Deposit Account Disclosure for Personal Accounts
This notice is to inform you of changes to the Deposit Account Disclosure for
Personal Accounts (“Disclosure”), which will become effective on December 1,
2014. The Disclosure is relative to any and all personal checking, savings, money
market savings, IRA or certificate of deposit accounts you maintain with Bank of the
West.
The amended and restated Disclosure, together with the applicable Schedule of
Fees and Charges, current Rate Sheet, your signature card and any other addenda
that may be provided to you with reference to your deposit account(s), form the
agreement between you and the Bank.
We encourage you to read the entire amended and restated Disclosure carefully,
as the terms and conditions replace any previous versions of the Disclosure that
you have received prior to December 1, 2014, and certain of these changes may
impact your legal rights. You indicate that you accept the changes in the amended
and restated Disclosure by continuing your account relationship with us or, if the
changes affect your certificate of deposit, by allowing the certificate of deposit to
renew after the changes become effective.
Please note that the amended and restated Disclosure contains a dispute
resolution provision providing for mandatory arbitration in the event of a dispute
arising out of your account(s) or the Disclosure. Under this provision, you waive
your rights to try any claim in court before a judge or jury and to bring or participate
in any class or other representative action.
In order to comply with regulatory rules, we highlight the following change in terms
applicable to Wisconsin residents as of December 1, 2014. Due to a change in
state law, Wisconsin residents no longer have unique rules on liability for
unauthorized use of an ATM or Debit Card. Purchases and withdrawals made with
a Bank of the West ATM or Debit Card will be subject to the consumer liability
dollar limitations set forth in the first two paragraphs under the “Consumer Liability”
section on page 33 of the amended and restated Disclosure. Also, please be
aware that MasterCard® Zero Liability policy still applies.

This schedule applies to personal accounts opened in Wyoming. This
Schedule, along with the Deposit Account Disclosure for Personal Accounts,
current rate sheet, your current signature card, and any other addenda that
may be provided to you at account opening or from time to time thereafter form
the agreement between you and Bank of the West as to your checking, money
market, savings, certificates of deposit, and retirement accounts (collectively,
the “Agreement”). The Bank reserves the right to add to, delete from,
discontinue, or otherwise amend any product, service, fee or charge, package
or program offering at any time with such notice as is required by law. To the
extent that any of the terms or provisions of this Schedule of Fees and
Charges conflict with those contained in any other document in the Agreement,
the terms and provisions contained herein shall control.

*Occurrence: (Solely for the purposes of overdrafts and returned item fees) An
Occurrence is each day in which your account does not have sufficient available
funds to cover the items presented for payment regardless of whether or not you
are charged an Overdraft or Returned Item fee for the item. For example, if you
have three (3) items presented for payment in a single day for which there are
insufficient funds to cover these items, that is considered to be one (1)
“Occurrence”. However, you may be charged for each of the three items. An
Overdraft and/or Returned Item fee is based on the number of Overdraft and

Savings account can be linked to a checking account. The standard interest rate plus the Relationship Premium interest rate equals the Relationship Interest Rate; the standard interest rate plus the Premier Relationship Premium interest rate equals
the Premier Relationship Interest Rate. The Relationship Premium and Premier Relationship Premium interest rates are set at the Bank’s discretion and are subject to change without notice. There may not be a Relationship Premium or Premier
Relationship Premium associated with every balance tier.
4 To automatically qualify for a Relationship Interest Rate, you must have an open Bank of the West consumer checking account and a Choice Money Market Savings account with the same ownership; to automatically qualify for a Premier
Relationship Interest Rate, you must have an open Signature Checking account and a Choice Money Market Savings account with the same ownership. The Relationship Interest Rate or Premier Relationship Interest Rate will be earned on your
Choice Money Market Savings account, and is calculated as follows: On the last day of your statement cycle, your Choice Money Market Savings account’s end-of-day collected balance tier will be determined. If the Bank is paying a Relationship or
Premier Relationship Premium for that balance tier, that Premium will be added to the standard interest rate for the balance tier into which your daily end-of-day collected balance falls each day during the next full statement cycle. The Relationship or
Premier Relationship Premium will be applied beginning the first business day of the statement cycle. Once set, the Relationship or Premier Relationship Premium will not change during that statement cycle. The standard interest rate can change as
frequently as daily. Interest is compounded daily and paid to your Choice Money Market Savings account on the last day of the statement cycle. If you do not qualify for a Relationship or Premier Relationship Premium as of the last day of any
statement cycle, your account will earn only the standard interest rate during the next full statement cycle.
5 To qualify for a Relationship CD interest rate, you must have a Signature Checking account. Relationship CD interest rates are available on select CD products only and are subject to change or discontinuance at account renewal. If you do not
have an open Signature Checking account when the CD renews, you may receive the standard rate for the new term.
6 If you have an open, active Signature Checking account, you are eligible for a second Signature Checking account with no monthly service charge. The ownership on both accounts must be identical. The second Signature Checking does not
provide a relationship pricing benefit to a Choice Money Market Savings account.

Addendum to the Deposit Account Disclosure for Personal Accounts (All States1)
Effective April 11, 2014
The following information reflects a change to your current applicable Deposit Account Disclosure for Personal Accounts (“Booklet”). This addendum, together with the applicable Schedule of Fees and
Charges for Personal Accounts, the Booklet, current Rate Sheet, your Signature Card and any other addenda that may have been provided to you with reference to your deposit account(s) at account
opening or subsequently, form the agreement between you and the Bank. Except as expressly stated below, all other terms and conditions in our agreement with you continue in full force and effect. We
reserve the right to amend or discontinue any product offering at any time. Fees and charges are also subject to change.

Standard Overdraft Practices
The “Standard Overdraft practices” section in the Booklet has been replaced, in its entirety, with clarifying changes identified in bold, as follows:
We may choose, at our discretion, to assist you with an unplanned or occasional overdraft, to pay checks, ACH, recurring debit card transactions, and other items drawn on your account and charge
an Overdraft Fee when your account does not have sufficient funds to cover these items. Whether we will pay a particular item is decided by the bank, at our sole discretion, by evaluating a number of
factors relating to your account. Generally, we will not authorize and pay overdrafts for ATM transactions and everyday debit card transactions, unless you have authorized us to do so (Refer to Debit
Card Overdraft Services below).
If you do not want us to pay checks, ACH, or recurring debit card transactions when doing so will overdraw your account, please contact your local branch or call our Contact Center at
800-488-2265 and request to opt out of our Standard Overdraft Practice. Your choice to opt out will become effective within two (2) business days of your request. Even if we do not pay an item,
you will incur a Returned Item Fee if an item is returned for insufficient funds. (There still may be times when an item is paid, an overdraft occurs, and an Overdraft Fee is charged.)
The dishonoring of a check, ACH, recurring debit card transaction and other items drawn on your account could result in additional fees or other consequences imposed under your agreement with the
payee or by law.
We offer Overdraft Protection programs, such as Gold Line (line of credit) and Savings Overdraft Protection, which may be less expensive than our standard overdraft practices. Refer to
the Schedule of Fees and Charges for the applicable fees for these programs.
We disclose on your periodic bank statement the total amount of Overdraft and Returned item fees you incurred per statement period and year-to-date. You can help avoid returned item
and overdraft fees by maintaining a record of your deposits and withdrawals by check, recurring payments and debit card and ATM transactions.
Debit Card Overdraft Services
The Bank may not charge an Overdraft Fee to your checking or money market account for paying ATM or everyday debit card transactions against insufficient available funds unless you
have signed up for our Debit Card Overdraft Service.
The Debit Card Overdraft Service is a service whereby the Bank may, at our discretion, authorize and pay ATM and everyday debit card transactions against insufficient available funds. Signing up for
Debit Card Overdraft Service does not guarantee that the Bank will pay any ATM or everyday debit card transaction, when your account has insufficient available funds. If you sign up for Debit Card
Overdraft Service, an Overdraft Fee will be imposed when the Bank pays overdrafts on ATM transactions and everyday debit card transactions. You have the right to cancel your Debit Card Overdraft
Service at any time. When you sign up for or cancel Debit Card Overdraft Service, your choice will become effective within two (2) business days of your taking action. You will receive a notice
confirming your choice. The Bank reserves the right to amend or terminate Debit Card Overdraft Service or your participation in Debit Card Overdraft Service without notice at any time. Additionally, there
may be certain instances where checking accounts are not eligible for Debit Card Overdraft Service.

Special Rules for New Accounts
The following paragraphs amend the “Special Rules for New Accounts” section in the Booklet in its entirety:
If you are a new customer, the following special rules will apply during the first thirty (30) days your new account is open.
Funds from electronic deposits and wire transfers to your account will be available on the day we receive the deposit. Funds from deposits of cash, and the first $5,000 of a day’s total deposit of
cashier’s, certified, teller’s, travelers, and Federal, State, and local government checks will be available on the first business day after the day of your deposit, if the deposit meets certain conditions. For
example, the checks must be payable to you. The excess over $5,000 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury
check) is not made in person to one of our employees, the first $5,000 will not be available until the second business day after the day of your deposit.
Funds from all other check deposits will be available on the ninth business day after the day of deposit.

Withdrawals; Early Withdrawal Penalties
The “Withdrawals; Early Withdrawal Penalties” section in the Booklet has been replaced, in its entirety, with changes identified in bold, as follows:
Interest which has been reinvested may be withdrawn without penalty at any time, if the account term and interest rate have not changed since the reinvestment.
Additional withdrawals without penalty are permitted at maturity for automatically renewable certificates of deposit, during the ten (10) calendar day grace period (one [1] calendar day grace period for 731-day terms), upon a depositor’s death or mental incapacity, or for IRA account holders who are totally disabled or over 59. Withdrawals at any other time may be permitted at the Bank’s discretion and
may be subject to interest penalties. Accounts closed during the grace period will forfeit any interest that accrued during the grace period.
The penalty assessed may reduce the balance remaining on your account after the withdrawal. For terms of 7-31 days and 60 months+, the penalty is calculated at the interest rate in effect on the
account at the time of the withdrawal. The penalties on the amount withdrawn are:

ATM and Debit Card Services – General Information
The third paragraph in the “ATM and Debit Card Services - General Information” section in the Booklet has been replaced in its entirety, with changes identified in bold, as follows:
When you use your Debit Card for POS purchases, you are making a withdrawal from your primary checking account. You must follow the procedures used by the merchant or financial institution for
using your Debit Card or ATM Card. You may be asked to sign a sales slip or other document, or only to provide your account number. Some merchants may assess a fee for this type of transaction.
We are not liable if a merchant or financial institution refuses to accept your Debit Card, ATM Card or Card number. Bank of the West will deduct the amount of your transaction, including any charge
imposed by the merchant or financial institution, from the primary checking account that you designate for this service. When we give authorization to a merchant, we will reserve or place a hold on
funds in your account, generally for three (3) business days, to pay for your purchase. However, for some types of purchases we may place a hold for a longer period. Merchants such
as, but not limited to, car rental companies and hotels may request approval from us for an estimated amount of your purchases since the merchant doesn’t always know the exact amount
of your purchase when they request an authorization. If you do not ultimately use your Debit Card to pay for your purchases or if the actual amount of purchases posted to your account
varies from the estimated amount authorized by us, it is the responsibility of the merchant, not us, to cancel the prior authorization based on the estimated amount. The failure of the
merchant to cancel a prior authorization may result in a temporary reduction of your account balance. And if the authorization is for an amount higher or lower than the actual purchase
amount, the hold may remain on your account even after the actual purchase is paid from your account. The actual purchase amount will be paid from your account whenever the
merchant sends it to us, even if that is after the hold has expired.

Check Cashing Fee – Bank of the West Check
The “General Information about Deposit Accounts” section in the Booklet has been amended to add the following:
A per check fee will be charged to Basic Savings-only account holders and non-customers (a non-customer is a person or entity that does not have a Bank of the West deposit account, except minors)
who cash a check drawn on Bank of the West for more than $50 at one of our branches. No fee will be charged for cashing Bank of the West cashier’s checks or Bank of the West checks drawn on any
State government or on the Federal Government.

Checking, Money Market and Savings Accounts
The “Checking, Money Market and Savings Accounts” section in the Booklet has been amended to add the following:
Gold Line
If you have a Gold Line as overdraft protection for your personal checking account and one (1) or more items are presented for payment against your linked checking account, if funds in
your Gold Line are insufficient to cover any one (1) of the items plus the Loan Advance Fee, no Gold Line transfer will occur.
If one (1) or more items are presented against your checking account and there are enough funds in your Gold Line account to cover one or more of the items plus the Loan Advance Fee,
we will transfer enough to cover as many of the items as possible plus the Loan Advance Fee, up to the remaining amount available in your Gold Line account.
Auto-Save
Auto-Save allows you to increase your savings by having a fixed amount of money regularly transferred from your linked checking account to your Classic Savings Account or Choice Money Market
Savings Account. Linked accounts must have the same ownership. If you make a single monthly transfer of $25 or more, you won’t have to pay the monthly service charge for a Classic Savings
account. If you make a single monthly transfer of $75 or more, you won’t have to pay the monthly service charge for a Choice Money Market Savings account. You can set up the Auto-Save feature at
account opening, or at any time through Online Banking at bankofthewest.com, by calling us at 1-800-488-2265, or by visiting your local branch. If there are not sufficient funds in your checking account
to complete a scheduled transfer, such as an Auto-Save, to your savings or money market account, no transfer will occur, even if you have available overdraft protection for your checking account
through Savings Overdraft Protection and/or Gold Line. This means that if your savings or money market account monthly service charge would have been waived as a result of an eligible Auto-Save or
recurring transfer from your checking account, you may incur a monthly service charge for that statement cycle.
Savings Overdraft Protection
The “Savings Overdraft Protection” section in the Booklet is amended in its entirety:
For our personal checking accounts, we offer optional Savings Overdraft Protection which links your Bank of the West personal savings or money market account to your personal checking account to
help protect your checking account from unplanned or occasional overdrafts. The owner(s) of the checking account must be the same as the owner(s) of the savings or money market account.
If there are not sufficient funds in your checking account to cover the amount of items presented for payment, we will automatically transfer funds from the available balance in your linked savings or
money market account to your checking account. We transfer funds in increments of $50 up to the amount of the overdraft, including any Transfer Fee, up to the amount of the available balance in your
linked savings or money market account. The total of all $50 increments is considered one transfer and we charge a Savings Overdraft Protection Transfer Fee per transfer each day that a transfer
occurs. If your savings or money market account does not have a balance of $50, but there are sufficient funds to cover the overdraft amount and the Transfer Fee, then the entire savings or money
market balance will be transferred into the checking account. If one (1) or more items are presented against your checking account and there are enough funds in your linked savings or money market
account to cover one (1) or more of the items plus the Savings Overdraft Protection Transfer Fee, we will transfer enough to cover as many of the items as possible plus the Transfer Fee, up to the
remaining amount in your savings or money market account.
If you have Savings Overdraft Protection and a transfer occurs to a linked checking account that is overdrawn $5 or less, no Savings Overdraft Protection Transfer Fee will be assessed.
Each transfer counts as one (1) of the six (6) limited transactions you are allowed each calendar month from your savings or statement cycle from your money market account. For a savings account, if
you have already used the six (6) allotted transactions during any calendar month, the overdraft transfer will not occur. For a money market account, if you have already used the six (6) allotted
transactions during any statement cycle, the overdraft transfer may occur and you will be charged the Excess Withdrawal Fee in addition to the Overdraft Protection Transfer Fee.
Funds you deposit into your savings or money market account may not be available immediately for Overdraft Protection.
Savings Overdraft Protection does not cover ATM and everyday debit card transactions as they post to your account throughout the day. Savings Overdraft Protection only covers transactions that post
during nightly batch. Accordingly, if you attempt to make an ATM or everyday debit card transaction against insufficient funds and have not signed up for Debit Card Overdraft Service (See Debit Card
Overdraft Services information), then the transaction will be declined even if you have Savings Overdraft Protection and there are available funds to transfer from your savings or money market account
to cover the transaction.
