Conflicting Statements Regarding Judge Jenkin’s Recent Ruling On Myton
In published reports last
week in the Salt Lake Tribune and the Deseret News,
J. Craig Smith, attorney for
Myton City, made conflicting
statements regarding Judge
Jenkins’ recent ruling on Myton. In the Salt Lake Tribune
Smith was quoted as saying
that Judge Jenkins’ ruling
means that Myton owns the
land on which the Tribe’s
new community center is
being built. However, in
the Deseret News, Attorney
Smith was quoted as saying
that Judge Jenkins’ ruling left
Myton and its attorneys with
two questions. “Ownership
of the land is one question
that’s out there; the other is
jurisdiction. Does the town
have the responsibility for enforcing building and zoning
codes?” Smith was quoted as
saying.
On February 25, 2015,
attorneys for the Ute Tribe
filed two motions in the
federal court proceeding,
requesting that Judge Jenkins
clarify the ruling. The Tribe’s
motion requests clarification
on six specific points, which
the motion says, “either are
unclear from the Order, or
which the Tribe believes the
Town of Myton is already
misinterpreting.” The motion specifically asks Judge
Jenkins to clarify that his
ruling does not affect the
tribal trust status of lands that
were restored to the Ute Tribe
through an Order of Restora-
tion issued by the Secretary of
Interior in 1945. The Tribe’s
motion points out that Judge
Jenkins’ original ruling in the
case in 1981 recognized that
lands in and around Myton
were restored to tribal trust
status under the 1945 Order
of Restoration.
In his 1981 ruling in the
case, Judge Jenkins wrote,
“At various times, pursuant
mainly to the provisions of
the Indian Reorganization
Act of 1934 . . . the Secretary
of Interior has restored to
tribal ownership much of the
unallotted acreage within the
Uintah and Ouray reservation
that remained unentered”
under the federal laws that
opened the Reservation to
non-Indian settlement in
1905.
The Tribe’s motion also
notes that even the State of
Utah acknowledged in the
Perank and Hagen cases that
the 1945 Order of Restoration
restored lands in and around
Myton to “tribal ownership
and jurisdiction,” quoting
from the State of Utah’s legal
briefs in those cases. The
Tribe’s motion contends that
the State of Utah’s position in
the Perank and Hagen cases
is binding on the State and its
counties and municipalities
under the doctrine of judicial
estoppel.
Myton will have two
weeks to file a response to the
Tribe’s motion for clarification.

Notice of Ute Indian Tribe
Elections
Pursuant to Ordinance 13-006 as amended, notice is hereby
given that the Ute Indian Tribe of the Uintah and Ouray
Reservation will hold an election to fill the expiring terms of
the following members of the Ute Tribal Business Committee.
Ronald J Wopsock, Uintah Band
Phillip Chimburas, Whiteriver Band
Stewart Pike, Uncompahgre Band
NOMINATIONS:
Each eligible voter may write in the name of one eligible
nominee whom the voter would like to have representing
his or her band on the Business Committee for the period of
2015-2019. Nominations will be on March 10, 2015 from
8:30 a.m. to 4:30 p.m. in the Ute Tribe Auditorium.
PRIMARY ELECTION:
The Primary Election will be held on April 1, 2015 from
8:30 a.m. to 6:00 p.m. for the purpose of the selection of (2)
Candidates from the list of eligible nominees of the Uintah,
Whiteriver, and Uncompahgre Bands.
STATEMENT OF POLICY
FOR UTE BULLETIN
February 19, 2015
It is the policy of the Ute Bulletin not to publish inflammatory, disparaging, or negative political statements
directed at a specific individual or group of individuals,
intended to provoke or offend a reasonable member of the
group about whom the statements are made. This policy
also extends to political statements of an inflammatory,
disparaging, or negative nature. The Ute Bulletin is not
the appropriate place to make such political statements.
The Ute Bulletin, as a tribally-owned business, cannot
take or advertise a position on political matters.
The Ute Bulletin will continue to publish notices made by
the Election Board to notify tribal members of election
related events such as election dates and debate schedules.
GENERAL ELECTION:
The three (3) candidates receiving the highest number of
votes from each band in the General Election shall represent
the Uintah, Whiteriver, and Uncompahgre Bands on the Ute
Tribal Business Committee for the period of four years from
2015-2019. The General Election shall be held on April 13,
2015 from 8:30 a.m. to 6:00 p.m.
ELIGIBLE NOMINEE:
An eligible nominee is an enrolled member of the Ute Indian
Tribe, who is a member of either the Uintah, Whiteriver,
and Uncompahgre Bands; who is (21) years of age on the
day of the elections; and who has maintained a residence
within the boundaries of the Uintah & Ouray Reservation
for at least (1) year preceding the election date is eligible
to nominate and vote in the Primary and General Elections.
Air Quality held a workshop at the Energy & Minerals office
coordinated by Minnie Grant. Representatives from Inter
Tribal Council of Arizona, Inc Gwenda Gorman, Director
Health and Human Services, Eric Hardy, Health Promotion
Specialist, Venessa Dodge, Epidemiologist, presented to the
group information CDC Grant “Good Health and Wellness
in Indian Country” and MOU. ITCA is a not-for-profit Tribal
consortium, addressing issues and concerns, including health,
safety and welfare of ITCA Member Tribes.

WALK on the morning of
February 11, 2015 at the
Constitution Walking Park
in Roosevelt.
Afterwards they enjoyed
donuts and chocolate/regular
milk/water. The walk was
organized by the students
and staff of the Hope Squad
and was part of a full week
of events to bring awareness
to such issues as suicide,
depression and coping with
things that could trigger those
things that lead to suicide.
Awareness and prevention
as well as recognizing when
a peer needs help were all
emphasized during the week.
Hope Week started with an
assembly on Monday morning and each day of the week
had a theme. Students were
allowed to dress up as characters from Toy Story and the
theme was “You got a friend
in me.”
Each day had a different
theme from movies such as
Horton Hears a Who and A
Bugs Life to mention a few.

The Election Commission shall post the results of the Primary
Election on or before April 2, 201 and results of the General

have attempted to harass or intimidate an election official
or voter may be imprisoned for a term not to exceed 6
months and ordered to pay a fine not to exceed $500.00.”

Ira Hayes Memorial Parade Honors the Anniversary of the Raising of the US Flag on Iwa Jima
Sacaton, AZ- Annually, the Veterans of the U&O have been traveling to take part in
the Honoring of Ira Hayes and the raising of the US flag on Iwa Jima. This year several
Veterans and the tribal bus made the trip.
The Parade itself is the largest gathering of Native Veterans, family floats, honored veterans,
legion and VFW post. American Legion Post 136 Fort Duchesne walked in the parade
and carried the flags.

CYPHER Conference February

Mr. Louie Gong, he is an
artist, activist, and educator who was raised by
his grandparents in the
Nooksack tribal community.
Although he is best known
for his highly sought after,
hand-drawn custom shoes,
Louie has received international recognition for a
body of work that - like his
mixed heritage (Nooksack/
Chinese/French/Scottish) defies categorization.
The CYPHER Conference
was so cool.
Mr. Louie Gong got our
whole school involved and
made it very exciting. Mr.
Gong first started out talking
about how he got involved
into making and designing
shoes.
Then he handed out puzzle
Mr. Anthony Guzman begins
the conference, and introduces
Mr. Louie Gong.

After this, we got in a big
circle and told everyone
about our own piece and put
them all together creating a

Conference: April 9, 2015 - U of U annual powwow: April 10-11, 2015
Her hobbies include sleeping, drawing, eating candy,
and of course, sleeping some
more.
She wants to go to any
college that will accept her.
She says that she wants to
be an artist for a career.
Paris’ advice for her fellow
students is “Go to school,
do your work, and be a good
noodle!”
On February 17, 2015, I
interviewed Iktomi Favel.
Iktomi has been working
here at the school for three
years. She loves her students
here, and loves helping her
students grow.
For her hobbies, she likes
to attend Native American
ceremonies. She enjoys
learning her language and
learning our Ute language.
She enjoys reading books
about history, Native American cultures/history, and
books about spirituality.
Iktomi’s advice for the students is, “The hardest thing in
life is to be who you are, but
truly learn to love yourself
for who you are and share it
with others, and always be
kind.”

as women is to take care of
our health so that we can take
care of our families. Get those
check-ups and be proactive.

(UITDHE) will be accepting applications from LowIncome enrolled members of
the Ute Tribe for the rehabilitation of their homes. The
work will be done under the
Indian Community Development Block Grant (ICDBG)
project. The ICDBG project
will rehabilitate up to 23
homeownership units. The
homes are located throughout the counties of Duchesne
and Uintah, in the State of
Utah. The work will consist
of interior and exterior rehabilitation work of the home.
The first round for accepting
applications will begin February 17, 2015 through April
30, 2015. UITDHE hopes to
receive as many applications
possible during this period
and plans to commence with
the rehabilitation of up to
eight homes during this summer. Interested homeowners
can get an application and
eligibility requirements at
the UITDHE office in Fort

is hugely controversial but
when I look at the tape it was

team, both teams are yelling
at the refs. (Looking at the
tape the refs did a good job)
They start fouling we finish
the game with Shandon hitting 1 of 2 free throws, and
Tre hitting 2 of 2.
Saturday Evening at
Wasatch Academy (In Mt.
Pleasant) we beat Wasatch
Academy 74 to 57: (I have
all but the end of this game
recorded)
This was our second game
of the day, and the 3rd game in
a row for Wasatch Academy,
and you could tell both teams
were tired. The game was
tight until the end, Tre took
over the 4th quarter scoring
10 points in the 4th quarter
alone. With Tre’s domination
inside we had a lead with
minutes to go, they started
fouling and we were hitting
our free throws to clinch the
title.

Funeral services for William
Wyasket, age 86, of Vernal,
will be held on Saturday,
February 28, at 11:00a.m. at
the Whiterocks Community
Building. He will be taken
to the community building
on Friday at 4:00 p.m. for a
wake.
Burial will be in the Roosevelt Memorial Park under
the direction of the Hullinger
Mortuary.

Dear Ute Tribal Department:
At the end of each school
year the Ute Tribe High
School JOM Program organizes an annual senior trip
for all our graduating seniors.
This year will be a combined
senior trip with Uintah High
School, Uintah River High
School and Union High
School.
Undoubtedly our senior
trip is a huge event that
requires a lot of time and
support from our students,
parents and community. Our
seniors will be fundraising
next month at the main
concession stand for the
60th Annual Tournament of
Tribal Champions March
26th -28th. We are in need
