By entering this Sweepstakes and signing this document, I “Entrant” represent, warrant and affirm the following: (1) I am eighteen (18) years of age or older as of the date of my entry; (2) I am a permanent legal resident of one of the 50 United States, Washington D.C. (excluding Guam, Puerto Rico, and all other U.S. territories and possessions) or a permanent legal resident of a province in Canada (excluding the province of Quebec); (3) I have full authority to enter the Sweepstakes and that the Smile Photo I submitted is my original creation, I am the sole owner of said Material, that the Smile Photo portion of the Material has never been previously published, previously entered in any competition or contest or won any award prior, and/or performed or otherwise exhibited, and that the Smile Photo meets all requirements as stated in the Official Rules; (4) I have provided the telephone number in my Entry information, the daytime telephone number that I (and only I) will answer during the Sweepstakes Hours; (5) I am not subject to any agreement or arrangement that would interfere with my entering this Sweepstakes and/or participating on the Show (if requested), having my Smile Photo appear on the Show and assigning all the rights of Show participation assigned hereunder; (6) I grant to the Sponsor and its assigns the right to reproduce, publish, broadcast/use, adapt, delete, edit and/or modify the Material I submitted in any manner or format, for any programming, publicity, advertising and promotional purposes, and in any and all media, worldwide in perpetuity, in all languages, versions and formats, and without additional consideration, except where prohibited by law; (7) I release, indemnify, defend and hold harmless the Sweepstakes Entities from any and all liability, claims, losses, accident, illness, injuries (including embarrassment, defamation and invasion of privacy) of any kind, including death, resulting, in whole or in part, directly or indirectly, from my Material or this Sweepstakes, any preparation for or participation in any Sweepstakes-related activity, computer downloading any Sweepstakes information and/or mail/email methods and telephone service providers; (8) in all instances where the Material (or an appearance if applicable) is featured in any media, I and my Smile Photo (if applicable)/likeness/voice/address/biographical and/or information may be personally featured as well. I understand that Sponsor is not, however, obligated to so use me or my Material in the Sweepstakes, on the Show, the Web Sites, online photo gallery and/or in any media; (9) I understand and agree that my Material will become the sole property of the Sponsor and will not be returned to me; and (10) by entering, I agree to all terms and conditions set forth in the Sweepstakes’ Official Rules and Sponsor’s Terms of Use.
