 April 2014 – June 2014 – 5 bargaining sessions with School

 July 2014 – Determination of Impasse by state
 August 2014 – September 2014 – 3 mediation sessions with
state mediator, no
settlement
 October 2014 – Parties are certified to Fact-finding
 October 2014 – Fact-finding panel members and Neutral
appointed
 December 3, 2014 – First scheduled Fact-finding date.
Rescheduled by the Neutral.
 January 9, 2015 – Second scheduled Fact-finding date. Request to reschedule





made by the District. District request was based on the following
reasons;
January 9 is also the date of Governor Brown’s release of the Proposed
Budget for 2015-16
County Office of Education has challenged the District’s financial
condition
County Office of Education has notified the District of a $2.9 million
penalty that will be imposed due to a failure to make the minimum
percentage towards the classroom in 2013-14
The District has released it Fiscal Services Director and the Asst. Supt
of Business within the last several months
The District has two new board members that need to be brought up to
date on the budget and the status of negotiations
 Association made an argument against rescheduling. The Neutral ultimately made
the decision to allow the date to be rescheduled.
 February 13, 2015 – Third scheduled Fact-finding date.
Request to reschedule made
by the Association because of schedule
conflict with Association representative
who would be making the presentation
on behalf of the Association at the Factfinding hearing.
 February 23, 2015 – Fourth scheduled Fact-finding date.
 The Fact-finding hearing is presided over by the Neutral. The
Neutral decides what the hearing will look like – order of
events, length of time given to presentations, etc.
 The Neutral must use the following criteria in making
decisions;
 State and Federal laws
 Stipulations of the parties
 Interests and welfare of the public and the financial ability of the public
school employer
 Comparison of the wages, hours, and conditions of employment
 Consumer price index
 Any other facts that should be taken into consideration
 Both sides will make a presentation on the following items;
 Overview of the District, Association History, Bargaining History
and Comparable Districts
 The issues that are in dispute
 District Finances
 Both sides will be able to follow-up with rebuttal questions
 The Panel will convene to discuss the presentations and
next steps – Mediation is often one of the next steps

 Settlement prior, during, or after fact-finding
 Mediated settlement by Neutral the day of fact-finding
 No settlement at Fact-finding and the Neutral writes a report. The
Neutral has 30 days after the hearing to write the report. The report is
not binding on either party.
 No settlement after the release of the report – ADTA is able to legally
strike.
The best option is to organize for a settlement as early in
the process as possible. Fact-finding does not solve the
problem – Organizing does!
