Introduction
This introduction is not part of the Transitional Facility Standard, but is intended to indicate its general effect.
Purpose
This Standard states the requirements for the approval, aspects of maintenance and operation of Transitional
Facilities and the approval of Transitional Facility Operators.
Background
The Biosecurity Act 1993 (the Act) prescribes requirements for the exclusion, eradication and effective
management of pests and unwanted organisms in New Zealand. These organisms have the potential to
cause harm to natural and physical resources and human health in New Zealand. As such, any imported risk
goods must receive biosecurity clearance before they can officially enter New Zealand. As a part of this
process uncleared risk goods must go to a Transitional Facility upon arrival, and be held there until clearance
is obtained. Transitional Facilities hold uncleared risk goods for inspection, secure storage or treatment until
they receive biosecurity clearance or are re-shipped or destroyed.
Under section 39(3) of the Act, the Director-General of MPI may approve a place as a Transitional Facility.
Under section 40(3) of the Act, the Director-General may approve a person as an Operator of a Transitional
Facility. This document sets out the minimum requirements for maintaining and operating Transitional
Facilities, and describes the process for approval of a Transitional Facility and Transitional Facility Operator.
Scope
This Standard includes the minimum requirements for general Transitional Facilities dealing with:











live animals for holding and inspecting at approved Places of First Arrival
plant fibre;
risk goods requiring holding, sampling or inspection at the border;
seed for sowing;
stock feed meals;
stored plant products including seeds for consumption or processing;
uncleared risk goods at deconsolidation businesses;
uncleared risk goods in transit to other Transitional Facilities or for re-export;
uncleared risk goods/material for analysis/testing (for example, sand, soil or water);
wood or forestry products including sawn timber; and
wood packaging.
and the minimum requirements for general Transitional Facilities dealing with the specialist importation of, or
the management of:







animal products including hides, meat, skins and fibres;
biological products (inspection of packaging and holding only);
decontamination of biosecurity material;
fresh produce and nursery stock inspection;
fumigation and other official treatment at Transitional Facilities for quarantine purposes;
holding and inspection of live animals at approved Places of First Arrival;
holding, disposal and/or processing of quarantine refuse;

 inanimate material in containers (for example, machinery and parts including: agricultural
equipment, aircraft, car parts, forestry equipment, inanimate risk material, scrap metal, tyres, and
used vehicles);
 incineration and sterilisation Transitional Facilities;
 international mail inspection;
 personal effects inspection; and
 sea containers.
The scope of this Transitional Facilities Standard does not include the minimum requirements that must be
met for the operation and management of Transitional Facilities used for the destruction, holding, inspection,
quarantine, storage, or treatment of animals requiring higher levels of biosecurity, or for plants and plant
products requiring higher levels of biosecurity1, or for the destruction, inspection, processing or treatment, of
biological products2 (holding of biological products is covered under this Standard, see Annex G of the
Guidance Document for more details).
Who should read this Transitional Facility Standard?
This Standard applies to those who operate or wish to operate a general Transitional Facility for uncleared
risk goods.
Why is this Important?
If a Transitional Facility is operated other than in accordance with this Standard, it may result in the approval
for a general Transitional Facility or Transitional Facility Operator being suspended or terminated.
Other Information
Further information on management of a Transitional Facility is contained in the Guidance Document that
accompanies this Standard. The Guidance Document outlines processes that meet the required level of
biosecurity practice that a Transitional Facility and Transitional Facility Operator should follow, and provides
examples of how this Standard can be met.
Further guidance on how best to manage specialised Transitional Facility are contained in the annexes to the
Guidance Document. The outcomes required by this Standard must be met or exceeded, using either the
examples provided in the Guidance Document or approved equivalent measures.
It is expected that Transitional Facility Operator will also meet the requirements of local governing bodies and
any other relevant legislation, such as the Resource Management Act 1991, and any requirements of a
relevant Import Health Standard.

Part 1: Requirements for the Approval of Transitional
Facilities and Transitional Facility Operators
1.1 Incorporation of Material by Reference
(1)
The Guidance Document for the Facility Standard for General Transitional Facilities for Uncleared
Goods (Guidance document for MPI-STD-TFGEN)
1.2 Approval of a Transitional Facility
1.2.1 General Provisions and Requirements
(1)
Transitional Facilities must be approved in accordance with section 39(3) of the Act. Transitional
Facilities must have an approved Transitional Facility Operator and be constructed and operated in
accordance with this Standard, as well as any additional requirements specified in:
a)

a relevant IHS;
a relevant permit to import;
any notification from a Chief Technical Officer (CTO) relevant to a specific risk good.
Any person wishing to have a place approved as a Transitional Facility should follow the procedure
outlined in the Guidance Document that accompanies this Standard.
1.2.2 Changes to a Transitional Facility
A Transitional Facility is approved for specific purposes and activities related to the risk goods included in the
scope of the Transitional Facility Operating Manual. Any changes or modifications to these must be approved
by an MPI Inspector. Depending on the extent of change, a new approval may be required. For more
information on changes to Transitional Facilities refer to the Guidance document for MPI-STD-TFGEN.
1.2.3 Leased Transitional Facilities
Any lease agreements must not interfere with a Transitional Facility Operator’s ability to meet the
requirements of this Standard. If a Transitional Facility, or part of a Transitional Facility is leased, the lease
contract (or non-gratia arrangement) with the owner must clearly identify the business and the operational
arrangements contracted with the owner for meeting the requirements of the Standard. For more information
on lease agreements refer to the Guidance document for MPI-STD-TFGEN.
1.3 Approval of a Transitional Facility Operator
1.3.1 General Provisions and Requirements
(1)
A Transitional Facility Operator is a person, normally an individual, but may be the Crown, a
corporation sole, or a body of persons (corporate or unincorporated). If the Transitional Facility
Operator is the Crown, corporation, sole, or a body of persons, then an individual must be nominated
who has delegated and written authority for the resourcing and operation of the Transitional Facility.
This individual will nominally be the Transitional Facility Operator.
(2)
The Transitional Facility Operator is responsible for ensuring that:

the Transitional Facility is used for the purpose specified in the Transitional Facility Operating
Manual;

resources are in place for maintaining and managing the Transitional Facility, and;
the requirements of the Transitional Facility Operating Manual and any Quality Management
System can be met.
(3)
A Transitional Facility Operator will be approved by the Director-General in accordance with section
40(6) of the Act, if the Director-General is satisfied that the applicant is a fit and proper person to
operate the Transitional Facility, has the authority to resource and operate the Transitional Facility and
has the technical and financial resources in place to maintain and manage that Transitional Facility.
(4)
Any person wishing to be approved as an Operator of a Transitional Facility should follow the
procedure outlined in the Guidance document for MPI-STD-TFGEN.
1.3.2 Deputy Transitional Facility Operators
The Transitional Facility Operator may nominate individuals to be Deputy Transitional Facility Operators. A
Deputy Transitional Facility Operator must be appointed for a Transitional Facility where the Transitional
Facility Operator responsible for that Transitional Facility is located at a separate site. A Deputy Transitional
Facility Operator must have the authority to act as a second Transitional Facility Operator, nominally when the
Transitional Facility Operator is absent. To gain approval as a Deputy Transitional Facility Operator,
applicants must undertake the same training as Transitional Facility Operators. A Deputy Transitional Facility
Operator may also be required where it is the opinion of an MPI Inspector that a Deputy Transitional Facility
Operator is needed due to the complexities and particular operating factors of a Transitional Facility.
1.3.3 Transitional Facility Operator Training
Transitional Facility Operators and Deputy Transitional Facility Operators must successfully complete the
Transitional Facility Operator training course prior to receiving approval. Refresher training must be
undertaken every four years in order to maintain approval. Details of this training are available from an MPI
Inspector and on the MPI website.
1.3.4 Changes to Transitional Facility Operator
The MPI Inspector must be notified of any proposed changes to the Transitional Facility Operator or Deputy
Transitional Facility Operator(s). Prospective new Transitional Facility Operators must complete an application
according to the requirements in this Standard. It is illegal for a Transitional Facility to operate without an
approved Transitional Facility Operator.
1.4 Cancellation of approval of a Transitional Facility or Transitional
Facility Operator
(1)
Approval for a Transitional Facility may be cancelled in accordance with section 39 of the Act if the
Transitional Facility no longer complies with any of the requirements of this Standard; or the DirectorGeneral is satisfied that the Transitional Facility is no longer used for the purpose(s) specified in the
Transitional Facility Operating Manual. Notice of cancellation will be given in writing.
(2)
A Transitional Facility Operator’s approval may be cancelled in accordance with section 40 of the Act,
if the Director-General is satisfied that the Transitional Facility Operator is no longer operating the
Transitional Facility according to this Standard, has ceased to act as Transitional Facility Operator of
the Transitional Facility, or is no longer a fit and proper person to operate the Transitional Facility.
Before an approval for a Transitional Facility or Transitional Facility Operator is cancelled, the
Transitional Facility Operator will be given a reasonable opportunity to provide comments to MPI.
Notice of cancellation will be given in writing.
(3)
Where approval of a Transitional Facility is no longer required for any reason, the Transitional Facility
Operator must contact an MPI Inspector who will ensure that all biosecurity risks are dealt with before
Transitional Facility closure.

1.5 Personal Information on Individuals
In accordance with Principle 3 of the Privacy Act 1993, all information collected on applicants, identifying, or
capable of identifying, an individual person is personal information. The information is collected for purposes
relating to the approval of a Transitional Facility under section 39 of the Biosecurity Act 1993 and approval as
a Transitional Facility Operator under section 40 of the Biosecurity Act 1993. The recipient of this information,
which is also the agency that will collect and hold the information, is MPI. Failure to provide this information
will result in the Director-General declining an application for approval of a Transitional Facility or Transitional
Facility Operator. An individual has the right of access to, and correction of, any personal information that has
been provided.

Part 2: Requirements for Operating a Transitional Facility
2.1 Transitional Facility Operating Manual
A Transitional Facility Operating Manual must be prepared for each Transitional Facility. This Transitional
Facility Operating Manual must be approved before a Transitional Facility can be approved. The approval of
the Transitional Facility will be limited to the purpose and scope of activities listed in the Transitional Facility
Operating Manual. A current hard copy of the Transitional Facility Operating Manual must be readily
accessible to staff members and an MPI Inspector at all times. If a Transitional Facility Operator intends to
change the operations to activities outside the approved scope of the Transitional Facility Operating Manual,
an MPI Inspector must be informed as a revised Transitional Facility Operating Manual or new approval may
be required. For information on what a Transitional Facility Operating Manual should contain, refer to the
Guidance document for MPI-STD-TFGEN.
2.2 Transitional Facility Location
Transitional Facilities must be located in areas that can provide services and systems to ensure that the
biosecurity of uncleared risk goods is maintained and that adequate provision can be made for the
management of contingencies in the event of an incident or containment breach (for example, access to
public sewer and mains power). For more information on Transitional Facility location, refer to the Guidance
document for MPI-STD-TFGEN.
2.3 Receipt and Transfer of Uncleared Risk Goods
(1)
Uncleared risk goods must be managed in such a way that the biosecurity risks arising from the
uncleared risk goods are eliminated or minimised. They must be unloaded within the Transitional
Facility building or defined area. The Transitional Facility Operator is responsible for all uncleared risk
goods upon arrival at the Transitional Facility and must have authority from MPI to receive, transfer to
another Transitional Facility, or re-ship risk goods from New Zealand. The Transitional Facility may
only receive risk goods within the scope of their approval.
(2)
Where risk goods arrive without correct MPI documentation, the MPI Inspector must be notified
immediately, and the risk goods held securely until authority from MPI is received as to further actions
that must be taken.
(3)
Any transfer of uncleared risk goods must be in a secure and contained manner to prevent spillage or
contamination of the transporting vehicle, other cargo or the environment. If spillage or contamination
occurs during transport, the transporting vehicle or container must be cleaned and contamination and
waste must be disposed of as specified by an MPI Inspector. The Transitional Facility Operator must
report any spillage or leakage of uncleared risk goods likely to constitute a biosecurity risk to an MPI
Inspector as soon as possible. For more information on the management of uncleared risk goods refer

2.4 Internet Access
Transitional Facility Operators are encouraged to have access to an on-line computer and Transitional Facility
Operators should ensure that staff members are familiar with electronic communication. For more information
on internet access refer to the Guidance document for MPI-STD-TFGEN.

2.5 Transitional Facility Access and Security of Uncleared Risk
Goods
(1)
A Transitional Facility must have a system of controlling access to ensure the security of uncleared risk
goods. Only persons permitted by the Transitional Facility Operator are allowed in the Transitional
Facility while uncleared risk goods are present. Visitors must adhere to access procedures and where
possible be accompanied by a staff member while in the Transitional Facility. The instructions of the
Transitional Facility Operator or an MPI Inspector must be followed at all times. The Transitional
Facility Operator must provide access to the Transitional Facility for an MPI Inspector at any
reasonable time.
(2)
Prior to inspection, uncleared risk goods must not be moved from the Transitional Facility and must
remain secure and intact (parts or items may not be removed) unless authorisation is obtained from an
MPI Inspector. Uncleared risk goods must be held in such a manner that organisms (for example,
insects) cannot escape from the Transitional Facility and that other goods will not become
contaminated.
(3)
The Transitional Facility must use a system for tracking uncleared risk goods in and out of the
Transitional Facility that can be audited by an MPI Inspector. For more information on Transitional
Facility access and security of risk goods, refer to the Guidance document for MPI-STD-TFGEN.
2.6 Segregation of Uncleared Risk Goods
(1)
Uncleared risk goods must be effectively segregated from all other goods to prevent possible cross
contamination. The Transitional Facility Operating Manual must stipulate how this will be achieved,
monitored and maintained, and must be based on the likely risks posed by the uncleared risk goods.
Cleared goods or other goods that become contaminated or are suspected of being contaminated from
contact with uncleared risk goods must be regarded as a biosecurity risk and must be handled in the
same manner as uncleared risk goods. For more information on segregation of uncleared risk goods
refer to the Guidance document for MPI-STD-TFGEN.
(2)
When a Transitional Facility is not being used for the purpose of the approval it may be used for other
purposes between consignments. This must not compromise the ability to meet the requirements of
this Standard when the Transitional Facility is being used for the approved purpose.
2.7 Record Keeping
The Transitional Facility Operator must implement and maintain an effective record keeping system that
allows easy access to records for relevant staff members and the MPI Inspector. Records must be legible,
readily identifiable, and must be kept for a minimum of seven years from receipt, preparation or amendment.

2.8 Hygiene Requirements
Transitional Facilities must have a hygiene system in place that ensures they are managed at all times. The
Transitional Facility Operating Manual must specify hygiene procedures that will be used in the Transitional
Facility to achieve this. Hygiene requirements must take into account prevention of accumulation of debris and
waste, prevention of possible refuge areas for pests and the disposal of used dunnage, packaging, sweepings
or any other waste that might pose a biosecurity risk. For more information on hygiene requirements, refer to

2.9 Pests, Vermin and Weed Control
(1)
Transitional Facility Operators must ensure that pests, vermin and weeds are effectively controlled.
The Transitional Facility Operating Manual must describe the process that will be undertaken. Live
animals and plants that are not part of a consignment being imported into New Zealand are not
permitted in the Transitional Facility when uncleared risk goods are present.
(2)
It is every person’s duty to inform MPI as soon as practicable of the presence of any organism (such
as live pests) not normally seen or otherwise detected in New Zealand, in accordance with Section 44
of the Act.
2.10 Internal Assessment of Transitional Facility Activities
(1)
The Transitional Facility Operator must carry out regular self assessments of the Transitional Facility
activities to verify that activities continue to follow the procedures outlined in the Transitional Facility
Operating Manual. This must occur at a minimum once per year. Depending on the types of risk goods
being imported a higher frequency of self assessments may be required. The Transitional Facility
Operating Manual itself must also be reviewed on an annual basis by the Transitional Facility Operator
to ensure its continuing suitability and effectiveness and to introduce any necessary changes or
improvements. Any changes must first be approved by an MPI Inspector.
(2)
All self assessment and review findings and any corrective actions that arise from them must be
documented.
(3)

2.11 Inspection and Treatment of Identified Biosecurity Risks
If biosecurity risks are identified or suspected in uncleared risk goods, the risk goods must be destroyed or reshipped or treated as directed by an MPI Inspector. Goods directed for treatment must either be securely
transported to a Transitional Facility approved to provide treatments, or treated on site at the importing
Transitional Facility by an MPI approved treatment provider (a list of approved treatment suppliers can be
online).
2.12 Signage
A Transitional Facility must have a prominent sign or signs identifying the area as a Transitional Facility under
the Act. Signs must warn that entry is restricted to permitted persons only. For an example of a sign refer to
the Guidance document for MPI-STD-TFGEN. Signs are not permitted to display the MPI logo or the
acronyms ‘MPI’ as per the Flags, Emblems, and Names Protection Act 1981.
2.13 Inspection of Uncleared Rick Goods at Transitional Facilities
Pursuant to the risk goods being imported, an area or room must be identified for MPI Inspectors to use when
inspecting risk goods. This area must be approved by MPI prior to first use and be identified in the Transitional
Facility Operating Manual site map. This area must be of a sufficient size to enable the inspections to be
conducted effectively and safely and have the ability to contain any associated biosecurity risk. The area must
not be subjected to extreme temperatures, and must be adequately lit and ventilated. The Transitional Facility
must provide any fit for purpose equipment (for example, inspection benches, and microscopes), storage or
labour as required by an MPI Inspector to help with inspections. The inspection area must have the same
segregation requirements as an uncleared risk goods holding area. For more information on Inspection at

2.14 Contingency Plans
The Transitional Facility Operator must ensure that contingency plans are in place to manage all identified
biosecurity risks associated with the Transitional Facility including possible breaches of security (for example;
essential equipment malfunction or loss of electrical power or arrival on non-compliant animals). These
contingency plans must be included in the Transitional Facility Operating Manual.
2.15 Staff Training
(1)
Transitional Facility Operators must nominate a person or position responsible for training of staff
members. The Transitional Facility Operating Manual must describe how the training programme is
implemented, and the time scales for implementation and refresher courses.
(2)
Training must be available to new and existing staff members. Documents of training records for all
staff members must be held for MPI Inspection at the time of MPI audit.
2.16 Systems of Equivalence
Where a Transitional Facility Operator develops a customised system that meets the level of compliance
required by this Standard, they may, on verification and approval by MPI, include such a system in their
Transitional Facility Operating Manual as a ‘system of equivalence’.
2.17 External MPI Assessment
(1)
Transitional Facilities are assessed by an MPI Inspector to ensure the requirements specified in this
Standard are met.
(2)
Where a Transitional Facility is not compliant with this Standard, the MPI Inspector may recommend
that approval for that Transitional Facility and Transitional Facility Operator is cancelled. Where noncompliances are found but cancellation is not initially recommended, audit frequencies will increase
until the MPI Inspector is confident the Transitional Facility is compliant. Conversely, MPI may grant
audit dispensation to Transitional Facilities that are continually performing well in audits and are not
incurring non-compliances. A system for this is outlined in the Guidance document for MPI-STDTFGEN.
(3)
The Transitional Facility Operator must provide MPI Inspectors access to the Transitional Facility,
records and documents for inspection and audit to confirm compliance with this Standard or to
investigate non-compliances in accordance with the Act. The Transitional Facility Operator or Deputy
Transitional Facility Operator must be present to assist and ensure that all relevant procedures and
records are made available. MPI reserves the right to audit at any time and audits may be
unscheduled. Should a Transitional Facility Operator and/ or Deputy Transitional Facility Operator
display a lack of sufficient knowledge leading to failure of an audit, an MPI Inspector may require the
Transitional Facility Operator or Deputy Transitional Facility Operator to re-take the relevant training
course.
(4)
Under section 122 of the Act, Inspectors have the power to give directions regarding Transitional

2.18 Accredited Persons for Sea Container Transitional Facilities
Transitional Facilities approved for receiving and/ or unpacking sea containers must have MPI approved
Accredited Persons present upon delivery and unpacking of a container. The Accredited Person must have
undertaken the MPI approved Accredited Persons training course within the past two years and be registered
as a current Accredited Person by MPI. Re-training must be undertaken every two years for the first four years
(two sets of training) and after that time the training period is extended to being required once every four
years. This training period is subject to change under consultation. Further information is contained in the
Guidance document for MPI-STD-TFGEN, in Annex A for Transitional Facilities for sea containers.
2.19 Costs
The applicant is required to pay for all costs associated with an application for approval of a Transitional
Facility and Transitional Facility Operator including a processing fee, and for time spent reviewing the
application (including the Transitional Facility Operating Manual) by MPI. Transitional Facility Operators are
also required to pay any subsequent costs associated with the ongoing approval of the Transitional Facility or
Transitional Facility Operator, such as for audits (this includes an MPI Inspectors time and travel). Fees will be
charged according to the current Biosecurity Cost Regulations.
