9th STREET SAFETY IMPROVEMENT PROJECT
FEDERAL PROJECT NO. HSIP5449 (025), PROJECT NO. STR11002
This project involves pavement widening and slurry seal along 9th Street between Del Rosa Drive and Palm Avenue, including loop detector replacement,
in-roadway warning lights, flashing beacon, signing and striping. Project is located within the City of Highland, in the County of San Bernardino, California.
A pre-bid conference will be held on Thursday, October 9, 2014 at 10:00 am at the City of Highland, City Hall, 27215 Base Line, Highland, California 92346.
This meeting is to inform bidders of project requirements and subcontractors of subcontracting and material supply opportunities. Bidder attendance is
recommended.
Pursuant to Federal law, the City of Highland is implementing new Disadvantaged Business Enterprise (DBE) requirements to include all DBEs. The DBE
requirements are covered in the Specifications in Section 2, “Proposal Requirements and Conditions”: subsection 2-1.02, “Disadvantaged Business Enterprises
(DBE)”; and in Section 5, “General”: subsection 5-1.5, “Performance of DBEs”.
The DBE contract goal for this project is 9%.
This project is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code Section 12990. The City of Highland
affirms that in any contract entered into pursuant to this advertisement, DBEs will be afforded full opportunity to submit bids in response to this invitation.
No bid will be considered unless it is made on a proposal form furnished by the City Engineer. All proposals or bids shall be accompanied by cash or a check
payable to the City of Highland, certified by a responsible bank, for an amount which shall not be less than ten percent (10%) of the grand total bid or by a
bond for the amount over and above all statutory exemptions, or by a bond of an accredited surety company. The check or bond will be declared forfeited if
the successful bidder refuses to enter into a contract within ten calendar days following receipt of the contract from the City.
Bidders are advised that this project is funded with Federal Highway Administration funds. The requirements of the Davis-Bacon Act will apply to this project
and those requirements will be enforced. The prime contractor and all subcontractors are required to pay their laborers and mechanics employed under this
contract, a wage not less than the minimum wage for the work classification as specified in both the Federal and State wage decisions when the prime contract
amount exceeds $2,000. The higher of the two applicable wage classifications, either State prevailing wage or Davis-Bacon Federal prevailing wage, will
be enforced for all work under this contract. The prime contractor is responsible for ensuring subcontractor compliance with Davis-Bacon and Related Acts
Requirements. The Federal Labor Standards Provisions (HUD 4010) apply to this project. Bidders are required to complete and submit federal forms with
their proposal.
In accordance with the provisions of Sections 1770 and 1773 of the California Labor Code, the Director of the Department of Industrial Relations has ascertained
the general prevailing rates of per diem wages in the locality in which the work is to be performed. A schedule of prevailing wage rates as published by the
California Department of Industrial relations for the types of work to be done is provided with these specifications, is available at City Hall, and is also available
at the Department of Industrial Relations web site (www.dir.ca.gov). Federal Prevailing wages are available at www.frwebgate.access.gpo.gov/cg. The
Contractor and all subcontractors shall pay not less than these rates. The Contractor shall weekly submit certified payroll records of all workers employed
on this project.
Bidders are advised that, as required by federal law, the State has established a statewide overall DBE goal. This city federal-aid contract is considered to
be part of the statewide overall DBE goal. The City is required to report to Caltrans on DBE participation for all Federal-aid contracts each year so that
attainment efforts may be evaluated. To provide assistance in meeting the statewide goal, the City has established a DBE goal of Nine (9) percent for this
project. Bidders need to achieve the goal or demonstrate an adequate good faith effort.
PREVAILING WAGE REQUIREMENTS: Pursuant to California Labor Code Sections 1770, 1773, 1773.1, 1773.6 and 1773.7, as amended, the applicable
prevailing wages for this project have been determined. It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor
under him to pay not less than the higher of the Federal and the State prevailing wage rates to all workers employed by them in the execution of the contract.
The applicable Federal prevailing wage rates are those that are in effect ten (10) calendar days prior to bid opening; they are set forth on the U.S. Department
of Labor website: http://www.wdol.gov/wdol.scafiles/davisbacon/ca33.dvb but are not printed in the Specifications. Lower State wage rates for work classifications
not specifically listed in the Federal wage decision are not acceptable. The applicable State prevailing wage rates are set forth on the California Department
of Industrial relations website; http://www.dir.ca.gov/DLSR/PWD but are not printed in the Specifications; these rates are subject to predetermined increases.
The U.S. Department of Transportation (DOT) provides a toll-free hotline service to report bid rigging, bidder collusion, or other fraudulent activities. The
hotline is available Mondays through Fridays between 8:00 a.m. and 5:00 p.m. eastern time, at 800-424-9071. The hotline is part of the DOT’s continuing
effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information
will be treated confidentially, and caller anonymity will be respected.
Conflict of Interest: in the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions in 24 CFR 85.36,
OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the selection, award, or
administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved.
This project is subject to the “Buy America” provisions of the Surface Transportation Assistance Act of 1982 as amended by the Intermodal Surface Transportation
Efficiency Act of 1991.
The successful bidder will be required to furnish a labor and materials bond and a faithful performance bond in the amount equal to one hundred percent
(100%) of the contract price, such bonds to be secured by a surety company or surety companies satisfactory to the City Council of the City of Highland.
For any monies earned by the Contractor and withheld be the City of Highland to ensure the performance of the contract, the Contractor may, at his request
and expense, substitute securities equivalent to the amount withheld in the form and manner an subject to the conditions provided in Sections 10263 and
22300 of the California Public Contract code.
The successful bidder must possess a Class A Contractor’s license(s) at the time of award of this contract.

Genesee Avenue crosses I-5 at mile 29.5 in southwestern San Diego County, approximately 1.4 miles
south of the I-805/I-5 Interchange. The proposed replacement of Genesee Avenue OC is a result of
the planned widening of Genesee Avenue and I-5 as a part of the improvements related to the
broader I-5 North Coast corridor Project. The first stage of construction will consist of building a
2-span bridge, approximately 78 feet wide and 343 feet long, adjacent to and north of the existing
structure. The second stage of construction will begin once traffic on Genesee Avenue is transferred
from the existing bridge to the stage 1 (north) replacement bridge. The original Genesee Avenue
OC will then be demolished, and the stage 2 (south) replacement bridge will be constructed.

Assistance in obtaining bonding, lines of credit, insurance, equipment, supplies and materials is available
upon request. Flatiron/Papich, a Joint Venture analyzes and considers each DBE quote, including those
that are broken down into economically feasible units to facilitate bidding. Quotations must be valid
for same duration as specified by Owner for contract award. Bond Requirements: Notwithstanding
any contrary language in a bid to Flatiron/Papich, a Joint Venture. (”Flatiron/Papich”) or any prior
course of dealing between Flatiron/Papich and a bidder, and unless waived in writing by Flatiron/Papich,
Flatiron/Papich reserve the right, pursuant to Public Contract Code Section 4108 and otherwise, to
require each bidder to provide payment and performance bonds assuring bidder’s obligations to
Flatiron/Papich in the amount of 100 percent of the bid to Flatiron/Papich. Flatiron/Papich will
reimburse the bond premium at actual cost not to exceed 3%. The surety on the bonds must be a
California admitted surety.
