Manual under R.T.I. 2005 Section-4[1] [b] [i] Particulars of Functions and Duties I. 1) Functions of the Board:- To provide welfare measures to the registered Building and Other Construction Workers, such as a) Provide immediate assistance to a beneficiary in case of accident; b) Make payment of pension to the beneficiaries who have completed the age of sixty years; c) Sanction loans and advances to a beneficiary for construction of a house not exceeding such amount and on such terms and conditions as may be prescribed; d) Pay such amount in connection with premia for Group Insurance Scheme of the beneficiaries as it may deem fit; e) Give such financial assistance for the education of children of the beneficiaries as may be prescribed; f) Meet such medical expenses for treatment of major ailment of a beneficiary or, such dependant, as may be prescribed; g) Make payment of maternity benefit to the female beneficiaries; and h) Make provision and improvement of such other welfare measures and facilities as may be prescribed. 2) 3) PJ/RTI To monitor the inflow of Cess collection from the employers. To register building and other construction workers as beneficiaries and provide them with identity cards. 4) 5) 6) PJ/RTI To tie up with as Insurance Company and provide registered workers with Health Insurance Schemes and other schemes in general. To provide training programmes to building and other construction workers in order to impart special skills in them and also to upgrade the skills they already possess. To provide educational facilities to the children of registered construction workers and also impart training to these children in Job Oriented Course. Section-4[1] [b] [ii] Powers and Duties Of Officers & Employees 1) Labour Commissioner cum Chief Executive Officer:_The Secretary of the Board shall be an officer not below the rank of Additional Labour Commissioner or an I.A.S. Officer in the Senior Scale or an officer from the Central Services Group-A Senior Scale. i. He is the functional head of the Board, and shall exercise such powers and duties and shall monitor the work relating to the General Administration and Accounts of the Board, as per the delegation of power. ii. He shall exercise such powers and duties as prescribed under the Building and Other Construction Workers [Regulation of Employment and Conditions of Service] Act 1996, & Karnataka Rules 2006 and also Building and Other Construction Workers Welfare Cess Act 1996 & Central Rules 1998. 2) Joint Labour Commissioner and Joint Secretary: Joint Secretary of Board shall be an officer not below the rank of Deputy Labour Commissioner, drawn on deputation from the Department of Labour. Joint Secretary is responsible for the general administration of the Board, Maintenance of accounts work of the Board and also responsible to oversee implementation of the relevant provisions of the Building and Other Construction Workers [Regulation of Employment and Conditions of Service] Act, 1996 and overall implementation of the Building and Other Construction Workers Welfare Cess Act, 1996. 3) DeputyLabour Commissioner and Deputy Secretary:Deputy Secretary of Board shall be an officer not below the rank of DeputyLabour Commissioner drawn of deputation from the Department of Labour. PJ/RTI 4) Assistant Secretary and Assistant Labour Commissioner: Assistant Secretary of Board shall be an officer not below the rank of Assistant Labour Commissioner drawn on deputation from the Department of Labour. Assistant Secretary is responsible for the work relating to i] identification and registration of workers as beneficiaries. ii] Cessation and restoration of membership, iii] Examination of the proposals sent by the registering officers for extending various benefits under the schemes and matters relating to grant of benefits to beneficiaries. iv] Issuance of identification cards to the beneficiaries and all other relevant matters. 5) Labour Officer-1: Labour Officer-1 shall be an officer not below the rank of Labour Officer who belongs to Group B drawn on deputation from the Department of Labour. i. His basic duty is to assist the Deputy Secretary in matters of maintenance of accounts and administration work of the Board and the implementation of the provision of the Building and Other Construction Workers [Regulation of Employment and Conditions of Service] Act 1996, & Karnataka Rules 2006 and also Building and Other Construction Workers Welfare Cess Act 1996 & Central Rules 1998. Ii] Besides he is required to attend to other works allocated to the Development/Accounts/Administration section. 6) Labour Officer-2: Labour Officer-2 shall be an officer not below the rank of Labour Officer who belongs to Group B drawn on deputation from the Department of Labour. i. This Officer’s main job is to assist the Assistant Secretary. ii. Opening of Tappalcheques and documentation of the same and pass on to Accounts Section for remittance. PJ/RTI 7) Accounts Officer: This official is drawn on deputation from the Department of State Accounts. i. The official has to attend to all the accounts work and supervise and monitor the work of the officials in the accounts section and is also required to attend independent compilation work as entrusted. 8) FDA/Executives: These personnel are taken from an Out Source Agency. He/She has to receive the concerned tappals, enter in the register and building up a file and submit the file to the concerned Officer. 9) Junior Executives: This person is taken from an outsourced agency. He/She has to receive the concerned tappals, enter in the register and build up a file and submit the file to the concerned Officer. 10) Computer Operator: This person is taken from an outsourced agency. He/She shall be required to supervise the work of data entry operators. 11) Data Entry Operators: These personnel are taken from an Out Source Agency. They are generally employed for the work of data entry. They shall generate reports with regard to Cess, Beneficiaries and so on. PJ/RTI Section-4[1] [b] [iii] Procedure followed in the decision making process including channels of supervision and accountability 1) Executive/Junior Executive: They receive the tappalsfrom concerned tappal case worker and maintain the files as per the provisions under the ‘Hand Book of Office Procedure’ they attend the letters. Either by putting up an existing file or by opening a new file. Later these files with relevant notings are submitted to the concerned officer. 2) Labour Officer 1&2: They have to attend the file, ensure its correctness, both with regard to the notings and drafting. They have to check the file-whether the notings are in accordance with the statutes and ensure its correctness and submit the file to the functional head of the section. 3) Deputy Secretary/Assistant Secretary : The functional heads of the section shall examine the correctness of the drafting in relation to the relevant rule of Law, Government Orders, Notifications and so on dispose of the same, if possible at his/her level or if required submit to the Joint Secretary. Joint Secretary: Decides the issue by taking appropriate decision on the file and returns the file to the concerned sections through the functional heads. PJ/RTI Building and Other Construction Workers’ Welfare Board has been constituted under the Building and Other Construction Workers’ [Regulation of Employment and Conditions of Service] Act, 1996 and Karnataka Rules 2006. The Board mainly implements the provisions stipulated under chapter-IV and V of the said enactment. The Board also enforces the provisions of The Building and Other Construction Workers’ Welfare Cess Act, 1996 and Central Rules 1998. For the enforcement of Building and Other Construction Workers’ [Regulation of Employment and Conditions of Service] Act, 1996 and Karnataka Rules 2006, the officers of the Department of Labour have been notified as Inspectors- Labour Commissioner has been notified as Chief Inspector and Additional Labour Commissioners, Joint Labour Commissioners, Deputy Labour Commissioners, Assistant Labour Commissioners and Labour Officers have been notified as Inspectors. Decentralization of work respect to work sanction of beneficiaries schemes. Labour Officers have been notified as Registering Officers in relation to Registration and Establishments. If any person is aggrieved with the revocation of registration of the establishments, he may appeal with the Assistant Labour Commissioners who have been notified as appellate authorities. Under the Building and Other Construction Workers’ Welfare Cess Act, 1996 and Central Rules 1998, Senior Labour Inspectors and Labour Inspectors have been notified as Cess collectors. Further Labour Officer have been notified as Cess Assessing Authorities as far as assessment of cess is concerned. If any person is aggrieved with the assessment order of the Labour Officers or by an order imposing penalty with regard to non-payment of cess, he/she may prefer an appeal with the Deputy Labour Commissioners who have been notified as appellate authorities. Section 4 [1] [b] [v] Rules, Regulations, Instructions, Manuals and Records held or under control or used by employees for discharging functions Building and Other Construction Workers’ Welfare Board functions according to the service manuals, financial code and relevant Government Orders, Notifications etc., Apart from this Building and Other Construction Workers’ [Regulation of Employment and Conditions of Service] Act, 1996 and Karnataka Rules 2006 and Building and Other Construction Workers’ Welfare Cess Act, 1996 and Central Rules 1998 are being administered by the Board.
