Dear Fellow Technicians:
Recently, Southwest resorted to disciplinary action in response to a good faith report of a maintenance
discrepancy. We deemed Southwest’s action to be unlawful and supported a successful legal response.
Just a few days ago, Southwest alleged that technicians are engaged in the bad faith reporting of
maintenance discrepancies for the purpose of gaining leverage in the collective bargaining process. Such
alleged conduct, if true, is also unlawful.
When we perform our work, we have a legal obligation to perform it using the methods, techniques, and
practices prescribed in the applicable maintenance manuals. Moreover, we have a right and obligation to
bring maintenance discrepancies to Southwest’s attention when the failure to address these discrepancies
would violate any applicable federal aviation standard.
But we also have the obligation to refrain from submitting reports of maintenance discrepancies, or
otherwise slowing down, for the purpose of expressing our dissatisfaction with the status of contract
negotiations. If any of you are engaged in such actions, we request that you cease and desist immediately.
Such actions are unlawful and undermine your Union’s collective bargaining efforts.
As a Union, we are committed to defending your right to perform your work in accordance with the
Federal Aviation Regulations. As a Union, we are also committed to adhering to the status quo provisions
of the Railway Labor Act, which provide that we must refrain from any job action until we have been
released by the National Mediation Board.
Stay united and strong. Together we will obtain a fair agreement.
