open and public meeting on
Monday, August 4, 2014 in the
Commissioners Meeting Room,
Cheyenne County Court House,
1000 10th Avenue, Sidney,
Nebraska. A notice of this
meeting was published in the
Sidney Sun-Telegraph, aired on
KSID Radio, posted on the bulletin board in the County Court
House and on the Cheyenne
County website. Copies of the
agenda were posted on the
Court House bulletin board
and on the Cheyenne County
website, transmitted to each
Commissioner and kept current
and available to the public at the
County Clerk’s Office. Chairman
Harold G. Winkelman called the
meeting to order at 8:00 A.M.,
with the following present:

Procurement Procedures and
Code of Conduct with reference
to the Community Development
Block Grant for Adams Industries,
Inc. A motion was made by
McMillen, seconded by Olson
to approve the Procurement
Procedures and Code of Conduct
as reviewed. Roll Call: Aye:
McMillen, Winkelman, Olson.

The Board considered the
request from the County
Veterans Service Committee to
appoint Bill Suit as a member of
the Veterans Service Committee
to fill the unexpired term of
Richard B. Wright. The Board
received a letter from Richard
B. Wright resigning his position
as a Board member effective
July 28, 2014. The Board also
reviewed a letter from Ronald
L. Gusman, Veterans Service
Officer, requesting that Bill Suit
be appointed as a member to
the Cheyenne County Veterans
Service Committee to fill the
unexpired term of Richard B.
Wright. The term will begin July
28, 2014 and end on June 30,
2015. A motion was made by
McMillen, seconded by Olson to
accept the resignation of Richard
B. Wright as a member of the
Veterans Service Committee
and to approve the appointment
of Bill Suit to fill the unexpired
term of Richard B. Wright with
his term to begin July 28, 2014
and end on June 30, 2015. Roll
Call: Aye: Winkelman, Olson,
McMillen. Nay: None.
The Board reviewed a
Manager Application for Change
of Manager at The Sip LLC. A
motion was made by Olson, seconded by McMillen to approve
the Application for Change of
Manager at The Sip LLC, subject
to the results of the background
investigation by the Nebraska
State Patrol. Roll Call: Aye:
Olson, McMillen, Winkelman.
Nay: None.
Randy Meininger presented the annual report on the
Ambulance Service. Present
for this discussion were Herb
Stevens and Ray Woten.
Comments were heard.
County Treasurer Diane Scott
reported on the issuance of
County Tax Sale Certificates on
2011 taxes. A motion was made
by Olson, seconded by McMillen
to adopt Resolution 2014-25
directing the Cheyenne County
Treasurer to issue County
Tax Sale Certificates on 2011
taxes. Roll Call: Aye: McMillen,
Winkelman, Olson. Nay: None. A
complete copy of the Resolution
as adopted is on file at the
Office of the County Clerk.
Next,
Treasurer
Scott
requested approval to turn over
the Tax Sale Certificate to the
County Attorney for foreclosure on Lot 4, Block 41, First
Addition to Sidney, Nebraska.
A motionwas made by Olson,
seconded by McMillen to adopt
Resolution 2014-26 authorizing
the County Treasurer to turn
over the above-described Tax
Sale Certificate to the Cheyenne
County Attorney for foreclosure.

Highway
Superintendent
Tom
Noel
addressed
the
Board regarding an Interlocal
Agreement with the City of
Sidney for road maintenance
on County Roads 115 and 20.
County Attorney Paul Schaub
and City Manager Gary Person
were present. After a discussion, the Board directed County
Attorney Schaub to research
this matter and report back to
the Board.
Highway
Superintendent
Noel then updated the Board on
road activities.
At 11:00 A.M., the County
Board meeting was moved to
the Cheyenne County District
Courtroom, 1000 10th Avenue,
Sidney, Nebraska, to accommodate attendees of the public hearing on the proposal
of Cheyenne County to issue
health care facilities revenue
bonds in the principal amount of
up to $32,000,000.00. Present
were Chairman Winkelman,
Vice-Chairman McMillen and
Commissioner Olson. Also present were County Clerk Beth
E. Fiegenschuh and County
Attorney Paul B. Schaub.
Appearing via telephone was

Wismer,
Cheyenne
County Bond Counsel.
The Chairman announced
that the purpose of this portion
of the meeting was to hold a
public hearing on the proposal by
the County of Cheyenne, in the
State of Nebraska (the“Issuer”)
to
issue
not
exceeding
$32,000,000 aggregate principal amount of its bonds or notes
(the “Bonds”) and lend the proceeds of the sale of the Bonds
to Cheyenne County Hospital
Association, Inc., d/b/a Sidney
Regional Medical Center (the
“Hospital”) pursuant to the provisions of Nebraska Industrial
Development Act, Neb. Rev.
Stat. Sections 13-1101 et seq.,
as amended (the “Act”), to provide for the financing a portion of the costs of acquiring,
constructing, equipping and
furnishing an approximately
132,000 square foot replacement hospital and medical clinic
for the Hospital, including ancillary parking areas, landscaping and associated site work,
buildings and other improvements (the “Project”), and, as
applicable, funding debt service
reserve funds, capitalized interest, and paying costs of issuance
associated with the Bonds. All
property to be financed through
the issuance of the Bonds will
be owned and operated by the
Hospital and will be located at
1000 Pole Creek Crossing, in
the City of Sidney, Nebraska.
Loan payments are to be made
by the Hospital sufficient to pay
principal of, premium, if any,
and interest on such Bonds as
the same fall due. As provided
in the act, the bonds are limited obligations of the County,
secured by a pledge of revenues
of the Hospital and other security given by the Hospital, and
shall not constitute or give rise
to a pecuniary liability of the
County or a charge against its
general credit or taxing powers. The bonds will not constitute a general obligation of the
County, and the County shall
not be liable thereon out of any
taxes or any funds or properties other than those revenues
and assets of the Hospital to be
pledged for such purposes. The
purpose of the public hearing
and related public approval by
the Board of Commissioners of
the Issuer issuing such Bonds
is limited to compliance with
the public approval requirements of Section 147(f) of the
Internal Revenue Code of 1986,
as amended.
The Chairman then asked if
there was any person or persons present to express views
for or against the proposal by
the Issuer to issue such Bonds,
notice of said hearing havingbeen published as required by
law. Oral objections or other
comments were made by Jason
Petik, CEO of Sidney Regional
Medical Center; Amber Presley
from Baird Holm, Bond Counsel
for Sidney Regional Medical
Center; and Sandra Robnett.
The Chairman then declared
that the public hearing closed at
11:15 A.M.
A motion was made by
McMillen, seconded by Olson
to adopt Resolution 2014-27 as
above set out solely for the purpose of complying and in accordance with the public approvalrequirements of Section 147(f)
of the Code. Roll Call: Aye:
Olson, McMillen, Winkelman.

the Resolution as adopted is on
file at the Office of the County
Clerk.
There were no comments
from the public.
There being no further business to come before the Board,
Chairman Winkelman declared
the meeting adjourned at 11:20

Initiative Measure 425
A vote “FOR” will amend the
Nebraska statute establishing a minimum wage rate
for employees to increase
the current state minimum
wage from seven dollars and
twenty-ve cents ($7.25) per
hour to eight dollars ($8.00)
per hour on January 1, 2015,
and to nine dollars ($9.00)
per hour on January 1, 2016.
(2) For persons compensated by way of gratuities such as waitresses,
waiters, hotel bellhops,
porters, and shoeshine
persons, the employer
shall pay wages at the
minimum rate of two dollars and thirteen cents
per hour, plus all gratuities given to them for
services rendered. The
sum of wages and gratuities received by each
person compensated by
way of gratuities shall
equal or exceed the minimum wage rate provided
in subsection (1) of this
section. In determining
whether or not the individual is compensated
by way of gratuities, the
burden of proof shall be
upon the employer.
A vote “AGAINST” will not
cause the Nebraska statute establishing a minimum
wage rate for employees to
be amended in such manner.
