Email: [email protected] Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 2 WEEK IN REVIEW R M Derrington QC (Editor) RECENT SPEECHES – ADDRESSES BY THE ATTORNEYS GENERAL AT THE BAR ASSOCIATION CONFERENCE The annual Bar Association Conference was held at the Gold Coast last weekend. In attendance were both the State and Federal Attorneys-General. Each gave one of the key note addresses and each, in part, reflected on their views as to the role of the Attorney General generally, as well as giving some indication of matters of concern to them for the forthcoming year. In his address the State Attorney General, the Hon Jarrod Bleijie, reflected upon the changing role of the Attorney General and identified the differences between the role of the Attorney General in the UK (where the A-Gs rarely sit in Cabinet) and the position in Australia where the role is substantially more political. He also identified the various areas in which the Government had legislated in the past year or so and suggested the possibility of some further legislative reform. The Attorney further indicated that he was giving some thought to the introduction of a separate Court of Criminal Appeal; being a system that works well in New South Wales. This is not the first time that such an issue has arisen in Queensland. It was considered by the Queensland Law Reform Commission in its report in 1982 on the Supreme Court (page 24ff). That report, which is available on the Commission’s excellent website (click here), shows that consideration was given to adopting the New South Wales model which had civil and criminal divisions. As the working paper and the final report show, it would appear the concept of divisions in the Court of Appeal did not then progress because of a lack of a sufficient volume of work for a divided court. In his speech the Attorney General also indicated that he was considering the appointment of a Supreme Court Judge to sit permanently at the Gold Coast. It is anticipated that the speech delivered by the Commonwealth Attorney-General, the Hon Sentator Brandis, will be available for publication in the near future. ADDRESS BY JOHN MCKENNA QC AT THE BAR ASSOCIATION CONFERENCE – USE OF AUTHORITIES IN COURT – PROPOSED FREE ACCESS TO THE QUEENSLAND REPORTS Another important paper given at the Bar Association Conference was delivered by John McKenna QC, the Chairman of the Incorporated Council of Law Reporting (ICLR). This paper discussed two related topics being the appropriate use of authorities in Court and a proposal by the ICLR to provide practitioners with free on-line access to the Queensland Reports. As to the first point, Mr McKenna observed that it is a requirement in the Supreme Court, District Court, Magistrates’ Court and the Federal Court that the authorized reports of cases are to be used in preference to unauthorized reports or unpublished versions of the reasons for decisions. The need for such practice directions arose as a result of the Courts being too frequently referred to multiple, unreported authorities which are of limited value in the determination of cases. In his paper, Mr McKenna identifies the principles underlying the purpose of the practice direction and the manner in which it applies. As to the second point, Mr McKenna announced that the ICLR intended to launch a website from January 2014 on which a searchable database of the full set of Queensland Reports (being all reports of the Supreme Court from 1876) would be available to the profession free of charge. As the ICLR is a charity this initiative can only occur with the support of those who largely donate their time to the production of the reports, the professional bodies, the Department of Justice and the University of Queensland as well as the revenue generated by the carrying of public notices in this publication. Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 3 JUDICIAL SPEECHES – THE HON JUSTICE BYRNE AO RFD; SENIOR JUDGE ADMINISTRATOR OF THE SUPREME COURT OF QUEENSLAND Countering Judicial Corruption – Justice Byrne In a most interesting speech delivered at the recent G20 Anti-Corruption Working Group Meeting in Sydney, his Honour, Justice Byrne, the Senior Judge Administrator of the Supreme Court of Queensland, highlighted the importance of judicial integrity and impartiality in retaining the community’s confidence in the Courts. His Honour opened his presentation with a discussion of the recent decision of the High Court in Australian Electoral Commission v Johnston [2014] HCA 5 [18 February 2014], which he used as a striking example of the impact that a strong and trusted judiciary can have in a community. His Honour observed that, despite a single justice of the High Court declaring that candidates elected in a recount of the Senate votes in Western Australia were not duly elected, “there is no visible tension in the community at the judge’s decision.” His Honour, however, acknowledges that sustaining or creating this level of public confidence is not an easy task, and it is one that requires dedicated adherence by members of the judiciary to values such as independence, impartiality, integrity, propriety, equality, competence and diligence. He observed that these values have been enshrined in a number of international law instruments, including the Bangalore Principles, a document which is seeing increasing support internationally and which encourages national judiciaries to adopt measures that implement these values. Justice Byrne contends that the adoption of measures which support these values is crucial to building and maintaining an impartial and incorruptible judiciary, being an institution that is essential to the development of a prosperous and peaceful nation. BILLS BEFORE THE HOUSE In the last week a number of Bills have been dealt with by the Parliament, including the following: Youth Justice and other Legislation Amendment Bill 2014 (Report received from Committee on 12 March 2014) This important piece of legislation proposes substantial changes to the handling of offences committed by Youths. Some of the proposed changes include the identification of repeat offenders and the opening of the Children’s Court for matters involving those repeat offenders, the creation of a new offence where a child commits an offence whilst on bail, permitting findings of guilt where no conviction is recorded to be taken into account in subsequent sentence hearings where the accused is then an adult and the provision for transfer of the 17 year old youth offenders to an adult corrective services facility where those persons have six or more months to serve in detention. A significant change sought to be introduced by this new legislation is to sentencing principles generally, whether the person being sentenced is a child or an adult. That change is the abrogating of the requirement that a sentence of imprisonment is to be imposed when no other sentence is appropriate and as a matter of last resort. APPEALS An application for special leave to appeal was made to the High Court in the following case previously noted in the Queensland Law Reporter: Markan v Bar Association of Queensland [2014] QCA 34. Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 4 RECENT PRACTICE DECISION – COSTS AND CALDERBANK LETTERS J & D Rigging Pty Ltd v Agripower Australia Ltd [2014] QCA 23; Court of Appeal (Holmes JA, Applegarth and Boddice JJ) (21 February 2014). The Appellant in this matter had succeeded in overturning the decision at first instance that an adjudication decision under BICPA was void and should be set aside. The consequence was that the Appellant had the benefit of the adjudication decision which had awarded just over $2.5m. The Appellant sought its costs of the appeal and at first instance on an indemnity basis, relying on the failure of the Respondent to respond to a Calderbank Letter delivered shortly before the first instance hearing. The Court of Appeal reaffirmed the principles concerning the Court’s discretion as to costs in circumstances where a Calderbank Letter had been delivered. The principles identified were: • The failure to accept a Calderbank offer is a matter which the Court should take into account when considering to make an order for indemnity costs; • However, of itself, the refusal of an offer to compromise does not warrant the exercise of the discretion to award indemnity costs; • The critical question is whether or not the refusal to accept the offer of compromise was unreasonable in the circumstances? The party seeking the indemnity order must show that the refusal to accept the offer was “unreasonable” or “imprudent”. • In determining whether or not the refusal to accept the offer was “unreasonable” or “imprudent”, the Court ought ordinarily have regard to those matters identified in Hazeldene’s Chicken Farm Pty Ltd v Victorian WorkCover Authority (No 2) (2005) 13 VR 435 being: “(a) the stage of the proceeding at which the offer was received; (b) the time allowed to the offeree to consider the offer; (c) the extent of the compromise offered; (d) the offeree’s prospects of success, assessed as at the date of the offer; (e) the clarity with which the terms of the offer were expressed; (f) whether the offer foreshadowed an application for an indemnity costs in the event of the offeree’s rejecting it.” The Court refused to grant an order for indemnity costs and, in doing so, noted that the offer expired only 24 hours after the Appellant had provided its extensive written outline of submissions. It is apparent that the Court considered that the Respondent had not been given sufficient time to fully consider the Appellant’s case; that the extent of the compromise offered was small in comparison to the total claim; and that the Respondent had substantial arguments with respect to the matters in issue such that it could not be said that its case was “poor”. It is worth noting that the Court identified that whilst it is appropriate for the Court to encourage settlement of actions, it is also a relevant factor that potential litigants should not be discouraged from bringing their disputes to the Courts. RECENT ARTICLES – AUSTRALIA’S INTERNATIONAL ARBITRAL PROCEEDINGS IN RELATION TO THE TOBACCO PACKAGING LEGISLATION Tobacco Packaging Arbitration and the State’s Ability to Legislate, Ankita Ritwik The Australian government’s decision to mandate the ‘plain packaging’ of cigarettes has caused more than a little legal consternation, both locally and internationally. Australia, though currently having the most proscriptive plain packaging legislation is not the only country to mandate the plain packaging of cigarettes. Uruguay introduced similar, though (slightly) less stringent, legislation in February 2010. In an article, published in the Harvard International Law Journal and entitled Tobacco Packaging Arbitration and the State’s Ability to Legislate, Ankita Ritwik provides an update on the arbitration cases that have arisen out of this legislation in both Australia and Uruguay. Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 5 Immediately following the passing of the plain-packaging Bill in November 2011, Phillip Morris Asia Limited (“PM Asia”) – the Asian subsidiary of Philip Morris International (“PMI”) – filed an arbitration claim against the Australian government pursuant to the Hong Kong-Australia Bilateral Investment Treaty. This claim alleges that Australia has violated its obligations under the Treaty relating to “expropriation fair and equitable treatment, unreasonable impairment, full protection and security, and the umbrella clause.” Unusually, however, the relief sought by PM Asia is not confined to pecuniary damages, but rather, in addition to compensation for its costs and losses, PM Asia seeks the abrogation of the plain packaging legislation. Ritwik argues that despite a (very) limited number of arbitral decisions which have granted injunctive relief, there is a serious question-mark over whether an arbitral tribunal has the requisite authority to grant such a remedy and, arguably more importantly, whether these tribunals should be able to do so. Were an arbitral tribunal able to grant an injunction in these circumstances, it would, in effect, “trump the principle of legislative supremacy … [and] alter a central tenet of representative democracy” – a small group of unelected individuals would have significant influence over the regulatory functions of the state and ultimately have the power to eliminate a state’s ability to legislate. Further, as Ritwik highlights, this potential capacity of an arbitral body is particularly concerning in the immediate case where the legislation at issue has been enacted for the protection of the Australian people. The outcome of the arbitral proceedings will be of great interest. Given the impact that this legislation has had on PMI, and the likelihood that other nations will adopt legislation similar to Australia and Uruguay’s if it can be successfully defended, it is unlikely that they will discontinue their suit. Yet, as Ritwik highlights, these cases are already having an impact upon the willingness of nations to enter into investor-state arbitration agreements and the backlash from states, were the tribunal to grant injunctive relief, could significantly weaken the investor-state arbitration system. In essence Green is concerned with the dissonance between what people see as criminal conduct and the way the law of theft responds. For an extreme example, there is a large section of the community (mainly adolescent boys) that would no doubt support the criminalisation of conduct in the virtual world of online gaming. How does theft law respond in a world of intangibles where the notion of property is becoming highly sophisticated? Green calls for reform in a book that will appeal to regulators and academics. • Scott Leckie (ed), Housing, Land, and Property Restitution Rights of Refugees and Displaced Persons – Laws, Cases and Materials 2013 (Cambridge University Press) The Pinheiro principles recognise that millions of refugees and displaced persons worldwide continue to live in precarious and uncertain situations, and that all refugees and displaced persons have a right to voluntary return, in safety and dignity, to their original or former habitual homes and lands. In order for such principles to work for the benefit of the dispossessed there must be a legal framework that recognises and legitimises a right to housing, land, and property restitution. This is a specialized text of collected materials dealing with the rights of refugees and displaced persons to have Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 6 restored to them the housing, land and property rights they held at the time of their displacement. • William Flenley QC, Tom Leech QC, Thomas Grant, Graham Reid, and Paul Mitchell, Solicitors’ Negligence and Liability 3 ed 2013 (Bloomsbury Professional) The third edition of “Flenley & Leech” is a comprehensive treatment and extends to over 1000 pages. It is the leading text on solicitors’ liability and negligence in the United Kingdom and will continue to be a useful comparative resource for the Australian practitioner working is this wide ranging area of law. Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 7 EDITORS’ SELECTION OF NEW CASES The following cases have been selected for reporting in the Queensland Reports: SPECIFIC PERFORMANCE – DISCRETION TO REFUSE REMEDY – HARDSHIP Evans v Robcorp Pty Ltd [2014] QSC 26, Peter Lyons J (13 February 2014) This important decision addresses the question of whether or not the Court ought to order specific performance in circumstances where such an order would impose great hardship upon the respondent? The general principle involved in the decision is the discretionary nature of the equitable remedy of specific performance. In the matter before his Honour, an application for specific performance had been made, pursuant to s70 of the Property Law Act 1974 (Qld), by the applicant, a vendor in an unperformed contract for the sale of land. [1-5] In resisting this application on grounds related to their current impecuniosity, the respondents gave evidence to the effect that though at the time of making the contract they believed they would be in a position to perform their obligations, at the date of settlement, they were unable to do so and that, were the Court to make such an order, they would be unable to comply. [6] In determining whether or not an order for specific performance ought to be made in these circumstances, His Honour, Justice P Lyons canvassed decisions from a number of jurisdictions. In particular, his Honour noted the decision of the New Zealand Supreme Court in Nicholas v Ingram; subsequently cited with approval by Demack J in Ready Construction Pty Ltd v Jenno [1984] 2 Qd R 78, at 82, which considered it authority for the principle that “mere financial inability on the part of a purchaser is not a reason for refusing to decree specific performance” [10]. His Honour, however, was more persuaded by, and ultimately followed the reasoning of the NSW Supreme Court in Boyarsky v Taylor [2008] NSWSC 1415 and its citations to Spry’s Equitable Remedies to the effect that “the courts will not require that to be done which cannot be done” and that “there is no reason … why a source of hardship should be ignored merely because it did not exist at the time when the contract was entered into.” [12-15] On the basis of this reasoning, Peter Lyons J refused to make an order for summary judgment. Queensland Law Reporter – 14 March 2014 – [2014] 09 QLR 62 GENERAL INFORMATION ICLRQ The Incorporated Council of Law Reporting for the State of Queensland (ICLRQ) is a charitable institution which was founded in 1907. Under its constitution, the principal object of the ICLRQ is “the preparation and publication in a convenient form, at a moderate price, and under gratuitous professional superintendence and control, of Reports of Judicial Decisions of the Supreme Court in the State of Queensland.” In pursuit of this object, the ICLRQ publishes a set of authorised reports of the key decisions of the Supreme Court of Queensland (Queensland Reports) and a weekly supplement to these reports (Queensland Law Reporter). Under the constitution of the ICLRQ, all surplus funds from its operations are used to benefit the Supreme Court of Queensland Library. The members of the Council serve on a voluntary basis. The Council is constituted by three practising barristers and three practising solicitors (who are appointed annually by the Judges of the Supreme Court) and three ex officio members (the Attorney-General of Queensland, the Solicitor-General of Queensland and the Registrar of the Supreme Court).
