BUDGERIGAR ASSOCIATION INC. (ACTBA) AUCTION RULES 1. Any person wishing to participate in the ACTBA auction must register with the auction secretariat prior to the commencement of the auction. Upon registration, auction participants will receive a numbered bidder’s card. Bidder cards must be returned at the end of the auction. 2. All statements in the auction catalogue have been provided by the vendors—the auction organisers are not responsible for any errors in the catalogue. Intending buyers should satisfy themselves as to the origin, age or condition of any lot in which they may be interested. Cameras, recording equipment, judging sticks and carry cages are not permitted in the inspection area. 3. The vendor or the auction organisers have the right to withdraw or substitute any lot or combine two or more lots. Any birds accepted by the auction organisers after the production of the catalogue will be listed on a supplementary sheet which will be available on registration for the auction. 4. To make a bid, auction participants must raise their bidder’s card—no other forms of bid (such as a head nod) will be accepted. Bids will be acknowledged by the auctioneer. Bidders should ensure that the auctioneer correctly acknowledges their bids. Lots will be sold to the highest bidder as acknowledged by the auctioneer except when the highest bid is below a reserve price for a lot. After the fall of the hammer, no party will be allowed to retract their bid. Disputed bids will be referred for resolution to the auctioneer and the auction organisers. Their decision will be binding on all parties. 5. Lots must be paid for prior to collection. Payments can be made by cash, bank cheque, Visa card, MasterCard or Eftpost. A 5% surcharge will apply to all credit card payments. Personal cheques will not be accepted unless a prior arrangement has been made with the auction organisers (Mario Capasso or Glen Schiller). If any successful bidder fails to pay for their purchase/s on the day of the auction, the vendor or their agent has the right to resell the lot/s. 6. Buyers must collect their birds from the auction secretariat after they have paid for their purchase at the end of the auction—buyers must not remove their lots from the auction benches themselves. Proof of payment in the form of an auction receipt must be presented before lots will be released. Buyers must provide their own carry box or cage. Once birds have been paid for, only the buyer may handle the birds—the vendor, vendor’s agent, the auctioneer or auctioneer organisers will not handle the birds. The lots will be presented to the buyer who will remove the birds from the show cages and transfer them to their own caging facility. 7. Facilities are available for absentee buyers—full arrangements must be made with the auction organisers (Mario Capasso or Glen Schiller), including the lot/s which you wish to bid for and your bid limit, prior to the auction date. The auction organisers or their agent will bid on your behalf. Payment must be made by credit card over the phone or by making an advance payment to the ACTBA (by cheque or direct debit) at least seven days prior to the auction. The total value of any successful purchases made on your behalf will be deducted from the sum held and any credit owing forwarded to you with an itemised list of those lots you have successfully purchased. Any variation to these arrangements must be made with the auction organisers prior to bidding. Absentee buyers must make their own arrangements for their birds to be collected from the auction venue on completion of the auction. The auction organisers can assist with the freighting of birds at the buyer’s expense. 8. The ACTBA, the auctioneer, the auction organisers and the ACTBA are not responsible for any faults or defects in any lot. The buyer having taken delivery of the birds shall be conclusive evidence that they are in satisfactory order and condition and fit for the purpose for which they are required. No refunds will be given. 9. In the event of any disputes or decisions, the auctioneer and the auction organisers have the final say and that decision is binding on all parties.
