DUMPING COMMODITY REGISTER 7604.10.00(1) R. 24 ALUMINIUM EXTRUSIONS EXPORTED FROM THE PEOPLE’S REPUBLIC OF CHINA Measures Anti-dumping measures in the form of interim dumping duty (IDD) and interim countervailing duty (ICD) have been imposed on aluminium extrusions exported from the Peoples Republic of China (China). Description of the goods The aluminum extrusions covered by measures: are produced by an extrusion process; are of alloys having metallic elements falling within the alloy designations published by The Aluminium Association commencing with 1, 2, 3, 5, 6 or 7 (or proprietary or other certifying body equivalents); have finishes being: as extruded (mill); mechanical; anodized; or painted or otherwise coated, whether or not worked; have a wall thickness or diameter greater than 0.5 mm; have a maximum weight per metre of 27 kilograms; and have a profile or cross-section fitting within a circle having a diameter of 421 mm. Goods subject to measures should be classified using the tariff sub-headings and associated statistical codes contained in Table 1. Exemption type ‘SUPPLIER’ applies to aluminium extrusions manufactured by Tai Ao and either exported directly by Tai Ao or supplied through Phoenix Endeavour Ltd. There is one exporter exempt from IDD only: Guangdong Zhongya Aluminium Company Limited (Guangdong Zhongya formerly known as Zhaoqing New Zhongya Aluminium Co Ltd). ICD will apply to aluminium extrusions manufactured by Guangdong Zhongya and either exported directly by Guangdong Zhongya or supplied through Zhongya Shaped Aluminium HK Holding Ltd. All other exporters are subject to IDD and ICD measures as advised in Table 3 below. Dates of Effect IDD and ICD were initially imposed on 29 October 2010 and were last revised on: 27 August 2011 – following reinvestigation; 21 November 2012 – following an accelerated review for Wuxi Xisha Photoelectric Aluminium Products Co Ltd 11 October 2013 – following a Federal Court decision 18 December 2013 – following an accelerated review for Guangdong Jinxiecheng Aluminium Manufacturing Co Ltd (Guangdong Jinxiecheng) and; 28 November 2014 – following an accelerated review for Zhaoqing Xinlianchang Metal Corporation Ltd (Zhaoqing Xinlianchang). Reflecting the Federal Court Orders, the changes to the anti-dumping measures related only to aluminium extrusions exported by Tai Shan City Kam Kiu Aluminium Extrusion Company and Panasia Aluminium China. No changes were made to the anti-dumping measures applicable to other Chinese exporters of aluminium extrusions. Australian Dumping Notice (ADN) 2013/80 provided further information to assist affected importers and Customs brokers. Change 03/02/2015 DUMPING COMMODITY REGISTER 7604.10.00(2) ALUMINIUM EXTRUSIONS EXPORTED FROM THE PEOPLE’S REPUBLIC OF CHINA Dates of Effect (continued) The accelerated review applied resulted in the imposition of exporter specific anti-dumping measures applying to aluminium extrusions exported by Guangdong Jinxiecheng. ADN 2013/74 provides further information to assist affected importers and Customs brokers. The accelerated review for exports of aluminium extrusions by Zhaoqing Xinlianchang resulted in the imposition of exporter specific anti-dumping and countervailing measures. ADN 2014/131 provides further information to assist affected importers and Customs Brokers. Identifying the goods subject to measures Table 2 provides guidance to importers and brokers to assist in the categorisation of aluminium extrusions into the types covered by interim duties (GUC), and those not covered (Non GUC). In most cases, extrusions classified to headings 7604 or 7608 would be subject to IDD and/or ICD. Importers should use the table to categorise their goods and decide whether dumping and countervailing duties apply. For example, shower frame kits, window frame kits, unassembled unitised curtain walls Unglazed window or door frames 7 Fully assembled finished products containing aluminium extrusions Windows, doors Direction for collection of IDD and ICD Goods subject to the measures must be entered using the relevant dumping specification number (DSN) for the nominated exporter/supplier as shown in Table 3 and the export price terms shown in Tables 6 and 7. PLEASE NOTE: The All Other Exporter rate of ICD and/or IDD will apply unless an importer/broker can provide proof that the goods are being supplied either directly by a named exporter or through a linked supplier(s). The IDD for all exporter/suppliers except Guangdong Jinxiecheng and Zhaoqing Xinlianchang is in the form of a fixed + variable measure. The IDD liability is calculated as follows: the dumping export price (DXP) or ascertained export price (AEP), whichever is the greatest, multiplied by the IDD ad valorem duty rate; Plus the amount, if any, by which the DXP is lower than the AEP. For Guangdong Jinxiecheng and Zhaoqing Xinlianchang, the IDD is in the form of a floor price. The IDD liability is calculated as the difference between the DXP and both the normal value and the non-injurious price (NIP) and is payable only where the DXP is less than both the normal value and NIP. The ICD for all exporter/suppliers is in the form of a fixed measure. The ICD liability is calculated by multiplying the DXP by the ICD ad valorem duty rate. DUMPING COMMODITY REGISTER 7604.10.00(3) R. 29 ALUMINIUM EXTRUSIONS EXPORTED FROM THE PEOPLE’S REPUBLIC OF CHINA Release of details of measures Unless otherwise advised, the rate of IDD and the AEP for each DSN in Tables 6 and 7 are considered Confidential and will not be published. Bona fide importers of the goods may be provided with the confidential information relevant to a nominated exporter/supplier or country in the case of country wide measures. The onus is on the importer to prove their bona fides by providing evidence of the following to [email protected]: a previous trading history with a nominated exporter/supplier of the goods from a country subject to dumping/countervailing measures. Evidence of a trading history would take the form of at least commercial invoices, packing list and bills of lading from previous shipments. Additional documentation as proof of bona fides may also be requested. in the absence of a trading history, an offer or a quotation from an exporter/supplier of goods subject to dumping/countervailing measures. The offer or quotation must be on the exporter/supplier’s company letterhead – emails will not generally be accepted. or Importers should note that only as much of the confidential information as is necessary to enter the goods will be provided. ACDN 2012/61 provides further information to assist importers and Customs brokers. The Australian Customs and Border Protection Service (ACBPS) will conduct monitoring of imports subject to anti-dumping measures consistent with its published policy. Duty Assessment Where anti-dumping measures have been imposed on goods exported to Australia, the importer is liable to pay IDD and/or ICD at the time of importation. The rates of IDD and/or ICD are based on prices verified during the original dumping investigation or subsequent review of the duty and are in place for a period of five years unless revoked earlier. To ensure that the amount of IDD and/or ICD collected by ACBPS does not exceed the actual dumping and/or subsidy margin for each consignment over the five-year period, provision exists for assessment of the final duty liability under the Customs Tariff (Anti-Dumping) Act 1975. This system allows for any excess interim duty to be refunded where it is found that prices have changed since the original investigation or subsequent review. There are a series of time frames fixed by legislation that govern the duty assessment system. An application for duty assessment must cover all shipments entered for home consumption by an importer in a specific six-month importation period. The six-month period is determined by the date of publication of the initial notice imposing the dumping duty. Where securities have been taken pending the Minister's decision, the importation period may be less than six months. An application for a duty assessment cannot be lodged prior to the end of the particular importation period to which it relates, but must be lodged with the Anti-Dumping Commission within six months from the end of that importation period.
