Proposed Alimony Work Product: Meeting and discussion held in conjunction with
the Legislative Committee. All votes by Executive Council on alimony work product
were preceded by vote by Legislative Committee. Presentation by Thomas Sasser.
Discussion led by Thomas Sasser, Abigail Beebe and Christopher Rumbold.
a. Motion (1): Does body agree in concept with moving forward with proposed
legislation? Motion carries. 23/ in favor; 3/ opposed; 0/abstentions.

b. Motion (2): Does the body agree with paragraph 1 (removing only the word
“present” in paragraph 1(a))? Motion carries. 26/ in favor; 0/opposed;
0/abstentions.
c. Motion (3): Does the body agree with paragraph 2 as written with grammatical
corrections noted (addition of “presumptive” before “alimony duration”, add
apostrophe, add comma)? Motion carries. 25/ in favor; 1/opposed;
0/abstentions.
d. Motion (4): Does the body agree with paragraph 3 as modified and with
corrections (break down paragraph into 3(a) (existing language) and (b)
language similar to “after determining the alimony award and considering any
deviation factors, the payor has the present ability to pay the amount
awarded”; change “ranges” to “range” in line 2 of paragraph 3; replace “and”
with “or” in line 8; replace “one or more” with “all” in line 8; add “upon which
evidence was presented” to the end of line 8; add “reasonable” after “her” in
line three of existing paragraph 3(a); replace “vocation” with “vocational” in
existing paragraph 3(f); change colon in existing paragraphs 3(g) and 3(i) to
semi-colons; add new paragraph (m)(which would be a number upon relettering consistent with motion) to reflect language similar to “tax issues

e. Motion (5): Does the body agree with paragraph 4 as revised (delete “except
that a determination of potential income shall not be made for a party who is
completely physically or mentally incapacitated or is caring for a child under
the age of thirty months for whom the parties owe a joint legal responsibility
or if” and insert “unless” in its place)? Motion carries. 27/ in favor;
0/opposed; 0/abstentions.
f. Motion (6): To change the language in existing paragraph 5(b)(11) to language
similar to “Trust income or distributions regularly received, relied upon, or
readily available to the beneficiary.” Motion carries. 16/ in favor; 9/opposed;
0/abstentions.
g. Motion (7): To approve paragraph 5, including paragraphs (a) and (b) with
nonsubstantive changes (renumber from 5(b)(3); delete “held in or” from
5(b)(19); add “or benefits after “payments” in existing 5(b)(22), with change to
existing paragraph 5(b)(21) to comport with Zold v. Zold? Motion carries. 25/
in favor; 0/opposed; 0/abstentions.

m. Motion (13): To approve paragraph 6 as modified (modify to include a
codification of existing law regarding recipient spouse’s potential earning
capacity in a nominal alimony situation after the first sentence; delete
“amount” in line 2 and replace with “alimony”; delete “The duration of the
nominal alimony shall be established within the presumptive durational range
based upon the length of the marriage.”; add “Prior to expiration,” at the
beginning of the last sentence in the paragraph; add “as to amount and
duration” before “to a full alimony” in the second to the last sentence; add “in
61.08” after “alimony guidelines” in the second to the last sentence and move
“in accordance with s. 61.14 to after “modified” in the same sentence? Motion
carries. 26/ in favor; 0/opposed; 0/abstentions.
n. Representative Ritch Workman Introduced. Product discussed. Workman
indicates that the following are his interests:
i. Wants to eliminate the gamesmanship in the supportive relationship
scenario.
ii. Tom raises the issue of retroactive application and Workman explains his
position.
iii. Wants declining insurance under specific circumstances.
iv. Wants an individual to be able to retire
v. Wants to eliminate the gamesmanship in the area of attorney’s fees.
vi. Modification – He does not believe the law should provide the basis to
modify an award and would like to see a modification based on existing
law without regard to term of award.

Secretary’s Report:
Motion (14) (by Rob Jones) to approve the Executive Council minutes from the
meeting of September 20, 2014. Approved – majority.
IV.
Treasurer’s Report (Laura Davis Smith): Motion to adopt proposed budget for 20152016. Approved unanimously.
V.
Chair’s Report (Norberto Katz): David Garfinkel has resigned and applications will be
solicited; once submitted, nominations will take place and will be announced at a live
Executive Council meeting the first week of December. There will be an email vote to fill
the vacancy. Final approval of the alimony product will take place at the next Executive
Council meeting. Discussion had over “rapid response” alimony team.

Closing Remarks and Adjournment – Motion 15 (by Rob Jones) to adjourn. Approved.

Good-Bye Excursion—Culebra “Get Away”*
Culcbra “Get Way”; After a fast power-cat ride of less than an
hour, we anchor off the west coast of Culebra at the incredible
reef area of “Carlos Rosario” or the Luis Peña underwater
nature preserve for about 1 ½ hours of some of the best
snorkeling anywhere! We’ll then move on to our beach stop
at world famous Flamenco Beach. Depending upon the sea
conditions, sometimes we will go to Culebrita, a tiny islet
off the east coast of Culebra, with a stunning ½ mile long
horseshoe beach. Truly off the beaten path! In either location,
it is a short swim into the beach and there are more great
snorkeling opportunities. Here you’ll enjoy a sumptuous buffet
lunch on board our catamaran, complete with Piña coladas or
Rum Punch. You’ll spend the rest of the afternoon snorkeling,
beachcombing along this spectacular beach or relaxing on our
roof deck. This is the perfect combination for avid snorkelers
and beach connoisseurs to enjoy Culebra’s colorful reefs,
spectacular white sands, and awesome turquoise blue waters.
At around 3:00 pm, we depart Culebra, cruising along the
Marine Cordillera (island chain) on the way back to Fajardo. Arrival time back at Marina Puerto Del Rey
is 3:45 pm. We provide quality snorkeling gear, and underwater cameras are available on board for
sale. Please bring towels, sunscreen and wear light clothing over a swimsuit.
