TOWN OF MONROE PLANNING BOARD REQUEST FOR PROPOSAL PLANNING BOARD ATTORNEY RFP# PB2014-1 NOTICE IS HEREBY GIVEN that the Town of Monroe Planning Board is seeking proposals for PLANNING BOARD ATTORNEY/LEGAL SERVICES. Proposals to RFP#2014-1 will be received at the office of the Town Clerk, Town Hall, 101 Mine Road, Monroe, NY. All proposals must in a sealed envelope with the number of the RFP noted in the bottom right corner, and must be received by 12:00 p.m. (noon) on Wednesday, November 5, 2014. All envelopes will be opened at 1:00 p.m, or as soon as practicable thereafter, by the Town Clerk or her designee. The Planning Board of the Town of Monroe, reserves the right to reject any or all proposals, and to waive any formal defect or technical defect therein. Any applicant may withdraw their proposal prior to the specified time for public opening. SCOPE OF SERVICES REQUESTED The Planning Board of the Town of Monroe is seeking the services of an attorney to provide legal services for the Planning Board as provided by law, including but not limited to: 1. Planning Board Services: Provide legal support services to the Planning Board of the Town of Monroe. The selected consulting Attorney will provide written legal opinions and answer inquires relating to site plan, subdivision plan, land improvement plans, land disturbance plans, and construction plans (collectively all “development plans”), projects proposed by applicants to be developed in the Town of Monroe, NY. Additional legal support will be required for lot line changes which may or may not result in subdivision plans. 2. Meeting Attendance and Participation: The selected Attorney will be expected to attend all Planning Board workshops and regular meetings (currently meetings are held on the first and second Tuesdays of the month), and other meetings as may be periodically requested, at which time the Attorney shall be prepared to respond to questions on matters before the Planning Board. 3. Prepare, or assist in the preparation of easements, including by not limited to drainage easements, water easements, and conservation easements. Assist in the review of road maintenance agreements. 4. Oversee and assist in the formation of any deed transferring ownership of any parcels or lots to the Town of Monroe, by means of fee-simple or other appropriate determined device as deemed by the Planning Board. 5. Review all documents associated with formation of a Home Owners Association (HOA). 7. Advise on the meaning and application of the Town Code of Monroe, NY, or of any State or Federal laws as they apply to zoning/planning. 8. The consulting Attorney may be requested to meet directly with the Planning Board Engineer, developers and property owners to discuss proposed projects. 9. The Attorney will be expected to review, as may be submitted each month, plans, reports and other materials submitted to the Planning Board related to any legal issues in a timely manner, without unreasonable delays, identify additional information required from the applicant, and recommend courses of action, as required. 10. The Attorney will be expected to issue written legal opinions to the Planning Board as needed. 11. Prepare resolutions as required. 12. Generally maintain knowledge and legal skills necessary to maintain proficiency in all matters relating to the Planning Board. MINIMUM ELEMENTS TO BE INCLUDED IN PROPOSAL TO RFP# PB2014-1 1. Name and address of firm, including any branch offices. Supply corresponding telephone numbers, FAX numbers, and email address. 2. Brief narrative about the history of the firm. 3. A description of clerical and support Staff. 4. Supply name of specific attorney who will be assigned to the Planning Board of the Town of Monroe. 5. Detailed resume of the attorney proposed to work directly with the Town of Monroe Planning Board including a description of the attorney’s education, experience, qualifications, number of years with the firm. List any experience in regards to representing other municipalities or public entities. 6. Outline your fees proposed, fee schedule, or other basis for compensation. Indicate hourly rates, monthly or other retainers, per project fees, or such other manner of compensation you deem appropriate to the services to be provided. 7. References – 3 references required, 2 of which must have direct knowledge of your representation of a municipal or public entity. 8. Copy of your New York Business Registration Certificate. 9. Disclose any potential conflicts of interest in representing the Town. 10. Identify all municipal entities that you currently represent. 11. October 23, 2014 Press release to local newspapers to be sent. November 5, 2014 Deadline for receiving replies to RFP# PB2014-1 is 12:00 (noon). The Town Clerk, or her designee, will open all submittals. After all submittal are opened, Kate Troiano, Secretary to the Planning Board, will be given all proposals in order to make copies and distribute them to all Town of Monroe Planning Board members at the November 5th Planning Board meeting. November 6 – 30, 2014 Planning Board members will make their recommendations after having read the submittals. The top 3 applicants will be contacted and interviews set up. Interviews will be held in accordance with the Open Meetings Law. December 2, 2014 Planning Board to announce its determination. 3 of 3
