The intending allottee shall pay the Stamp Duty, Registration Charges and all other incidental charges for execution of conveyance deed in favour of the intending in allottee. No cost shell borne by the company. 1. THAT the intending allottee(s) has applied for registration for allotment of the Residential Plot in "Sainik Residency", Greater Noida, with full knowledge of laws, notifications and rules applicable to this area. 2. THAT the intending allottee(s) has fully satisfied himself/ herself about the interest and title of the Company in the Residential Plot comprised in VPRPL. 3. THAT the intending allottee(s) shall pay to the Company the amount as per the Payment 16. The intending allottee shall get his/her complete address registered with the Company at the time of booking and it shall be his/her responsibility to inform the Company by registered AID letter about all subsequent changes, if any, in his/her address. 17. In all communications with Company the reference of unit booked must be mentioned plan listed in the Company's price list. 4. THAT the time of payment of installments as per the payment plan shall be the essence of this transaction. It shall be incumbent on the intending allottee(s) to comply with the terms of payment and other terms and conditions of allotment and sale. In case, the payment of any installment is delayed, the intending allottee(s) shall be liable to pay interest, calculated from the due date of the outstanding amount @ 18% p.a. compounded every quarter. However, if the intending allottee(s) fails to pay any installment(s) with interest within 90 days, from due date, the Company shall have the right to forfeit the entire amount of Registration money deposited by the intending allottee(s) and in such a case the allotment of the said Residential Plot, shall stand cancelled and the intending allottee(s) shall be left with no right or lien on the said Residential Plot. The amount paid, if any, over and above the Registration money shall be refunded by the Company without interest after adjustment of interest accrued on the delayed payments(s), if any, due from the intending allottee(s). 5. It is specifically understood by the intending allottee that the Company may incorporate clearly. 18. THAT possession of the Residential Plot shall be taken over by the allottee(s) after execution of the conveyance deed/Possession Letter. 19. THAT the Company shall have the first lien and paramount charges on the Residential Plot until the entire Sale Consideration and other charges have been paid and all legal formalities completed. 20. THAT the intending Allottee(s) is entitled to get the name of his/her nominee substituted in his/her place, with prior approval of the Company, provided the intending Allottee(s) has paid at least 50% of the total Sale Consideration to the Company, who may in its discretion permit the same on such conditions as it may deem fit and proper and as per the guidelines issued by the local Authorities, if any, in this regard. 21. THAT the intending allottee(s) undertakes to abide by all the laws, rules, regulations, bylaws, guidelines & instructions issued by the Government or other authorities and made applicable to the said complex. 22. THAT the intending Allottee(s) shall solely be responsible for compliance with all applicable laws, notifications, guidelines, etc. for purchase of immovable property in India at Uttar Pradesh. 23. THAT the refund/cancellation of the booked unit(s) is subject to T & C/ policy of the company, whether applicable time of payment of cancelled amount is subject to company policy and 15% of the total received amount will be charged/ deduct on account of administration charges of the Copmpany 24. THAT Allottee(s), if residing outside India, shall solely be responsible for complying with the necessary formalities as laid down in Foreign Exchange Management Act (FEMA) 1999, RBI Act and Rules/Guidelines made/issue d there under and all other applicable laws includin g that of re mittance of payment, acquisition/sale/transfer of immovable properties in India. The Allottee(s) understands and agrees that in the event of any failure on his/ her/their part to comply with the prevailing FEMA as amended from time to time, the Allottee(s) shall keep the Developer Company fully indemnified and harmless in this regard. Whenever there is any change in the residential status of the Allottee(s) subsequent to the signing of this Agreement it shall be sole responsibility of the Allottee(s) to intimate the same in writing to the VPRPL immediately. 25. THAT the allotment of Apartment is the discretion of the company and the company has a right to reject any offer/application without giving any cause at any stage of the project. 26. THAT Delhi Courts alone shall have the jurisdiction in all matters arising out of and/or toughing or concerning this transaction. If as a result of any rules or directions of the Government or any Authority of if the competent authority delays, withholds, denies the grant of necessary approvals for Project or due to force majeure conditions, the Company after provisional and/or final allotment is unable to deliver the unit to the intending allottee the Company shall be liable only to refund the amounts received from him/her with interest as mentioned in the Buyer Agreement/ Allotment Letter. 7. THAT basic price of the Residential Plot is firm. 8. THAT all taxes and statutory shell be charged extra. 9. THAT if for any reason the Company is not in a position to allot the Residential Plot applied for, the Company shall be responsible only to consider alternative property or refund of the amount deposited. However, the Company shall not be liable for any compensation on this account. 10. THAT the Company shall have the right to effect suitable and necessary alterations in the layout plan, if and when found necessary. Such alterations shall be binding on the Purchaser(s). The alterations may include change in location, number, boundaries and area of the said Residential Plot. 11. In case there are joint intending allottees, all communications shall be sent by the Company to intending allottee whose name appears first and the address given by him/her for mailing and which shall for all purposes by considered as served on all the intending allotters and no separate communication shall be necessary to the other named intending allottee. 12. The allottee shall not use the premises for any activity other than the use specified for. 13. The intending allotted shall abide by all the laws, rules and regulations applicable to the said unit and/or project. 14. The intending allottee shall not be entitled to get the name of his/her nominee substituted in his/her place without the prior approval of the Company. Such approval shall be granted on payment of administrative charges as prescribed by the Company.
