Scheme overview The cover is to be given, not charged for, by the contractor to the customer It will be available on all pools installed up to a contract value of £200,000 with the exception of those fitted in a commercial environment (such as Hotel or Leisure Centre) Where the contract is with a developer but the end user will be a domestic home user then the Policy can be issued Value of the IBG The aggregate amount payable under this policy is the original contract value (not more than £200,000, as detailed in the schedule) or £50,000 whichever is the lesser Each individual claim will be limited to a maximum of £25,000 All claims will be subject to the policy Excess What is covered in this IBG? Pool Shell Finishes Equipment Breaches of SPATA Standards Six years* Two years One year Three years * Please note this figure may change as part of the development of European standards Exceptions The Insurer shall not be liable for: 1 Any defect that would not have been recoverable under the Contractor’s Written Guarantee; or 2 the cost of routine maintenance, overhaul or modifications or loss or damage arising therefrom, or for which compensation/recourse is provided by legislation such as but not restricted to the Consumer Credit Act 1974; or Exceptions 3 any loss of use, loss of profit, loss of enjoyment or Consequential Loss of any nature; or 4 any loss or damage for which the Policy Holder can obtain compensation or recourse from a third party 5 any damage or defect caused by fair wear and tear, sunlight, storm or deterioration due to neglect in maintenance; or Exceptions 6 the rectification of defective design of the Insured Works but not damage to the Insured Works resulting therefrom unless otherwise excluded; or 7 any remedial work undertaken without the consent of the Insurer 8 any amount which is above the limit of Indemnity as detailed in this Policy Exceptions 9 any damage caused to the property at the time the Insured works were carried out 10 any loss or damage to the Insured Works caused by any peril capable of being insured under a commercial property, household or similar policy of insurance, including but not limited to fire, lightning, explosion, storm, tempest, flood, malicious damage, accidental damage, subsidence, landslip or heave, whether or not such insurance is effective or in force at the time Exceptions 11 The cost of repairs and any awards for costs issued by a court of law, relating to an action brought against the Contractor by the Policy Holder which directly results in the Contractor Ceasing to trade 12 any work necessary to bring the Insured works up to current SPATA Standards, where the Insured works met the SPATA Standards in force at the time the Insured works were completed Scheme procedure SPATA Members make the declaration to Weald, who will process the information and issue the policy direct to the Member’s customer What is needed? Compulsory membership for installers (and renovators) Inspection fee of £250 to be paid by the client (not refunded, if claim unsuccessful, but there would be an insurance excess of £250 to be paid by client) Next steps Start date proposed is April 2014 onwards Subject to feedback at the AGM, there may be a need to survey members to identify if this is the desired way forward Feedback Over to You!
