Believe me, I do share in your frustrations. I must apologise in that I did
not realise that the correspondences below were of an informal nature while I can understand most written Swedish, my grasp of the subtleties is
quite weak, so unfortunately I missed this. I hope we can continue work
together to find a solution that we can all agree on. I'm sure you can
understand our need to have solid solutions in place so that we and future
owners of the apartment are not put in the same position that we are in
now.
For the record, a couple of additional points regarding the smoking.
1) I'm not sure there needs to be a fresh decision on the smoking ban on
the roof as one already exists - due to the points detailed in my previous
mail (the existing sign + our face to face meeting with Jan).
2) There is a large "rökning förbud" sign on the entrance to the roof that
people still ignore, so any softening of this will in theory make the
problem worse. Given that they are ignoring this sign and littering the
ground with cigarette butts etc, I would suggest these people are selfish
by nature. So, if given the option, they would not care about any
inconvenience to us and continue to please themselves, At least now I have
the right to lean out of the window and tell them they are not allowed to
blow smoke into our bedroom's and living room.
3) I think a key point/principal in all of this is that the smoker's do
have a number of choices of where to go - they can go to the street, stay
in their own apartment, etc where it doesn't pollute other private
environments, but we do not have this luxury - we are stuck with smelling
their smoke.
4) I was outside cleaning up the terrace this evening - I didn't go all the
way to the other side as people were sitting eating their dinner and I
didn't wish to disturb them by sweeping under the window - but attached is
a picture of the cigarette butts I collected from the immediate vicinity of
our windows which illustrates the scale of smoking we have outside of our
apartment

Det börjar kännas långdraget och rörigt det här.
Du vänder dig ibland till mig för en informell diskussion och ibland till
styrelsen genom mig för att få formella svar.
Jag kan naturligtvis inte svara å styrelsens vägnar utan att först ha ett
möte med denna.
Eftersom du nu har anlagt en så pass formell ton i vissa av dina frågor så
föreslår jag att du istället ställer dessa direkt till styrelsen.
Vårt nästa möte är den 22 september.
Vad det gäller ”rökning förbjuden” eller ”rökning undanbedes” håller jag på
att utreda om detta kan bestämmas av styrelsen eller om det är en fråga för
medlemmarna på en medlemsstämma.
Om det är ett beslut som styrelsen kan ta så håller jag med dig och Jenny.
Beträffande den skylt som redan sitter uppe så känner jag för närvarande
inte till hur den kommit dit eller hur detta har beslutats.

To take each point in turn:
1) The Sign/smoking on the roof: There seems to be some crossed wires
here
as the roof has always been no smoking, so to make smoking allowed
represents a significant step back for us. This is the case because
a) Ever since we have lived here, there has been a no smoking sign up
that people have been ignoring (see attached photo)
b) When I came to meet you and Jan face to face in April this year,
it was made clear that smoking was under no circumstances allowed.
c) It is clear from the email correspondence (see attached) between
you and Jenny that there is not an issue with having no smoking on
the roof
- the only point in our suggested sign that you mention is the word
"absolut" due due definition problems. This points strongly to the
fact
that we are on the same page regarding no smoking on the roof.
When people smoke on the roof we smell smoke in our apartment which
cannot
be acceptable. I'm sure that you can agree that, besides being
unpleasant,
the effects of passive smoking are well documented and it makes me
extremely uncomfortable when I come into my children's room at night
and it
smells of cigarette smoke. I look out of the window the next morning
and
there are new cigarette butts on the ground, so it is clear where the
smell
of smoke is coming from. The position is exacerbated in summer when
we need
to have the windows open due to the temperature.
Would it be possible for you to use the initially suggested wording
on the
signs (with minor modifications to be agreed as promised)?
2) Mess on the roof: Thankyou for taking this forward with EM and I
will
start clearing up this week
3) Selling a part of the roof terrace: please may you be so kind as
to get
a final answer/certainty on this so we know where we stand?
4) Payment for plants: Is it possible for the board to take a
decision on
this?
5) The board fulfilling it's duties to prevent us being disturbed:
I'm not
sure that you have answered my statement here: "does the board
consider
that the solutions suggested adequetly fulfills their responsibility
that the solutions suggested adequetly fulfills their responsibility
to
prevent us from being disturbed"
Sorry to push you on the answers for these, but we really need to
have
absolute clarity on the key points for our own peace of mind but also
so
any future owners can know all the facts when they buy. I look
forward to
your response and thanks once again for you help in this matter.

Det kommer upp en ny skylt om en vecka senast. Det blir inte
"rökning
förbjuden” utan en vädjan om att undvika rökning. Ida i styrelsen
tar
fram ett förslag som jag ska godkänna.
Jag ska ta upp ogräset med Einar Mattson. Du får väldigt gärna
städa
själv.
Om terassytor/tak sålts av tidigare styrelse utan att det föregåtts
av
ett stämmobeslut (vilket jag inte är säker på) så är det min
uppfattning
att det gjorts på ett regelvidrigt sätt och att det inte kan göras
igen.
Styrelsen har inte fattat något beslut om att betala för växterna
utan
erbjuder er istället att själva införskaffa sådana, med viss risk
för
att ett framtida styrelsebeslut från en annan styrelse kan göra att
ni
får avlägsna växterna igen.
Ja, detta är ett sätt för styrelsen att hantera era upplevda
problem med
störningar från medlemmar som vistas på terassen.

Following on from our conversation last Tuesday I have the following
points:
1) The signs that we agreed are still not up (no smoking/please be
considerate to our children etc) - do you know when these will be in
place?
In terms of where the should be put up, it is important that they are
on
the last door before you access the roof on both sides so they can't
be
missed. In addition, I think it would help to have a further "no
smoking"
sign on the black railings at the front of the roof as this is where
people
congregate to smoke. I hope it is possible to arrange these ASAP. If
you
would like me to produce and laminate the agreed wording and stick
them up,
I would be more than happy to do so to speed up the process, just let
me
know in this respect
2) The roof is currently quite overgrown - is it possible for someone
to
come and clear away the weeds growing between the cracks? A company
came to
do it 2 summers ago but nothing since. There is a lot of litter on
the roof
(cigarettes, cigarette packets, Beer cans, drink cups etc) and I'm
happy to
clear that if it's OK with you.
3) To document our conversation regarding the roofs that have already
been
sold and to ensure a common understanding, these were sold by mistake
by a
previous board and as such do not represent a binding precedent that
this
board has to follow. Thus we are not able to follow that precedent to
purchase an area of the roof directly outside our window - please
correct
me if I have misunderstood this
4) With respect to positioning of the plants outside our window to
provide
protection against intrusion/invasion of privacy - the board will not
pay
for these nor can they provide any guarantees that future boards will
grant
positioning of such plants. Furthermore this is considered by the
board as
adequately discharging their duties to protect us from
disturbance/threat
of disturbance - please correct me if I have misunderstood this

Hej Jan,
Vi har inte hört av er sedan vårt senaste mail, men det kan ju bero
på
semestertider.
Vi vill bara säga att även vi är på semester, men en vän passar vår
lägenhet. Hon sa att det har stått ett par ute på terassen och att
det
luktar cigarettrök nästan hela tiden.
Om lappen är uppe så verkar den inte räcka. Kan även behövas en ute
på
terassen då vissa använder sina fönster för att ta sig ut.
Har nu varit hos en bostadsrättsjurist eftersom vi inte är så insatta
i
den balken. De sa att det är styrelsens ansvar att se till att vi
inte blir
störda och eftersom det varit störningar och att någon kan komma och
banka
på rutan igen så bör åtgärder tas. Om det diskuteras fram ett
insynsskydd
så ska styrelsen stå för det.
När det gäller att vi köper loss ytan utanför som vissa har gjort så
ska
samma gälla för oss om inte ett stämmobeslut tagits att sådan
försäljning
ej ska ske efter senaste godkännandet.
Sist men inte minst så tog vi upp det att vi köpt lägenheten som om
att
det inte var en uteplats för alla utan endast om man köpte biten
utanför
sitt fönster. Och att tidigare ägare menat att det inte är en
uteplats och
innan dess var det kontor/lokaler. Juristen sa då att föreningen inte
bara
kan ändra syftet med en yta utan att tillfråga de boende runt
omkring. Och
att efter tidigare rättsfall så har det varit så att om boendes
privatliv
inkräktas på så har antingen föreningen nekats att ändra eller om
skadan
redan skett så har de fått betala den estimerade värdeminskningen på
lägenheten.
Vi hoppas på en smidig lösning och är tacksamma för samtalen som nu
är
igång och har gått till jurist för rådgivning för att skynda på en
seg
process där vi tror att båda parter varit utan juridisk kompetens i
bostadsrättsbalken. Vi har stått för kostnaden själva.
