B) Direct the County Attorney's Office to amend the construction code (Ordinance 12-5) to delete the Contractor License Delinquent Renewal penalty which will be addressed in the Building and Construction Services fee schedule. Approval of this agenda item is anticipated to reduce the cost of building permits by $7.23 million during calendar year 2013 and reduce the fund balance in the Building Services Fund from a current projected level of $7.5 million at December 31, 2012 to $3.8 million by December 31, 2013. Financial Impact Statement: Approval of this agenda item is anticipated to reduce the cost of building permits by $7.23 million during calendar year 2013 and reduce the fund balance in the Building Services Fund from a current projected level of $7.5 million at December 31, 2012 to $3.8 million by December 31, 2013. Background: At the September 8, 2011 Board meeting, the Board voted to approve a 15-month 50% fee reduction for building and construction related permit applications. The period of the reduction was from October 1, 2011 through December 31, 2012. The reduction was made due to the downturn suffered by the building industry and was designed to stimulate economic development and construction activity. Over the term of the reduction, permit activity has increased. However, there has not yet been a significant sustained recovery. By approving this agenda item, the Board will further stimulate the building industry and the local economy. The proposed fee schedule also includes minor corrections to the adopted fee schedule to reflect current practices. Additionally, the County recognizes that the current fund balance in the Building Services Fund is greater than is necessary to assure financial stability within the fund. The Building Services Fund will close FY 12 with a projected fund balance of $7.5 million. Further reduction to the adopted fee rates will initiate the process of reducing the ending fund balance while maintaining sound financial practice. Extending the reduction period for an additional 12 months while simultaneously increasing the reduction rate to 60% fee is anticipated to reduce fund balance to $3.8 million by December 31, 2013, which is approximately 4.5 months of operating expenditures. During the term of this extension, staff will continue to work with the building industry to further evaluate the County's fee structure and to develop a target fund balance policy for managing fund balance to a level that will be maintained within an agreed upon range. A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF HILLSBOROUGH COUNTY, FLORIDA AMENDING RESOLUTION R11-088 RELATING TO THE FEE SCHEDULE FOR BUILDING AND CONSTRUCTION SERVICES, PROVIDING FOR AN EXTENSION OF THE LIMITED-DURATION PERMIT FEE REDUCTION AND AN INCREASE IN THE REDUCTION PROVIDING FOR REVISIONS TO THE ADOPTED FEES AND PROVIDING FOR STAND-ALONE PERMIT FEES Upon motion by Commissioner ______________, seconded by Commissioner ______________, the following Resolution was adopted by a vote of to , with Commissioner(s) voting “No”: WHEREAS, the Legislature of the State of Florida has in Chapter 125, Florida Statutes, authorized local governments to adopt ordinances and regulations to protect the public health, safety, and general welfare of its citizens; and WHEREAS, the Legislature of the State of Florida in Sections 125.56 and 553.80, Florida Statutes, has authorized local government regulation of building construction and adoption of fee schedules for permitting, inspection and enforcement of the Florida Building Code; and WHEREAS, the Board of County Commissioners has adopted ordinances and regulations regarding activities including but not limited to building construction and inspection and administration of competency tests and renewal of licenses for construction trades and has included procedures for submission and review of applications and inspections; and WHEREAS, the Board of County Commissioners has established a fee schedule for Building and Construction Services, formerly know as the Development Services Department Building Services Division, as reflected in Board Policy 03.04.16.00; and WHEREAS, on September 8, 2011, the Board of County Commissioners adopted Resolution R11-088 providing for a limited-duration reduction in permit fees for building and construction related permit applications and applications for service which reduction was effective through December 31, 2012; and WHEREAS, the fee schedule for Building and Construction Services should be reviewed to ensure that the fees do not exceed the costs necessary for permitting, inspection and enforcement of the Florida Building Code; and WHEREAS, based on the current economic conditions, the Board of County Commissioners finds that it is in the best interest of the County to extend the limited-duration building and construction permit and service fee reduction through December 31, 2013 and increase the reduction; and WHEREAS, the Board of County Commissioners of Hillsborough County finds that the extension of the limited-duration fee reduction and increase in the reduction provided by this Resolution represents a reasonable assessment of fees for building and construction permits and services in light of the desire to stimulate economic development while the fee schedule is being reviewed. 4 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF HILLSBOROUGH COUNTY, FLORIDA, AT ITS REGULAR MEETING ASSEMBLED THIS 15th DAY OF NOVEMBER 2012: 1. All building and construction related permit applications and applications for service regulated by the Florida Building Code filed pursuant to established procedures shall be accompanied by the fees as set forth in the schedule attached hereto as Exhibit A. 2. The “Stand Alone” permit fees in Exhibit A shall be applicable to stand alone trade permits associated with new single-family permitting as such time as the County’s permitting software is modified to accommodate such permitting. 3. The fees noted with an asterisk on Exhibit A shall be reduced by sixty percent (60%) for all building and construction related permit applications and applications for service filed on or after the effective date of this Resolution through December 31, 2013. For applications filed after December 31, 2013, all fees shall be charged at one hundred percent (100%) of the amount shown on Exhibit A, and the asterisk notations shall have no further effect. 4. The Building Services Fund balance shall be monitored from the effective date of this Resolution through December 31, 2013. In the event that the Building Services fund is projected to fall to a level that ceases to represent fiscal stability, the Board of County Commissioners reserves the right to rescind the sixty percent (60%) reduction provided by this Resolution prior to December 31, 2013. Any such rescission shall not become effective until thirty (30) days after approval by the Board of County Commissioners. 5. The Board of County Commissioners shall review the fee schedule established by this Resolution prior to December 31, 2013. 6. The fees collected pursuant to this Resolution shall be used exclusively to pay for activities necessary to administer and enforce the Florida Building Code and shall not be diverted to any other purpose. 7. The provisions of this Resolution shall supersede and repeal the provisions of Resolution R11-088 and the fee schedule set forth in Exhibit A, subject to the limited-duration modification provided by this Resolution, shall replace the fee schedule set forth in Board Policy 03.04.16.00. 8.
