Please retain a blank copy of this sheet to send to us anytime there are changes in personnel or responsibilities. This information will allow us to contact the appropriate people in your organization with questions or emergencies. All after-hours (home, cell) phone numbers will be kept strictly confidential and will be used only if an emergency situation arises in your suite after hours or on the weekend. For more information regarding tenant emergencies and designation of a tenant safety coordinator, please consult the Emergency Procedures section of the handbook. For each tenant in the building, building management requests the names of two (2) people for contact purposes and the name of your accounting contact. These are personnel who will be responsible for requesting services from the Landlord. These people should be able to sign service requests for additional work, which may be provided at an additional cost. The second name is that of an alternate contact. We are requesting the home telephone numbers of these individuals in case of an after-hours emergency. All home telephone numbers are kept strictly confidential. We are also asking for your accounting contact to assist with invoices and rental payment questions. Click here to download a Tenant Contact Form Building Security: Building Access Access to the building is available 24 hours per day, seven days per week. Regular hours are from 6:00 a.m. to 6:00 p.m., Monday through Friday, and 6:00 a.m. to 1:00 p.m. on Saturdays. Entry to the building on Saturdays and at times other than these hours through the Federal Street and Bullington Plaza Area Entrances will require you to use your valid access card to gain admittance to the building. The front plaza doors closest to the DART rail line are open 24 hours per day, seven days per week. After building hours, you will be required to sign in and sign out at the Lobby Desk, which is manned by Security personnel 24 hours per day, seven days per week. The glass doors at the back of the elevator lobby are reserved access for Building Personnel Only. If you have boxes or catering needs, please see the Lobby Desk for admittance through these doors. You will be required to show your building access card. Tenant Access System Cards Upon move in, each tenant will receive an access card admitting them to the building, the turnstiles and their tenant floor. Tenant Access System Cards (continued) Lost or stolen access cards should be reported immediately to Access Control located on the B-1 level at 214-812-6253. There will be a charge to the tenants for cards that are lost, stolen or damaged. When an employee is terminated from the tenant’s employment, his/her access system card should be collected and returned to Access Control. On situations where the employee's access system card cannot be retrieved Access Control should be notified immediately so access to the building can be disabled. In addition, it is the tenant’s responsibility to collect the keys and cards of all terminated employees in order to maintain the security of the suite. If replacement locks are needed because keys have not been collected from individual(s), the tenant will be charged for this service. Building Security: Deliveries Dock Access, Freight Access, Corporate Catering, Insurance Requirements Energy Plaza Dock and Bullington Truck Terminal Rules The City of Dallas operates and regulates the Bullington Truck Terminal and street access to the Energy Plaza dock through City Ordinances ruling 18408. Normal operating hours are 6:00 AM to 5:00 PM, Monday through Friday. Maximum access height is 14’2”, with maximum length of 34’ during normal operation hours and restricted to the same company having only one vehicle at the dock location during normal business hours. There is no limit on vehicles outside of normal operating hours. There is a 30-minute time limit on loading and unloading during the 9:00 AM until 12:00 PM peak hours. No service vehicle can park after delivery of equipment and no parking of any tenant’s private vehicles are allowed at any time. 1. Frequent Energy Plaza registered users with access cards will enter through the B-3 dock doors and proceed to the Freight Elevator accessing the tenant areas. 2. Non-registered users will utilize the call box located at the B-3 Energy Plaza Dock Gate to notify Security of their delivery. Security will escort them to the Lobby Desk for notification to the tenant. 3. All after hour’s dock delivery request must be approved through the management office at 214-812-6060 with 24-hour notice. A fee of $28 per hour shall be charged for use of the terminal outside of normal operating hours, with a minimum of 2 hours. 4. After 1:00 pm, the City of Dallas does permit with approved signed notification form available at the management office, longer loading and unloading than 30-minute time limit. * Listed below are pertinent City Ordinances pertaining to the use of the terminal: Sec 28-128.9 - The terminal shall be used for the expeditious unloading and delivery or pickup and loading of materials to or from businesses located within buildings opening into the terminal. Sec. 28-128.10 - The normal operating hours of the terminal are from 6:00 a.m. to 5:00 p.m. Monday through Friday. A person may, upon giving 24 hours notice, obtain permission from the Building Management Office for after hour delivery. A fee of $28.00 an hour shall be charged for use of the terminal outside of normal operating hours, with a minimum of 2 hours. Sec. 28-128.11 (a) A person commits an offense if, during normal operating hours, he enters a vehicle ramp of the terminal while operating a truck-tractor, semi-trailer, pole trailer or trailer. (b) A person operating a truck-tractor, semi-trailer, pole trailer, or trailer may use the terminal outside of normal building services hours if permission is obtained from the Building Management Office. Sec. 28-128.12 (a) A person commits an offense if, during normal operating hours, he stops, stands, or parks a vehicle in the terminal for any purpose other than the expeditious unloading and delivery or pickup and loading of materials to or from a business located within a building opening into the terminal. (b) A person commits an offense if, during normal operating hours, he stops, stands, or parks a vehicle in the terminal for a period exceeding 30 minutes. Vehicle size: Maximum height 14' 2", maximum length 34' during normal operating hours. Access is restricted to one vehicle per company during normal operating hours. No limit outside of normal operating hours. Freight Elevator Access All large deliveries must be scheduled through the management office. It is preferable that larger deliveries be scheduled later in the afternoon. No deliveries using dollies or carts may be made through the lobby. Any items that cannot be easily carried in the passenger elevators must be transported onto the freight elevator. Food Access All catering deliveries require a tenant representative to meet the caterer at the Lobby Security Desk and the tenant is responsible for the caterer until they exit the building. We ask that Building Security be notified of all corporate catering deliveries prior to the delivery by calling the Main Lobby Desk at 214-812-2962. Please include the name of the caterer, the floor destination, the tenant name, the tenant contact name and the telephone number. All personal food deliveries must be picked up at the Lobby Security Desk by a tenant representative. NO ACCESS will be granted to any food delivery persons for a personal delivery. All after hour catering deliveries must be scheduled in advance, a 24 hours notice is required to the Lobby Security Desk at 214-812-2962. Insurance Requirements All vendors and contractors entering the building must provide the management office with an approved Certificate of Insurance before work or deliveries may begin. All vendors and contractors must be escorted by the tenant or tenant’s representative to the tenant’s suite. For vendors and contractors with frequent business at the tenant’s suite, the tenant may wish to have them obtain an Energy Plaza access card after a thorough background check at the Access Control Office located on B-1. Building Security: Lost and Found Please report any lost or found items to the Building Management or Security Access Control. Security Access Control: 214-812-6253 Building Management: 214-812-6060 Building Security: Property Removal As a theft preventative measure, each time you, or one of your employees or your vendors or contractors remove any material (i.e. computers, furniture, construction tools, etc.) from the building, a property removal form must be presented to the Security Attendant at the Lobby Desk. This property removal form must be signed by your authorized tenant representative. Click here to download a Property Removal Form Building Security: Special Keying Unless your lease specifies otherwise, all keys in the Building are included in a Building Master Key System. This key system is necessary so that the building staff has access to all areas in the event of an emergency. For this reason, we require that no locks be changed or additional locks be added to any door within your suite. If additional lock work for your suite is necessary, this service must be coordinated through the management office. There will be a charge for re-keying locks. As a standard Building policy, all suites are re-keyed when new tenants move in. This helps to ensure the security of that space for the new tenant. If a tenant would like additional keys to any of the locks in their suite, keys can be obtained through the management office. Copies of keys can be obtained at a cost. In response to a Tenant’s Internal Security needs, we can provide services that include: Keying individual offices Re-keying the entire suite Building Security: Tenant Security Responsibilities Remember that the best way to improve security is for each tenant in the building to take an active role as you would in the neighborhood where you live. Keep all doors locked after you leave the office. Instruct employees to keep valuables, including purses, in locked desks when unattended. Keep calculators and expensive items off desktops when not at desk. Articles of value, including handbags and coats should not be left in unguarded reception areas or desks, even for a few minutes. Notify security in and around the property where loiterers are observed. Special care should be taken during times best suited for pilferage (i.e. thirty minutes after opening), during absence from work areas and office. Check wastebaskets at the end of the day to see if any equipment or other valuables may have been stored for later removal. Lock suite entry door when entry area is unattended. Building Security: Visitors and Special Admittance Tenant visitors must check in with Building Security at the Lobby Desk when entering the building. Building Security will contact the tenant contact. Tenant must report to the Lobby to check in visitors and be issued a “Visitor” access card. Visitors will be asked to present identification to be registered into the access system where they will then be given a visitor badge permitting them through the turnstiles only. Visitors must be accompanied by tenant contact at all times. The tenant contact must escort the visitors back to the Lobby Desk when visitors leave the building and be sure the visitor access card is turned in to Building Security. After hour visitors may only enter through the Front Plaza Entrance Door closest to the DART Rail Line. If possible, please register large visitor groups at least 24 hours in advance with the Lobby Desk at 214-812-2962. Visitors must abide by the Building Rules & Regulations as found in the Policies and Procedures section of this handbook. If at any time during working hours you desire adjustment to the temperature within your suite, electronically submit a work order through your tenant administrator or contact the management office for assistance. To avoid damage and minimize delays, please do not adjust thermostats, cover vents or utilize space heaters. In addition, we suggest that you keep shades closed when in direct sunlight. Keeping blinds closed at night and over the weekend will help maintain a more constant temperature in your suite. HVAC services after business hours are available upon request and can be scheduled by submitting a service request on line through your tenant administrator or by contacting the Building Management Office. There will be a charge for after hours HVAC Service per your lease agreement. We ask that you schedule after business hours HVAC at least 24 hours in advance. Building Services: Janitorial Services The cleaning for Energy Plaza is handled by contract services. Cleaning service is provided five nights a week, Sunday through Thursday. Carpets will be vacuumed, unobstructured surfaces dusted, trash emptied, and kitchens, break rooms and restrooms cleaned. If trash that is to be disposed of is not in wastebaskets, please inform cleaning personnel by leaving a large note on such items marked TRASH and BASURA (Spanish for trash). Please DO NOT leave items that are not trash on top or near wastebaskets that might be misconstrued as garbage. If you have special cleaning needs, such as carpet shampooing, contact Building Management. Special cleaning services can be arranged at tenant expense. Energy Plaza utilizes day porters during business hours to tidy tenant restrooms, common areas and exterior plaza’s. If a cleaning problem arises during working hours, please contact Building Management at 214-812-6060. Building Services: Trash Removal and Recycle Normal building trash removal is provided as a standard building service. Large-scale debris, such as trash following construction or minor renovations, as well as computer equipment removal, is the responsibility of the tenant. For disposal of small debris and boxes, please contact Building Management. Energy Plaza utilizes a desk-side single basket recycling system.You will no longer need to decide which trash should go into the recycling container. Instead, all trash (empty cans included) goes into your single trash basket at your desk side (CLEAR WHITE LINERS) and is later separated at the waste collection’s material recovery center offsite. Wet trash (liquid) and discarded food are to be placed in your kitchen/break room/conference area’s (where meals will be consumed) in trash receptacles with BLACK LINERS. Copy rooms and shredding areas are designated recycle areas with CLEAR WHITE LINERS. Building Services: Mail Service Expediting Postal Mail Delivery Services at Energy Plaza On 10/05/2009, the Postal Service began delivering the incoming Postal Mail to the new Energy Plaza Postal Boxes, B-1. The Energy Plaza Tenant’s Mail Service Departments will coordinate the postal mail pick-up from the postal boxes and handle the internal delivery. The Postal Service will utilize their sorting technology to separate the incoming mail to each Company and it will be essential that the address delivery information on each envelope includes the (1) recipient name (2) company name (3) street address (4) city, state and zip-code. If needed, work with your vendors and customers to assure that they include the proper address information to expedite the delivery services. This relationship is most important when discussing fire and life-safety issues. You depend on the management team to provide you with information and instructions on how to respond during an emergency situation. Similarly, we depend on you – and all the tenants – to become familiar with that information, and to participate in evacuation drills and training sessions. Throughout the following Emergencies section, we will refer to the Incident Commander, Floor Wardens, Searchers, Special Needs Monitors, Stairwell and Alternates. These are people in the building who have been assigned to specific duties to perform during an emergency situation. Please refer to the Evacuation section of this guide for more information on the responsibilities of each of these positions. All members of your staff must be familiar with these procedures. It is recommended that all employees complete the online education training. Emergency Procedures: Incident Command System The Incident Command System (ICS) is a management system that outlines the protocol, procedures, and terminology for organizing personnel, facilities, equipment, and communications at the scene of an emergency. ICS provides a common framework from which all emergency responders can work. ICS is widely used throughout the United States by fire agencies, and is increasingly used for law enforcement, first responders, and other public safety applications, as well as for emergency and event management. It was designed to provide clear lines of authority, clear objectives and clear communication. Transwestern Commercial Services has chosen to implement a basic version of ICS to manage emergencies. Fundamental to ICS is establishing who the Incident Commander is during an emergency. The role of the Incident Commander is to set objectives and priorities, develop the action plan, conduct tactical operations, provide logistical support and evaluate results. While the Incident Commander has the final decision, he or she does not make the decisions in a vacuum. The Incident Commander hears and evaluates recommendations from others, especially those who might know more about a particular area. The most senior member of the property team ON-SITE during the emergency is the Incident Commander. If there is not yet a member of the property team on-site, the most senior security officer is the Incident Commander. As Incident Commander, he or she is responsible for making on-site decisions and issuing on-site commands on behalf of Transwestern Commercial Services during the event. If there is no property team member or security officer on-site, then the Incident Commander is the Manager on Duty (MOD) at that time. Transwestern Commercial Services will have an off-site manager on duty, on call, 24 hours per day at all times. Emergency Procedures: Evacuation Plan It is imperative that all tenants follow the Evacuation Plan (the “Plan”) as outlined below. It is your company's responsibility to assign responsible personnel to assist the property management team, and to be responsible for controlling the movement of your employees and visitors during a full or partial evacuation of the building. The Evacuation Plan includes information on the following topics: Evacuation team members and their responsibilities Evacuation plans and procedures Training Emergency procedures for: Evacuation Fire Medical Emergencies Power Failure Bomb Threats Chemical, Biological, or Radiological (CBR) Event Emergency procedures for: Severe Weather Civil Disturbance Terrorist Activities Workplace Violence Evacuation Team Member and Responsibilities You should establish an evacuation team based on the positions described below. Additionally, you need to keep an updated emergency telephone calling tree for contacting employees. A list of your evacuation team and special needs persons must be provided to Building Management and updated quarterly. The Evacuation Team for each floor consists of the Floor Warden, Searchers, Special Needs Monitors, Stairwell Monitors and Alternates. It is each team member’s responsibility to be familiar with the Plan, the emergency exits, and the location and operation of any available fire alarm system, equipment, and extinguishers. The following pages outline the roles and responsibilities of Evacuation Team members. All of the following roles are appointed by you, the tenant, with the exception of the Incident Commander who is the most senior member of the building management team on-site at the time of an emergency. Evacuation Team Member and Responsibilities Incident Commander – Manages the evacuation of the entire building, the most senior property team member on-site at the time of emergency. (e.g. Property Manager, Engineer, Security, or the MOD) Provides overall management/supervision of the emergency evacuation. Handles all external (i.e. local authorities) and internal communications regarding emergencies. Makes all decisions related to building emergencies and evacuation. Floor Wardens – Manages the evacuation of the assigned suite or floor and appointed by tenant. Organizes and directs the Evacuation Team for an assigned suite. Keeps property management team informed. Ensures all public areas of their assigned floor are evacuated. Organize and direct the evacuation Team for an assigned suite. Keeps property management team informed of any changes to the list of individuals requiring special assistance as well as any absences of the Evacuation Team for their suite. Evacuation Team Member and Responsibilities (continued) Searchers – Ensures no one is left behind. Searchers are appointed by the tenant for each floor and each suite. Searches all rooms and public areas in their assigned suite to ensure everyone has evacuated Informs the Floor Warden when assigned area is fully evacuated. Informs the Floor Warden when assigned area is fully evacuated. Special Needs Monitors – Aid persons requiring special assistance and are appointed by each tenant on each floor. Ensures that those needing special assistance are evacuated safely. Evacuation Team Member and Responsibilities (continued) Stairwell Monitors – Manages stairwell evacuation inside suites and common areas. Ensures that the stairwell door is not hot to the touch and there is no smoke in the stairwell. Holds the stairwell door, keeps talking to a minimum, and ensures those evacuating stay on the right side on the stairwell. Stands on the stairwell landing to direct traffic flow and encourages evacuees to remain calm. Alternates - Sufficient alternates for each Evacuation Team position must be assigned so that a principal or alternate is in the building at all times during working hours to support leadership under the Plan. Alternate coverage during vacation, sick leave, etc. must be taken into account. Training All members of the tenant’s evacuation team will be asked to attend forums and training sessions conducted by the fire department, police department and/or Transwestern Commercial Services. The training is essential to the readiness of the evacuation team. Building Management will schedule the sessions and provide you with pertinent information. Tenants should conduct in-house training and emergency evacuation drills regularly in accordance with the Plan. The Transwestern Commercial Services property management team is available to assist with presentations and a review for your firm’s emergency evacuation plan. Evacuation Drills Building Management, often with the assistance of the fire department, conducts periodic emergency evacuation drills for the building in accordance with the Evacuation Plan. All occupants of the building are required to participate in the emergency evacuation drills. The occupants may be required to leave the building and assemble in an area designated by the Incident Commander. First Aid & Emergency Supplies It is recommended that you have, at minimum, the following items available in your tenant space: First aid kit Cell phone with spare batteries Transistor radio with extra batteries Heavy gloves in case of broken glass Flashlights and fresh batteries Bottled water Instructions for Persons Requiring Special Needs Persons requiring special assistance (broken leg, pregnancy, physically challenged, etc.) must be identified and considered prior to any emergency evacuation. It is necessary for Floor Wardens to notify Building Management of any persons who may require special assistance during an evacuation. A form for maintaining a list of persons requiring special assistance can be obtained from the Building Management office. Persons not requiring or providing assistance will evacuate first. Persons requiring special assistance can then evacuate in an effort to avoid injury. If there is evidence of fire, persons requiring special assistance should be positioned near the emergency exit located farthest away from the fire. If fire conditions pose a personal threat, the Special Needs Monitor will enter into the emergency stairwell accompanying the person requiring assistance and wait for help from the fire department. The Evacuation Team may assist in evacuating the persons requiring special assistance if danger is imminent and the fire department has not yet arrived. Emergency Procedures: Fire Provisions General Information The building may be fully or partially evacuated when a fire alarm signal is sounded. An effective evacuation depends on the orderly ‘phasing’ of floor clearance, which means that the fire floor is evacuated first and immediately. The next floors to evacuate should be the two floors directly above the fire floor, followed by the one floor directly below. The Incident Commander will be in charge of the evacuation until the fire department arrives. Building occupants must create an environment that supports cooperation with Floor Wardens to ensure that all employees are well informed and instructed on evacuation procedures. If Smoke or Fire is Discovered Call 911 Call Building Security at 214-812-6767 Small Fire – use an extinguisher from the stairwell Large Fire Close the door to contain it Evacuate the floor Emergency Procedures: Medical Emergency Time is extremely important in the case of a medical emergency. Transwestern Commercial Services recommends that all tenants keep a first aid kit, including emergency supplies, unlocked and fully stocked in their suite. It is the tenant’s responsibility to make sure that employees are aware of its location and proper use of the supplies. Do not attempt to move the injured person unless it is necessary for safety reasons. Emergency Procedures: Power Failure In the event the building sustains a power failure, emergency lighting is available in the stairwells and throughout your floor powered by a 1000kw emergency generator. All HVAC equipment, lights, outlets, and most telephone equipment may not be operational. Should a power failure occur: If a building evacuation is ordered, follow the evacuation plan procedures. Follow all instructions from the Incident Commander and Floor Wardens. Do not reenter the building until instructed. During a power failure elevators will return to the main elevator lobby and automatically be placed out of service. In the event that a passenger becomes entrapped please notify Building Security via the elevator emergency intercom system. Emergency Procedures: Bomb Threat The success of the building’s prevention strategy requires the full cooperation of all tenants. All suspicious individuals, activities, packages, or situations should be reported to building security. If a general or non-specific bomb threat is received by a tenant (no description of bomb, no detonation time, no location, etc.), the building in most cases will remain open. However, the decision to evacuate each tenant’s suite is at the discretion of each tenant. Evacuation may become necessary if the threat is specific in nature, the call cannot be resolved as a hoax, or a suspicious object is located. In case of evacuation, the process described in the Evacuation Plan shall be followed. Please know that in most bomb threats, the bomb squad will not respond to a threat. If an unidentified or suspicious package is located, they may then respond to examine the object. In many cases a police officer will be dispatched, without urgency, to take a report of the threat. ** If you encounter a suspicious package or substance, please remember these keys to guide your response: Isolation, Notification, and Evacuation. All tenant occupants led by the evacuation team should begin a search if appropriate. Record search results and report to the incident commander or authorities. If evacuation becomes necessary follow evacuation plan and the instruction of evacuation team members. Click here to Download a Bomb Threat Checklist Emergency Procedures: Chemical, Biological or Radiological Event There is a heightened awareness of the emerging threat of terrorism by unconventional weapons. The most dangerous forms of these weapons are also the most difficult to manufacture and transport because they are volatile and difficult to produce and deploy. The response to an incident involving CBR agents is similar to any other incident involving hazardous materials. Notification: Call 911 and then call 214-812-6767. Isolation: Isolate CBR object, area and those exposed. Evacuation: Follow the evacuation or relocate procedures according to CBR event. The person who discovers a CBR Incident should: Call 911. Give the 911 dispatcher the following information: Caller’s name Nature of emergency Company name Physical address Suite/Floor number Telephone number Call Building Management at 214-812-6060. If evacuation becomes necessary, follow the evacuation plan and the instructions of the evacuation team. Emergency Procedures: Severe Weather When severe weather conditions become apparent, the U.S. Weather Bureau describes conditions by two (2) classifications, a watch or a warning. This applies to the reporting of severe thunderstorms, the approach of weather conditions favoring the formation of tornadoes, a hurricane conditions, a winter storm condition, etc. A Watch becomes effective when atmospheric conditions are right to produce the particular weather phenomenon. A Warning means that the weather condition has been spotted and prompt action must be taken for safety. The decision to evacuate the building or move to the stairwells based on the above weather reports will be made by Building Management. In the event these conditions do exist, the following guidelines should be kept in mind: Tenants should maintain an inventory of first aid and emergency supplies to be used during severe weather Move to the core areas of the building (Interior rooms or stairwells) Stay away from doors and windows Do not go to the Lobby Listen for announcements over the intercom system. Emergency Procedures: Earthquake Before In the event of an earthquake, DO NOT ATTEMPT TO LEAVE THE BUILDING. Reports indicate that you are safer within the building until the tremors subside. If evacuation is necessary, know where the locations of possible safe refuge areas are outside and away from the building. Beware of falling debris and electrical lines. Have a plan for reuniting with your family. Have an out-of-state contact person for your family members to contact. During Remain calm. Do not exit the building. DO NOT USE ELEVATORS. If you are in an elevator, exit as soon as possible. Move away from the building exterior. Stay away from windows, bookcases, filing cabinets, and any objects that may fall or shatter. Take cover under desk or another sturdy object or against the wall in the core of the building. Protect your head. DUCK, COVER, and HOLD. DO NOT take cover in emergency stairwells because they may need to be used for evacuation. After Be prepared for aftershocks. Check for injured and assist if possible. Do not move seriously injured person unless they are in immediate danger. Tenant’s evacuation team should check floor for damage. Check for fires, water leaks, and electrical shorts. DO NOT use matches or cigarette lighters or turn on electrical switches or appliances. Open doors carefully. Watch for falling debris. Stay away from windows/glassed areas. Replace telephone receivers, in case the telephone system works. Use telephones for emergency calls ONLY. Listen to radio for emergency reports. Do not spread rumors regarding building condition, extent of damage, and injuries. This may cause a panic. Cooperate with the public safety officials. Notify Building Management of any damage to the building. Emergency Procedures: Hurricanes and Floods When a hurricane warning is announced, hurricane conditions are considered imminent and may begin immediately or at least within the next 12 to 24 hours. When a hurricane warning has been issued, it is of the utmost importance that all precautionary measures and actions are taken immediately for the protection of life and property. Keep abreast of weather conditions via radio or television. Close all doors of perimeter offices. If time permits, close all drapes and blinds. LEAVE ALL INTERIOR DOORS OPEN in order to prevent atmospheric pressure problems. Notify Building Management of all flooding, leaks, fires, and structural damage. Someone from Building Management will contact you with further instructions. If there is enough warning, 12-24 hours, people may leave the building. However, if there is no advance warning, people should not evacuate unless instructed to do so by authorities. Emergency Procedures: Civil Disturbance We rely on the local authorities to advise us of protective actions that should be taken during a local disturbance in or around the property. Emergency procedures may include one or more of the following: Partial building evacuation Securing entry to the building Securing all stairwells Securing elevators on a given floor Restricting access In the event of a civil disturbance, tenants may be asked to remain in the building under advisement of the Incident Commander or law enforcement agencies until the disturbance is under control. Emergency Procedures: Terrorism If we experience what we believe to be a credible threat in this building, we will alert our tenant contacts. Unless authorities dictate, the decision to evacuate the premises will remain with each tenant. Ultimately, security is everyone’s responsibility and no security measure can completely prevent terrorist attacks. By working together, however, we hope to create a more secure environment. Transwestern Commercial Services has established a Threat Level Matrix based on the Department of Homeland Security (DHS) threat advisory color code system. This Matrix provides a list of actionable security options available at each DHS level related to operating procedures that would restrict free and open access to the building. Some of these options include restrictions on the use of the loading dock, the parking areas, lobby control for tenants and visitors, delivery services, etc. Transwestern Commercial Services trains its staff and the various Floor Wardens to react to emergencies to help guide tenants to safe areas in the event of a terrorist incident. Energy Star is a government-backed program helping businesses and consumers protect the environment through superior energy efficiency. Canvassing Canvassing, soliciting and peddling in the building are prohibited and tenant shall cooperate to prevent such activities. Animals, Bicycles, Vehicles Tenants shall not bring or keep within the building any animal, bicycle, motorcycle, or other types of vehicle except as required by law. Bicycle storage is located on the B1 level of the building. Please see Building Security for access. Office Equipment For our safety the following items are not allowed in personal workspaces/offices. Toaster ovens Microwaves Refrigerators Hot plates Space heaters Electric blankets Coffee/tea makers Coffee cup/pot warmers Curling irons Candles, candle warmers and scented plug-ins Extension cords are not allowed. Only UL certified power strips are permitted in the building. Never plug a power strip into another power strip. Small personal fans are allowed but must be turned off before leaving the office. Plumbing Fixtures Tenants shall not use the restrooms or plumbing fixtures of the building for any other purpose than the purpose for which they were constructed or manufactured. Fire and Safety Regulations Subject to all fire or other safety regulations, all doors opening onto common areas, and all doors upon the perimeter of the demised premises shall be kept closed. During non-business hours, doors should be kept locked, except when in use for ingress or egress. Tenant shall cooperate with energy conservation by limiting the use of lights to areas occupied during non-business hours. Trash The disposal of any trash, refuse or other substances of any kind should not occur except in the designated refuse containers. No material shall be placed in trash boxes or receptacles if such material cannot be disposed of in an ordinary and customary manner without being in violation of any law or ordinance. NO TRASH SHALL BE LEFT IN THE HALLWAY BY THE FREIGHT ELEVATOR. Common Areas Tenants shall use the common areas only as a means of ingress and egress and Tenant shall not permit any loitering by any persons in the common areas or elsewhere within the building. The common areas and roof of the building are not for the use of the general public. Tenants shall not utilize the stairwells for exercising. Alterations Tenant shall not mark, paint, drill, cut, string wires within or in any way deface any part of the building Tenant shall not mark, paint, drill, cut, string wires within or in any way deface any part of the building without the prior written consent of Landlord and as Landlord may direct. Upon removal of any wall decorations or floor coverings by Tenant, any damages to the walls or floors shall be repaired by Tenant at Tenant’s expense. Freight Elevators Freight elevators are only to be used for deliveries from the B3 loading dock and moving large products (such as dollies/carts) throughout the building. Freight elevators should not be used for general tenant use. Policies and Procedures: Contractor Rules and Regulations Subsequent to the completion and occupancy of your new office, you may find that you need additional items or specific requirements have changed. If you discover you desire a change, then please feel free to notify Building Management. All alterations and improvements to the premises must be approved by the Landlord. This approval is necessary to make certain that the proposed work not only meets the same standards of original construction, but also complies with all building codes and regulations. EFH Design & Construction has resources for a variety of contractual services. Whether you are installing an additional electrical outlet or constructing major renovations, please contact Building Management to review these services. If you prefer to contract work for yourself, then please remember that all construction or electrical work must be approved by Building Management prior to any work starting in the building. Prior to any work beginning in the building, the contractor must submit a Contractor Request Form on the tenant’s behalf, outlining the work to be performed, dates, times, etc. Also, should this work require life/safety systems to be disabled during this time, this must be stated on the form. The form will then be signed off by the Property Manager, ensuring that this work complies with building standards and guidelines. Prior to the work starting, your contractor must provide copies of licenses and insurance to Transwestern Commercial Services. After the work is fully executed, your contractor must execute a Release of Lien. This document serves to evidence that the contractor has received full payment for their work and protects you and the Landlord against any lien claims. Depending on the scope of the work, we may also require drawings, which clearly delineate the scope of work, and a building permit to be provided prior to the work starting. Insurance Contractors and their Subcontractors shall provide insurance coverage in accordance with the requirements of the Management. A Certificate of Insurance evidencing the required coverage shall be submitted by the Contractor to Property Management prior to the commencement of the work. The Certificate shall name the following as additional insured: Transwestern Commercial Services and EFH Properties Company. and Its direct and indirect subsidiaries, Inc. (1601 Bryan Street, Dallas, Texas 75201) must name as Certificate Holders. The following regulations establish the minimum criteria for all construction activities on the property. The regulations are subject to change and Contractors will be notified of changes that affect their work. Transwestern Commercial Services (Management) requires strict compliance with these regulations. Prior to the commencement of any work, this section must be read by both Tenant and Contractor and a signed acknowledgement must be turned in to Building Management. Access Security Contractor shall sign in and out all construction personnel with the Lobby Attendant at the start and end of each workday. Work Affecting Adjacent Spaces or Requiring Use of Freight Elevator Adjacent Space: Request for approval 24 hrs. prior to any work, that will require access to adjacent lease spaces. Building Systems: Requests for approval 24 hrs. in advance of any, work which shall require the impairment or alteration of any building system. Freight Elevator: Freight Elevator Request shall be submitted for approval 24 hrs. in advance of any extensive use requirements for the freight elevators (i.e. stocking material, removing trash). Freight elevator, affected public corridors, doors, and doorjambs must be protected with padding. Personnel Construction personnel shall use the freight elevators at all times. Only Contractor's supervisory personnel may use the passenger elevators. Alcohol, drugs, smoking and pets are not permitted on the property or within the building. Construction Personnel found to be in the possession of or under the influence of drugs or alcohol are subject to immediate removal from the property and banned from further work on the property. Contractor personnel are not permitted to use vending machines inside the tenant spaces, or table, and chairs in common areas provided for the use of the building tenants. Contractor’s staff must wear a shirt with contractor’s logo. Contractor’s staff must be respectful of tenants. Use of foul language, rude behavior or vandalism by Construction personnel will result in immediate removal from the property and may be banned from further work on the property. Parking will not be provided in the building. Housekeeping All common areas shall be kept clean at all times. These areas include but are not limited to common corridors, restrooms, stairwells, lobbies, elevators, loading dock, and the grounds. Lobby areas are to be vacuumed at end of each work shift. Construction debris and trash shall be removed from the jobsite as soon as possible. Building Management reserves the right to require trash removal on demand. Construction debris and trash shall not be stored for any period of time in mechanical rooms, freight lobbies, adjacent spaces or any other location outside of the jobsite. Contractors must furnish sealed trashcans to be used for food-related trash to prevent insect and rodent infestation. All trash removal shall be scheduled for weekends, or Monday through Friday between the hours of 6:00 p.m. and 7:00 a.m. Contractor shall provide walk off mats at each exit from the jobsite. Mats shall be maintained or replaced as necessary to prevent construction dust from being tracked throughout the buildings. Mechanical and Electrical rooms shall be broom cleaned daily. Panel covers shall be replaced on all active electrical panels daily. Cleaning of paintbrushes, spackle knives, tools and buckets are permitted only in the slop sink in the janitor’s closet. No contractor is permitted to use the building’s equipment, ladders or tools. Building Systems/Facilities Fire Sprinkler Systems Contractor shall notify Building Management 24 hours in advance of any work affecting the sprinkler system. Contractor shall check in with the Chief Engineer immediately prior to commencement of the sprinkler work. Chief Engineer shall accompany Contractor and tag impaired devices. When notified by the Contractor, impaired device tags shall be removed by Chief Engineer after the work is complete and the system is operational. Sprinkler Standpipes or risers may not be drained or remain empty between the hours of 7:30 a.m. and 6:00 p.m. Sprinkler feed mains, cross-mains and branch lines shall be drained after 7:30 a.m. on regular business days only and must be refilled by 5:00 p.m. each day. Exceptions require approval of Building Management. The Contractor may incur additional cost for Building Management personnel when these steps are not followed. Building Systems/Facilities Fire Alarm Contractor shall not conduct any activities that will activate the building fire alarm system prior to the implementation of precautionary measures to prevent false alarms. Contractor shall be charged $250.00 per occurrence in the event of false fire alarms caused by smoke detectors that have not been taken out of service prior to the work in accordance with the following procedures. Contractor shall notify Building Management in advance of any activities that will require impairment of any smoke detectors. Smoke detectors will be taken out of service by Building Management. Contractor's personnel shall not disable smoke detectors for any reason. Contractor shall notify Building Management or Security when the work is finished and shall not leave the project until all smoke detectors are back in service. The building’s fire alarm contractor must perform the final connection to the building’s fire alarm system. Please coordinate with Chief Engineer. The Work The work shall not begin prior to authorization by Building Management. A copy of the building permit and the contractor’s certificate of insurance must be provided before work can commence. All work must be performed in accordance with all of the applicable codes and regulations (including but not limited to OSHA). Contractor is required to use Lock Out/ Tag Out procedures as required by OSHA. Contractor is to furnish Lock Out/ Tag Out supplies, if needed. Noisy Work: Noisy work shall be performed between 6:00 p.m. and 7:00 a.m. or on weekends regardless of the location in the building. Noisy work includes but is not limited to drilling, grinding, shooting stud track or ceiling hanger wires, and the use of power saws. Welding: All welding shall be performed between 6:00 p.m. and 7:00 a.m. and procedures for venting fumes shall be approved by Building Management twenty-four (24) hours prior to commencement of the work. Contractor is to have an adequate fire extinguisher and blankets available at all times. Noxious fumes: All work that will produce noxious fumes (i.e. oil based or spray painting and sizing) shall be performed after 6:00 p.m. and shall be finished with ample time to clear the air of the fumes prior to 7:00 a.m. weekdays, or on weekends. The Work (continued) Building Management reserves the right to stop any work that is disruptive to the tenants in the building.Contractor shall work in harmony with other Contractors and Subcontractors performing work in the building on behalf of Building Management or other tenants. Contractor shall maintain an active and current safety training and record keeping program and require his Subcontractors to do likewise. Contractor shall notify Building Management twenty-four (24) hours in advance of ceiling close-in so that Building Management will have the opportunity to inspect the work. Signs or logos will not be permitted without prior approval of Building Management. Demolished materials are property of Manager unless noted otherwise. Any penetrations of the slab require the slab to be first x-rayed, which is to be performed after normal business hours and coordinated with engineer. General contractor’s superintendent is required to supervise all related project work on a full time basis. Subcontractors Only those Mechanical, Electrical, Plumbing, Fire Sprinkler, Security and Fire Alarm subcontractors which have been approved by Management may perform work on the project. Qualified journeymen only can perform work on HVAC equipment. Building Facilities Contractor will only use the Lower B-1 Level restrooms. Restrooms, toilets, maids’ closet, washbowls and other apparatus shall not be used for any purpose other than that for which they were designed. Any expenses for repair of damage to the above shall be borne by the Contractor. Thermostats/HVAC System Existing thermostats and induction units (or the like type of equipment) shall be protected during demolition and construction to prevent malfunction of the HVAC operating systems. Contractor will install new filters on fan coil units at end of project. Materials Materials shall be hoisted via the freight elevators. Passenger elevators shall not be used for material transportation. No materials shall be hoisted outside the freight elevator cabs without prior notification and approval of Building Management. All costs associated with material hoisting shall be borne by the Contractor. Materials shall not be stored in the freight elevator lobbies, mechanical rooms or any other common space within the building. Materials shall not be stored in adjacent vacant space without prior consent of management. Dollies, carts and other moving or loading apparatus shall have rubber tires. The expense of any damage caused to floors/wall, etc., by moving materials shall be borne by the Contractor causing the damage. All public areas are to be sufficiently protected in advance by the Contractor to avoid such damage. Freight elevators are available on a first come, first serve basis. The Contractor is advised to contact Building Management 24 hrs. in advance of any hoisting operations that will require extensive use of the freight elevators to determine the availability of the elevators. Materials (continued) Building Management reserves the right to inspect all tool boxes, storage bins, trash bins, or other conveyances prior to removal from the property. The Contractor shall comply with all Federal, State, and Local regulations pertaining to the use of hazardous materials or potentially hazardous materials. No hazardous materials may be used on the property without prior written approval of Building Management. All MSDS sheets must be submitted to Building Management prior to delivery of material to site. All doors, hardware, door frames, light fixtures, HVAC units, air boots, slot diffuses, millwork and appliances to be removed from demolished leases are the property of the building and may be required to be relocated elsewhere in the building. Please contact the Building Management office for direction. Hazardous Materials Spills or Releases If a material cannot be identified, assume it is hazardous. If a hazardous material is released or spilled, there are a few basic responses that must be followed. The following minimum response procedures should be followed regardless of the nature of the incident. Notify Building Management of the incident immediately. State the location of the accident, the type of material released and any actions taken. Evacuate everyone in the vicinity immediately. This includes tenants, contractors, and building personnel. If the release of a dangerous vapor or gas occurs, a larger area of evacuation may be necessary. Once you know the area is cleared, you may take safe and reasonable steps to identify the released materials. If you can identify the materials, small spills of liquids may be limited with sand bags or adsorbents. Isolated fumes or gases may be limited by closing doors or shutting down air handler units in the area. Hazardous Materials Spills or Releases (continued) If the material has not been identified, the Property Manager or Chief Engineer will attempt to use Material Safety Data Sheets to classify the material according to its hazardous properties. If the spill or release is deemed to be a threat to a wide spread area of the property and/or its occupants, then immediately call 911 and ask for the Fire Department HAZMAT Response Unit, then call Building Management. The Building Management office reserves the right at any time to rescind, alter, or waive (in whole or part) any of these Construction Rules and Regulations whenever the management office deems necessary, desirable, or proper in its sole and reasonable judgment. Policies and Procedures: Insurance Protection 1. Worker's Compensation (in statutory amounts) and Employer's Liability (in the amounts of One Million Dollars ($1,000,000) each accident, One Million Dollars ($1,000,000) disease-policy limit and One Million Dollars ($1,000,000) disease-each employee) insurance covering the employees of Contractor in accordance with the laws of the State. 2. Comprehensive General Liability (including contractual liability, bodily injury liability, product/completed operation, and independent contractor's coverage) of not less than One Million Dollars ($1,000,000) per person and One Million Dollars ($1,000,000) per accident, and property damage limits of not less than One Million Dollars ($1,000,000) OR a combined single limit of One Million Dollars ($1,000,000), OR One Million Dollars ($1,000,000) general aggregate. 3. Automobile Liability insurance of not less than One Million Dollars ($1,000,000) per person bodily injury and One Million Dollars ($1,000,000) per occurrence bodily injury and One Million Dollars ($1,000,000) property damage, OR One Million Dollars ($1,000,000) combined single limit. 4. Excess Umbrella Liability coverage in amounts not less than Two Million Dollars ($2,000,000). 5. Such insurance shall be endorsed to name the Owner (TXU Properties, Inc.) and Manager (Transwestern Commercial Services), including affiliates and subsidiaries as Insured, to provide primary coverage for the Owner and Manager, and to provide a cross liability provision. Original rider must be sent to Certificate Holder as evidence of this coverage. 6. Waiver of Subrogation - Each policy, including any umbrella or excess policies, will contain waivers of right of subrogation in favor of Transwestern Commercial Services and TXU Properties, Inc. as only relates to liability arising out of Contractors obligations. 7. Written Notice - Must provide for thirty-(30) days prior written notice in the event of cancellation or material change in policy. 8. Transwestern Commercial Services and TXU Properties, Inc. (1601 Bryan Street, 4th Floor, Dallas, Texas 75201) must be named as Certificate Holders. 9. Such insurance shall be with insurance companies satisfactory to Owner and Manager. 10. Before Contractor performs work at or on premises or delivers materials to site of work, Contractor shall furnish certificates of insurance to Owner and Manager, evidencing the foregoing insurance coverage. 11. Contractor shall maintain all of the foregoing insurance coverage in full force and effect until the work is fully completed. 12. Certificate Holder must receive an original of the document. Copies will be accepted only for short-term verification, but an original must be forwarded immediately. 13. Deductibles - Any and all deductibles in the above-described insurance requirements will be assumed by, for the account of and at the policyholder's sole risk. Please submit the Certificate of Insurance before the commencement of work on the property. If you have any questions, please call Building Management at (214) 812-6060. You are welcome to fax the certificate to (214) 812-6058, but we must receive an original within seven (7) working days. Please mail the original immediately to Transwestern Commercial Services 1601 Bryan Street, 4th Floor, Dallas, Texas 75201. Policies and Procedures: Moving Policy General Information All tenant moves-into, out of, or within the building-must be coordinated with the Building Management office. Please notify the Property Manager of your proposed moving date and to schedule the freight elevator. The moving company must provide a certificate of insurance to the management office at least five (5) days prior to the day of the move. Transwestern Commercial Services also requires that the moving company provide protection for the building floors, walls, and elevators during loading and unloading. If you are not using a moving company, please call the management office for assistance in coordinating the use of the elevator and protection of floors, walls and elevators. In general, moves must be undertaken during non-business hours to simplify access to the building and minimize any disturbance to other tenants. If this is inconvenient, the management office will attempt to accommodate your schedule in every way possible. Move-in IMPORTANT: Please provide 48 hour notification to the Building Management Office when moving bulky materials, office furniture or equipment in or out of the building. All such movement must be pre-arranged with the Management Office. All of the following will be subject to Management’s approval: Time of delivery or movement Method of movement Routing of movement Transwestern Commercial Services and EFH Properties Company. and it’s direct and indirect subsidiaries, Inc. shall not be liable for injury or damages to any person or property involved as a result of tenant deliveries or move-ins. Two and four wheel dollies, carts or other type conveyances (with the exception of baby buggies and wheel chairs) must be taken into the freight elevator only. Only packages, cartons or other items that can be carried by hand may be transported on passenger elevators. Materials that can cause discomfort, inconvenience or damage (such as open paint cans) should not be carried on passenger elevators even when carried by hand. All dollies and conveyances of materials, supplies or equipment will be entered through the loading dock and transported via the service hallway to the freight elevator. When moving furniture or equipment, please provide Building Management with a letter stating the date and time of the move. 48 hour notice is required. If it involves the utilization of a professional moving company, then you must also provide Management with a Certificate of Insurance meeting the Landlord’s insurance requirements from the moving company. It is preferred that the freight elevator be used, but should additional elevators be required, NO elevators are available for moving furniture and equipment Monday through Friday, except Holidays during these times: 7:00 a.m. - 9:30 a.m. 11:00 a.m. - 1:00 p.m. 3:30 p.m. - 6:00 p.m. The tenant will be responsible for ensuring that the building lobby floors (including carpeting, tile, marble and wood) are protected during the move. Any move-ins or outs after building hours, during holidays or on weekends must be attended by security at the tenant’s expense. The freight elevator may only be operated by a member of the building staff and is at the expense of the tenant. There is a minimum 4-hour charge for these services. Moving Company Requirements Prior to the day of the move, your moving company must provide a Certificate of Insurance. (Please see Insurance section) Building Management will inspect your move-in route to your suite before and after your move. We suggest that your move coordinator attend the walkthrough. Tenants are responsible for their moving company by: Scheduling arrivals and departures Supervising help Providing access to restrooms Making repairs to building damages and/or reimbursement for costs Removing all packing materials Requiring placement of rigid boarding over the pathway to and from the elevators and office. Protecting wall corners with shields Keeping elevators padded Using established service routes and access doors Prohibiting the use of the main lobby without special approval and preparation Notifying Building Management for answers to any questions related to the building. A Security Officer and/or janitorial member to run the freight elevator, at the tenant’s expense, must attend any move-ins or outs after building hours, during holidays or on weekends. Policies and Procedures: Smoking Energy Plaza provides a smoke-free building and campus. Smoking is not permitted anywhere on the property. Per Dallas City Ordinance 27440 smoking is not allowed within 15 feet of any entrance to an indoor or enclosed area. Violators will be reported to management of the appropriate company. Electronic Cigarettes Use of electronic cigarettes is not permitted in the building. Designated Smoking Area A designated smoking area is located on the Federal Street Parking lot. Policies and Procedures: Tenant Functions and Guidelines If you are planning a function (e.g., party, reception), please notify Building Management at least two (2) weeks in advance. Building Management maintains certain policies and procedures that assist in coordinating events and limiting liability of the building. Building Management may ask for the following: date and time of event, number of guests, presence of alcohol, parking requirements, overtime HVAC requirements, service elevator use, janitorial needs, electrical requirements (for sound equipment), security requirements, and certificates of insurance. Typically, functions may not be held in the common areas or on the building grounds.
