The rates of royalty for minor minerals are determined by the state government and the project proponent / lessee has no locus standii over this exclusive policy matter. It is the policy matter of the state and the view of the public shall be communicated Shree Pankaj Sharma, R/o Pali By auctioning lease for mining of bajri to one person only, there would be adverse impact to the environment. It would have been better if the lease were granted to 3 to 4 parties / contractors. By resorting to e-auction the letter of intent has been granted to the P.P. for the single riverbed mining project under the tehsil with the view to control the illegal mining and also with the sole objective for carrying out the sustainable project activity by protecting the environment. It is the policy matter of the state and the view of the public shall be communicated - Shree Ramlal, Sarpanch, R/o Thakurla The copy of the lease be make available to the concerned gram sabha Shree Shanker Jangaid Where the plantation is proposed and with whom the responsibility of maintenance rests with. At this juncture no lease deed has been entered with the P.P. However the P.P. can produce the copy of LoI on the asking of the gram sabha. The plantation shall be carried out as per green belt development plan contained in the EMP. The PP shall be responsible for the maintenance of the plantation carried out during the project period. As per approved mine plan, the transportation of minerals shall be carried through covered trucks and overloading avoided beyond the stipulated capacity. It is the responsibility of the state mine department and the transport department to ensure no overloading of trucks. For effective control on overloading of trucks, the Hon’ble High Court of Judicature for Rajasthan at Jaipur Bench vide Judgment dated 14.08.2014 has made the P.P. solely responsible and passed instructions to other departments like mining , transport and police to The PP shall show the copy of LoI / Lease deed if demanded by the gram sabha. - The PP shall be responsible for the maintenance of the plantation during the project period. Section 9.3 (Green Belt Development Plan – Rs. 11 lac per annum) Approved mining plan shall be strictly complied with. Periodical checking of loaded trucks at proper “Naka” shall be carried out by mining as well as transport department. Section 4.10.2 Shree Raju, R/o Rupawas No overloading of the trucks should be allowed and these shall be covered to avoid spilling of minerals. Action Plan Reference in EIA Doc - Shree Sardar Banjara, R/o Devaliya Management Plan should be made available to the gram sabha. The work stipulated under the management plan shall be discussed with the concerned gram sabha and undertaken after taking them into the confidence. It is policy matter of the state and thus no action rests with the P.P. In general the water table of neighboring area gets lowered in case of mining in the bed of influent river which is not the present case as the river(s) in question are ephemeral in nature. During monsoon and in post monsoon season the water table rises in comparison to premonsoon water depths. The mining upto 3 m is envisaged in the approved mining plan. The EIA document vouches for deployment of manpower indigenously available during the lease period. The work proposed under CSR initiative shall be carried out after taking locals into confidence. Section 9.2.6.1 (CSR Activities – Rs. 20 lac) - - Approved mining plan shall be strictly complied with. Section 2.10 and Section 4.5.1 The local people shall get the employment for executing mining activities as well as labour oriented works under the management plans. Section and 8.3.1 4.9
