A tenancy is a legally binding contract. It is therefore important that all tenants who enter the contract understand the terms and conditions. These terms and conditions are contained in New Charter’s Tenancy Agreements. As an existing tenant, you will already be familiar with your Tenancy Agreement. However, people who you wish to create a joint tenancy with should also familiarise themselves with these terms and conditions before they apply. A joint tenancy can be a tenancy between two and four joint tenants. So, if you are currently a sole tenant you can apply to have a joint tenancy with up to three other people. It is important to remember that each tenant is jointly and severally liable for the tenancy. This is a legal term which means that you are collectively and individually responsible. For example, each tenant is responsible for all the rent. A breach of tenancy by one is the responsibility of all the tenants. Ending of the tenancy by one ends the tenancy for all the tenants. No. As a New Charter tenant you must first end your existing tenancy by giving 4 weeks notice to quit in writing. On expiry of the 4 weeks notice, we can then create a new tenancy. However, creating any new tenancy is subject to the written consent of New Charter. Will I keep my preserved right to buy if I am granted a new joint tenancy? If you are applying for a joint tenancy with someone other than your partner, you will only be entitled to Housing Benefit on your share of the rent. In these circumstances, each joint tenant who wishes to apply for Housing Benefit will need to complete their own individual application form. Partners who are not recognised as couples under Housing Benefit regulations will be affected in the same way. Before you decide to apply for a joint tenancy, you can contact the Housing Benefit Section of Tameside Council to find out how your Housing Benefit claim may be affected. You can do this by telephoning 0161 342 3709. There are many reasons why existing tenants want to create joint tenancies with other people. We recognise that these reasons will be personal to each individual. However, if you are considering applying for a joint tenancy for the following reasons you may want to think again. I want to provide security for a member of my family. I am worried about what will happen to them if I die. New Charter offers extensive succession rights if you die. Section 10 of your Tenancy Agreement outlines these rights in more detail. However, if you need further information about succession and how it personally affects you and your family, please contact your local Neighbourhood Management Officer. I intend to exercise my preserved right to buy, and to do so my partner needs to be a joint tenant. This is not correct. You may share the preserved right to buy with up to three members of your family (including partners and spouses) who are not themselves tenants, subject to certain requirements. Yes. However, as a tenant you do not have any legal right to change your tenancy in this way. You will need the Landlord’s written consent under New Charter’s policy on creating joint tenancies with existing tenants. If you are thinking of applying to create a joint tenancy with someone else, then you need to consider the following: 1. Joint tenancies can only be created between an existing tenant and members of their family as follows: The tenant’s spouse or civil partner, providing they occupy the property as their only or principal home and can provide a copy of their marriage or civil partnership certificate. The tenant’s partner (including non-heterosexual relationships), providing they occupy the property as their only or principal home and can provide evidence that they have been living with the tenant for the last 12 months. Any other member of the tenant’s family (for example, son, mother, aunt or nephew), providing they occupy the property as their only or principal home and can provide evidence that they have been living with the tenant for the last 12 months. 99053 nc joint tenant text_99053 nc joint tenant text 08/08/2011 3:48 PM Page 6 2. If you are in rent arrears or have other outstanding debts to New Charter, we may refuse your application. Before a decision is made, we will consider your individual debt under our Debt Policy and Anti-Poverty Strategy. 3. If you are in breach of any of your existing tenancy conditions, any application to create a joint tenancy will be refused. However, you can reapply once the breach is put right to our satisfaction. 4. If there is a history of relationship breakdown between you and the person(s) you wish to create a joint tenancy with, we may refuse your application. 5. We will refuse your application if you are overcrowding the property. 6. We will refuse your application if you are under-occupying the property by more than one bedroom. 7. If your current property is classed as “suitable for elderly residents only”, and the person(s) you wish to create a joint tenancy with does not meet the necessary age criteria, we will refuse your application. 99053 nc joint tenant text_99053 nc joint tenant text 08/08/2011 3:48 PM Page 7 8. Everyone who applies for a joint tenancy must be aged 18 or over. New Charter will consider applications from minors aged 16 or 17 providing it can be independently proven the joint tenancy is necessary for the minor. 9. If the person(s) you wish to create a joint tenancy with does not qualify for accommodation under our Allocations Policy, we will refuse your application. 10.If the person(s) you wish to create a joint tenancy with is not a U.K. resident and does not meet the habitual residence test requirements, your application will be refused.
