Sample Submission Instructions, Terms and Conditions, and Data Transmittal Sample Submission Form – There are three (3) forms that can be used depending upon the type of measurement requested. Complete the
information requested on the form and enter Analysis Code from the price list above. The information will be used by the MPAL Technical Staff to
perform measurements. If questions arise, please contact MPAL. If the MPAL staff has questions, they will contact you directly.
Receipt of samples – All shipments must include the Sample Submission Form, MSDS and billing information before samples can be entered into
the laboratory schedule. Samples received after 12:00noon will be entered into the schedule on the next business day. Microtrac Particle Analysis
Laboratory (MPAL) is open Mon – Fri except holidays. Shipments can be received from 8:00 am through 4:00 PM. If samples are damaged upon
receipt or if there is evidence of corruption of the packaging and contents, customer will be notified immediately.
Data Questions – Questions regarding the data may be addressed to the MPAL analyst having performed the measurements. The analyst may
enlist the assistance as necessary of other Microtrac experts.
Reliability – Representative sampling is a key to all analytical measurements. Samples that are not representative of whole can provide data not
representative of the material under test. Using good sampling techniques is a prerequisite to trusted data. MPAL has the capability to develop
representative samples from the sample supplied. Should special techniques be required to achieve representative sample, charges may be
assessed. MPAL instrumentation undergoes a validation IQ/OQ on an annual basis using the same vigorous testing and documentation procedures
by Microtrac Certified Service Engineers on instruments owned by our customers.
Analysis Method – Measurements will be performed on the instrumentation requested. If laboratory personnel determine that a different technique
will provide more advantageous information, customer will be notified by phone or e-mail.
Liability – MPAL cannot be held responsible for any damages due to delay or a failure to perform measurements on-time beyond its reasonable
control including power outages, weather, acts of God or other situation.
Delivery of Data – The Laboratory will provide data by e-mail unless otherwise requested. Email provides the quickest means to transmit data. Data
can also be transmitted by US Mail, FedX, USPS and FAX. Extra charges may apply.
Turnaround Time – Data will be provided not later than the last day of requested turnaround. If samples are not completed within the requested
turnaround, charges will be reduced coinciding with the actual turnaround. Due to the length of time required for surface area preparation and
measurements, limitations apply to turn-around time.
Retaining Samples – Samples received can be held 90 days, returned or discarded. It is important to note that powders and slurries can change
during normal storage conditions whether those conditions require refrigeration or room temperature. If changes to the nature of the material occur,
data changes may also occur.
Return of Samples – For a request of samples to be returned, Shipping and Handling charges will apply unless a shipping account number is
supplied on the Sample Submission Form. It usually more cost effective for the customer to supply shipping account number and carrier information.
Laboratory Qualification – MPAL operates under ISO 9001 and undergoes audit once per year as part of the Total Quality System in place at all
Microtrac facilities. In addition it operates using the guidelines of cGMP. Analysts are trained and re-trained on a regular basis as evidenced by inhouse training records. The MPAL is available for audit by request and appointment. Charges may apply depending upon level of business and
situation.
Re-measuring Samples – If customer requests a second or more repeat measurements on a sample, MPAL will comply with the request. If the
data are within general norms of reproducibility, charges may be assessed. If data demonstrate significant difference, charges will not be assessed.
Request must be made within 3 days of the data being transmitted to avoid potential changes in particle state.
Sample Preparation – Sample preparation is an important aspect of particle size measurements, surface area, porosity, etc., as with other
analytical measurements. There is no charge for this aspect of measurement except in special situations. Information on sample preparation to
satisfy the specific needs of the customer should be completed and provided with the Sample Request Form on a separate paper. It is not always
desirable to develop procedures that provide full dispersion for particle size distribution measurements. Please call Microtrac MPAL if you would like
to discuss. Special set ups other than normal routine use or instrument conversions, may require assessment of additional fees.
Solubility and other Physical Characteristics – Information on physical characteristics is important to providing robust measurements. Depending
upon the measurement requested please provide information on parameters such as solubility (fluid suspension measurements), melting point
(surface area), etc. A second sheet may be attached to the Sample Submission Form to provide this information.
Payment, Billing and Invoicing – MPAL terms for payment are net 30 days. Use of Purchase Order Number must include hard copy of order.
Payment can be made by AMEX, VISA, Purchase Order, Master Card or by US Bank check and provided as part of the Sample Request Form.
Payments are to be in US Dollars. Analysis Services will not be initiated if past due accounts are not current or payment issues not resolved to the
satisfaction of Microtrac, Inc.
Liability Limits – Data may not necessarily indicate the characteristics of other samples from the same or other lots. MPAL assumes no
responsibility for the use of the data as chosen by the customer. MPAL will not be liable for any damages due to services performed by MPAL. In any
event liability will not be in excess of the billed or invoiced amount
.
Indemnity and Fees – Customer agrees by providing the Sample Submission Form to hold harmless all people associated with MPAL and its parent
company, Nikkiso America Inc., arising by any misconduct or other negligence by the customer. Customer will be responsible for fees and costs
associated with attorneys and litigation. The laws of Pennsylvania (Montgomeryville County) shall govern the terms of this agreement. Federal law
will preempt state regulations.
