UOBM TV STARBUY INSTALMENT PAYMENT PLAN TERMS AND CONDITIONS UOBM CREDIT CARDS Eligibility 1. United Overseas Bank (Malaysia) Bhd (271809-K) (“UOBM”) Starbuy Instalment Payment Plan (“Promotion”) is open to all eligible UOBM principal and supplementary Credit Cardmembers (“Cardmembers”) whose account(s) are current, valid, subsisting and in good credit standing as may be determined by UOBM at its sole and absolute discretion. 2. This Promotion is only applicable to UOBM Credit Cards issued in Malaysia. 3. The following shall not be eligible for the Promotion:a. Cardmembers whose account(s) are terminated, suspended or cancelled within the Promotion Period; b. All UOBM Debit, Private Label, Business, Purchasing and Corporate Cardmembers; c. Any accounts held with UOBM that are delinquent or unsatisfactorily conducted as determined by UOBM at its sole and absolute discretion; and d. Persons who are or become insane, deceased, adjudicated bankrupt or have legal proceedings of any nature instituted against them. 4. The Promotion is only valid from 1 February 2015 to 30 April 2015 (both dates inclusive) (“Promotion Period”), unless otherwise notified. Promotion Mechanics 5. To be eligible for this Promotion, the Cardmembers are required to purchase any of the Sharp or Sony products and/or services listed in “UOB STARBUY- TV” product brochure at the purchase price offered to Cardmembers only (“Purchase Amount”) and successfully convert their purchases into a 12-months 0% interest-free Installment Payment Plan by completing and submitting the UOB STARBUY Installment Payment Plan Form (“Form”) by mail to: TRI-E MARKETING SDN BHD, A-5-35, IOI Boulevard, Jalan Kenari 5, Bandar Puchong Jaya, 47170 Puchong, Selangor, Malaysia or fax to 03-80763232 within the Promotion Period (“Qualification Criteria”). 6. For Sharp’s product, each Cardmember would be considered to have successfully satisfied the Qualification Criteria set out in clause 5 above upon the posting of the first and second instalment payment to the Cardmember’s UOBM Credit Card Account and such Cardmember shall be eligible to the rebate specified in the “UOB STARBUY-TV” product brochure which is equivalent to two (2) months instalment payment amount (“Rebate 1”) and one of the instalment payment amount under Rebate 1 will be credited to Cardmember’s UOBM Credit Card Account within six (6) to eight (8) weeks from the posting of the first instalment payment to the Cardmember’s UOBM Credit Card Account and another one of the instalment payment amount under Rebate 1 will be credited to Cardmember’s UOBM Credit Card Account within six (6) to eight (8) weeks from the posting of the second instalment payment to the Cardmember’s UOBM Credit Card Account. 7. For Sony’s product, each Cardmember would be considered to have successfully satisfied the Qualification Criteria set out in clause 5 above upon the posting of the first instalment payment to the Cardmember’s UOBM Credit Card Account and such Cardmember shall be eligible to the rebate specified in the “UOB STARBUY-TV” product brochure which is equivalent to one (1) month instalment payment amount (“Rebate 2”) and the Rebate 2 will be credited to Cardmember’s UOBM Credit Card Account within six (6) to eight (8) weeks from the posting of the first instalment payment to the Cardmember’s UOBM Credit Card Account. (Rebate 1 and Rebate 2 collectively referred to as the “Rebate”) 8. By submitting the Form in accordance with clause 5 above, the Cardmember agrees, consents and allows UOBM and Tri-E Marketing to provide its appointed agent – logistic company with the Cardmember’s name, address and contact number in order to fulfill the Cardmember’s request. 9. The prices quoted in the “UOB STARBUY-TV” product brochure are inclusive of delivery charges. 10. The fulfillment of products are strictly on first-come, first-serve basis within four (4) to six (6) weeks from the date the order was received and would be delivered by courier to the Cardmember’s delivery address set out in the Form. No delivery will be made to P.O. Box addresses or overseas addresses. UOBM will not entertain any requests for collection of products from any UOBM branches. 11. UNIRinggit rewards or SMART$ will not be awarded under this Promotion. 14. UOBM shall not be liable for any claims, losses, expenses incurred or damages that may be suffered by the Cardmember in any manner as the result of purchasing the products including and not limited to loss, damage or non-delivery of the products by Tri-E Marketing. UOBM shall also not be liable as a result of any defects or dissatisfaction with the quality of the products. 15. The Cardmember’s information will be used only for this Promotion and will be destroyed after the fulfillment of the products is completed. 16. At the time of awarding the Rebate, the Cardmember’s UOBM Credit Card Account(s) must be current, valid, subsisting and in good credit standing as may be determined by UOBM at its sole and absolute discretion and not in breach of any of the terms and conditions contained in the UOB Visa/MasterCard Cardmember Agreement (“Cardmember Agreement”). 17. The Rebate is not transferable to any other party or parties other than the Cardmember. 18. UOBM reserves the right: (a) To forfeit the Rebate in the event where there is a cancellation of the purchase under the Promotion or termination of the Cardmember’s Credit Card during the Promotion Period, or non-compliance or breach of these terms and conditions, the Instalment Payment Plan (“IPP”) terms and conditions and/or the Cardmember Agreement, with prior notice without assigning any reason; (b) To withdraw, suspend, extend or terminate earlier the Promotion prior to the expiry of the Promotion Period in whole or in part, at anytime with prior notice at its absolute discretion. 19. By participating in the Promotion, the Cardmembers agree to be bound by these terms and conditions and the IPP terms and conditions. 22. UOBM shall not be responsible for any failure or delay in transmission of sales transactions by Visa International Incorporated, MasterCard Worldwide, merchant establishments, postal or telecommunication authorities or any party in which may result in the Cardmember failing to be entitled to the Rebate under this Promotion. 23. UOBM’s decisions relating to this Promotion shall be final, conclusive and binding. No appeals and/or correspondences shall be entertained. 24. UOBM shall not be liable for any misrepresentation or misrepresentation of facts by any unauthorised third party in respect of the Promotion and/or the Rebate and published in any mass media, marketing or advertising materials. 25. To the fullest extent permitted by law, UOBM expressly excludes and disclaims any representations, warranties or endorsements, express or implied, written or oral, without limitation to those published in any mass media, marketing or advertising materials, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of this Promotion, the Rebate and the products under this Promotion. 26. UOBM shall not be responsible nor shall accept any liabilities of any nature and however arising or suffered by the Cardmembers and/or third parties resulting directly or indirectly from the Promotion. 27. UOBM is not affiliated with the Tri-E Marketing and makes no representation or warranty with respect to the quality of products and/or services supplied by the Tri-E Marketing. 28. In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this Promotion, these terms and conditions shall prevail. 29. UOBM reserves the right to add, delete or vary the Promotion’s terms and conditions, from time to time, wholly or in part, at its absolute discretion, by providing twenty one (21) days prior notice to the Cardmembers via posting on UOBM’s website, displaying a notice at any of UOBM’s branches and/or a statement insert in the Statement of Account. 30. These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia and the Cardmembers agree to submit to the non-exclusive jurisdiction of the courts of Malaysia.
