The goal of the workshop is to
provide attendees with information that will help them work
more effectively in PIAA companies. This workshop is recommended for corporate attorneys,
legal staff, and company physician leaders who want to stay on
top of the legal issues that impact
MPL insurers.

What to Do When the Government
Knocks on Your Door?

Many companies have been subject to potentially alarming “visits” from a representative
from a federal or state agency (i.e., U.S. Immigrations and Customs Enforcement, FBI, etc.).
This program will provide tips on how to prepare for this event, and will provide practical
details on how to avoid particular compliance
pitfalls. Recently, government agencies have
stepped up the pace of investigations in many
areas (EEOC, wage and hour laws, and immigration, among others). The best way to be
prepared for that “knock on the door” is to do
the necessary preparation work ahead of time.
Attendees will develop insight into how to respond when a government agent appears at
the door and how to train staff to react to government inquires calmly, and in a manner that
will not put the company in legal jeopardy.

More than one MPL carrier or other insurer
may become involved in a lawsuit. The big issues are cooperation, the rights and obligations
of the various parties and insurers, and the
overall strategy. This session will discuss several
scenarios for collaboration among MPL and
other insurance companies. One example: an
insured has both first-dollar coverage from a
hospital and private coverage for an MPL claim
(i.e., both are primary coverage). Another example: a “hybrid” claim from a patient injured
during an office visit; the loss could be MPL or
general liability/slip and fall. Participants will
gain insight into how to work with “other” insurers on a claim, including excess insurers,
risk retention groups, captives, and self-insureds, as well as the best approaches for collaborating with other MPL insurers when
appropriate.

that basis, address any shortcomings in their

World and What Worries Them

What current issues are most troubling to reinsurers? Is there anything dire enough to keep

an in-depth look at the answers to these questions, and, more generally, learn about the outlook for the MPL reinsurance market. They

will explore the new reinsurance products and
coverages now on the market, and discuss
whether MPL companies should be learning

the conclusion of this session, participants will

emerging trend? Is severity in big MPL awards
really changing? Attendees will find out what
their companies can do to identify and head
off these verdicts, instead of capitulating and
writing a big check every time. They will learn
what these cases have in common, and how to
spot one up front, before the jury returns a verdict. Participants also find out the particular
steps your company can take to mitigate the
risk of a mega-verdict risk. Perhaps reinsurance isn’t the only answer. Learn about the
other alternatives. At the conclusion of this
session, participants will have gained important insights into the challenges associated
with mega-verdicts. They will know what steps
they can take to recognize claims that may be
linked with this risk and how to reduce it.
They will also be armed with new strategies
for dealing effectively with the exposure to
