Box 190 Fort Duchesne, Utah 84026 Uintah & Ouray Indian reservation Vol. 49 # 10 - February 27, 2015 “2014-2015 Utah Schools Sports Association State Champions” Conflicting Statements Regarding Judge Jenkin’s Recent Ruling On Myton In published reports last week in the Salt Lake Tribune and the Deseret News, J. Craig Smith, attorney for Myton City, made conflicting statements regarding Judge Jenkins’ recent ruling on Myton. In the Salt Lake Tribune Smith was quoted as saying that Judge Jenkins’ ruling means that Myton owns the land on which the Tribe’s new community center is being built. However, in the Deseret News, Attorney Smith was quoted as saying that Judge Jenkins’ ruling left Myton and its attorneys with two questions. “Ownership of the land is one question that’s out there; the other is jurisdiction. Does the town have the responsibility for enforcing building and zoning codes?” Smith was quoted as saying. On February 25, 2015, attorneys for the Ute Tribe filed two motions in the federal court proceeding, requesting that Judge Jenkins clarify the ruling. The Tribe’s motion requests clarification on six specific points, which the motion says, “either are unclear from the Order, or which the Tribe believes the Town of Myton is already misinterpreting.” The motion specifically asks Judge Jenkins to clarify that his ruling does not affect the tribal trust status of lands that were restored to the Ute Tribe through an Order of Restora- tion issued by the Secretary of Interior in 1945. The Tribe’s motion points out that Judge Jenkins’ original ruling in the case in 1981 recognized that lands in and around Myton were restored to tribal trust status under the 1945 Order of Restoration. In his 1981 ruling in the case, Judge Jenkins wrote, “At various times, pursuant mainly to the provisions of the Indian Reorganization Act of 1934 . . . the Secretary of Interior has restored to tribal ownership much of the unallotted acreage within the Uintah and Ouray reservation that remained unentered” under the federal laws that opened the Reservation to non-Indian settlement in 1905. The Tribe’s motion also notes that even the State of Utah acknowledged in the Perank and Hagen cases that the 1945 Order of Restoration restored lands in and around Myton to “tribal ownership and jurisdiction,” quoting from the State of Utah’s legal briefs in those cases. The Tribe’s motion contends that the State of Utah’s position in the Perank and Hagen cases is binding on the State and its counties and municipalities under the doctrine of judicial estoppel. Myton will have two weeks to file a response to the Tribe’s motion for clarification. STATEMENT OF POLICY FOR UTE BULLETIN February 19, 2015 It is the policy of the Ute Bulletin not to publish inflammatory, disparaging, or negative political statements directed at a specific individual or group of individuals, intended to provoke or offend a reasonable member of the group about whom the statements are made. This policy also extends to political statements of an inflammatory, disparaging, or negative nature. The Ute Bulletin is not the appropriate place to make such political statements. ROOSEVELT JUNIOR HIGH SCHOOL students participated in the HOPE WALK on the morning of February 11, 2015 at the Constitution Walking Park in Roosevelt. Afterwards they enjoyed donuts and chocolate/regular milk/water. The walk was organized by the students and staff of the Hope Squad and was part of a full week of events to bring awareness to such issues as suicide, depression and coping with things that could trigger those things that lead to suicide. Awareness and prevention as well as recognizing when a peer needs help were all emphasized during the week. Hope Week started with an assembly on Monday morning and each day of the week had a theme. Students were allowed to dress up as characters from Toy Story and the theme was “You got a friend in me.” Each day had a different theme from movies such as Horton Hears a Who and A Bugs Life to mention a few. This year several Veterans and the tribal bus made the trip. The Parade itself is the largest gathering of Native Veterans, family floats, honored veterans, legion and VFW post. CYPHER Conference February 11, 12 2015 By Brylie Sloan Mr. Louie Gong, he is an artist, activist, and educator who was raised by his grandparents in the Nooksack tribal community. Although he is best known for his highly sought after, hand-drawn custom shoes, Louie has received international recognition for a body of work that - like his mixed heritage (Nooksack/ Chinese/French/Scottish) defies categorization. The CYPHER Conference was so cool. Mr. Louie Gong got our whole school involved and made it very exciting. Mr. Gong first started out talking about how he got involved into making and designing shoes. Then he handed out puzzle Mr. Anthony Guzman begins the conference, and introduces Mr. Louie Gong. pieces and made us describe ourselves on the puzzle piece. She wants to go to any college that will accept her. She says that she wants to be an artist for a career. Paris’ advice for her fellow students is “Go to school, do your work, and be a good noodle!” On February 17, 2015, I interviewed Iktomi Favel. Iktomi has been working here at the school for three years. She loves her students here, and loves helping her students grow. For her hobbies, she likes to attend Native American ceremonies. She enjoys learning her language and learning our Ute language. She enjoys reading books about history, Native American cultures/history, and books about spirituality. This game was tied 62 to 62 with one minute to go. Our boys were holding for the last shot, they went inside to Tre the defense collapsed Tre game it back to Marion on the drive to the hoop. With their tallest defender jumping for the block, Marion just misses the shot. DaVinci rebounds crosses half court and calls a time out with 15 seconds to go. Saturday Morning at Wasatch Academy (In Mt. Pleasant) we beat the number 1 seed American Heritage 65 to 61: (I have this game recorded) Another tight game the entire time. We were getting very good inside shots from great drives and Tre posting up. American Heritage was hitting lucky low percentage shots. The refs were calling the game way too tight on both sides, which was to our disadvantage as we only had 6 players and too had 4 fouls. We certainly had the disadvantage should this game go to overtime. With 48 seconds we were up by one and we start to stall, defense collapses the ball is hit across half court and the refs call over and back. (This is hugely controversial but when I look at the tape it was the correct call.) American Heritage gets the ball with 34 seconds, shoots a 3 misses wildly, get the rebound and puts it in, however the refs call a travel, this is hugely controversial for the other team, both teams are yelling at the refs. (Looking at the tape the refs did a good job) They start fouling we finish the game with Shandon hitting 1 of 2 free throws, and Tre hitting 2 of 2. Saturday Evening at Wasatch Academy (In Mt. Pleasant) we beat Wasatch Academy 74 to 57: (I have all but the end of this game recorded) This was our second game of the day, and the 3rd game in a row for Wasatch Academy, and you could tell both teams were tired. The game was tight until the end, Tre took over the 4th quarter scoring 10 points in the 4th quarter alone. With Tre’s domination inside we had a lead with minutes to go, they started fouling and we were hitting our free throws to clinch the title.
