interest. She remarried and became Mary

asset or having any entitlement to payment
from their sale. Her estate identified the
heirs being her four adult children: Wallace
A. Bean (deceased), Wesley S. Bean, G.A.
Bean, and Dan W. Bean (deceased) as well
as her then surviving spouse, George W.
Bradshaw (deceased).
The Plaintiff acquired the property from
Mathew J. Galle, who had inherited it from
his parents, George E. Galle and Kathryn C.
Galle who lived on it and had paid off the
real estate contracts.
If you assert some right, title or interest in
the subject parcels, you are hereby NOTIFIED TO APPEAR within sixty (60) days
after the date of the first publication of this
summons, which date is noted herein, and
defend this action in the above entitled court
by an answer asserting your claim to the
complaint of the plaintiff and serve a copy of
your answer upon the undersigned attorney

Deed of Trust encumbers the Real Property.
The 10/22/09 Deed of Trust secures the
obligations of Borrower under that certain

2. Failure to Pay Taxes
The Beneficiary has declared and does
hereby redeclare Borrower/Grantor in
default for failure to pay timely property
taxes due on the Real Property, as is required
under the 10/22/09 Deed of Trust. Such
defaults remains uncured as of the date of
this Notice of Trustee’s Sale, specifically
the taxes as shown overdue on EXHIBIT A
hereto (a printout of a search run July 30,
2013, on the Snohomish County website).
The Beneficiary has given prior written
notice to Borrower of Borrower’s default
in payment of property taxes on the Real
Property, not less than five times, in notice
letters dated November 21, 2012, December
20, 2012, March 22, 2013 [sic: incorrectly
dated 2012], and May 29, 2013, and in the
Notice of Default, dated June 14, 2013. The
default under the 10/22/09 Deed of Trust
is an Event of Default under the 10/22/09
Promissory Note.
3. Failure to Maintain Insurance
Banner Bank has received information
from insurance agent Whitfield’s United
Insurance, Everett, Washington, that Policy
No. CPP000712601, with Zahn Events
Center and Zahn LLC as insureds, is no
longer in force.
Under the 10/22/09 Deed of Trust, the
Grantor Zahn LLC is required to procure and
maintain fire and general liability insurance
coverage, as specified in the 10/22/09 Deed
of Trust. Failure to maintain the required
insurance, that goes uncured for 15 days
on notice, constitutes an Event of Default
under the 10/22/09 Deed of Trust. An Event
of Default under the 10/22/09 Deed of Trust
also constitutes an Event of Default under
the 10/22/09 Promissory Note.
The Beneficiary hereby declares the
Borrower/Grantor in default for failure to
procure and maintain fire and general liability insurance coverage, as specified and
required under the 10/22/09 Deed of Trust.
Failure to Maintain Good Status of Borrower/Grantor
According to the records of the Washington
Secretary of State, Borrower/Grantor Zahn,
LCC, was declared inactive on January
2, 2013.
Under the 10/22/09 Business Loan
Agreement, Borrower Zahn LLC made the
continuous warranty that it was a limited
liability company validly existing and in
good standing under and by virtue of the
laws of the State of Washington. Borrower
Zahn LLC has breached that warranty, by
reason of its inactive status.
Banner Bank hereby declares that breach
of warranty to be an Event of Default. Borrower is hereby notified that it is afforded
a period of 15 days from the date of this
Notice to cure such Event of Default.
An Event of Default under the 10/22/09
Business Loan Agreement also constitutes
an Event of Default under the 10/22/09
Promissory Note.
The foregoing amounts will increase with
the passage of time. You should contact
the undersigned Trustee for a current
payoff amount.
IV
As of July 29, 2013, the sum owing on the
obligations secured by the 10/22/09 Deed
of Trust is: Principal $842,295.57, together
with interest as provided in the underlying
loan documents and such other costs and
fees as are due under the 10/22/09 Promissory Note or other instrument secured, and
as are provided by statute.
V
The above-described Real Property will be
sold to satisfy the expense of sale and the
obligations secured by the 10/22/09 Deed of
Trust as provided by statute. The sale will be
made without warranty, express or implied,
regarding title, possession, or encumbrances
on Friday, November 8, 2013. The defaults
referred to in Paragraph III must be cured
before the date and time of sale. The sale
may be terminated any time before the sale
by the Borrower, Grantor, any guarantor,
or the holder of any recorded junior lien
or encumbrance paying the entire principal
and interest secured by the 10/22/09 Deed of
Trust, plus costs, fees, and advances, if any,
made pursuant to the terms of the obligation
and/or the 10/22/09 Deed of Trust, paying
all other amounts owing on the obligations
secured by the 10/22/09 Deed of Trust, and
curing all other defaults.
