success in this field.
