Request for Proposals Attorney Services City of Bolivar The City of Bolivar is seeking request for proposals for Attorney Services until 2:00 p.m. on April 2nd, 2015, opened and read aloud at City Hall 345 S. Specifications will be on file and may be examined and obtained between the hours of 8:00 a.m. & 5:00 p.m. Monday thru Friday at City Hall 345 S. MAIN AVENUE • BOLIVAR, MISSOURI 65613 • Office (417)326-2489 Fax (417)777-3212 The City of Bolivar is seeking bids for Attorney Services beginning April 2015 to provide services on a contract basis. Interested law firms and attorneys are welcome to submit qualifications and proposals for the provision of these services. In order to be considered, proposals must address each of the concerns requested in this document, including rates and fees. The deadline for submitting proposals will be April 2nd, 2015 at 2:00 p.m. Please see the notice to bidders for details. The City of Bolivar is a full-service City providing its residents with administrative, police and fire services, community development, public works, and parks recreational services with a population of 10,350 citizens. Minimum qualifications include a Juris Doctorate from an accredited law school, a license to practice law in the State of Missouri, and be a member in good standing for the Missouri Bar with required knowledge in the following: Municipal law and procedure including election law, taxation law, law applicable to city-owned utilities, and zoning law Criminal law and procedure for City prosecutions Contract law Real estate law Employment law Civil Rights and Constitutional law Legal drafting Environmental law Public financing law The City is requesting an attorney or firm that can provide legal services, as needed, for an annual flat fee to be billed monthly with a detailed listing of services rendered The annual flat rate would include: Attorney attendance at the City Council, Planning and Zoning and any other City Committee meetings is required by the City during the course of service contract Unlimited phone calls and/or correspondence for legal advice Provide office consultations or visits (whether at the attorney’s or City’s offices) Preparation of all written documentation necessary to handle the City’s legal needs regarding litigation and appeals; including ordinances, contracts, legal opinions, letters, policy creation and revision, and code revisions City prosecution services for all prosecution issues except jury trial and appeals Attorney travel time for City matters (subject to the limitations specified below regarding litigation and appeals) OUR VISION STATEMENT “Bolivar is a community – one of neighbors, character, identity, strong heritage and faith. Now and in the future, we are committed to being a hub of economic growth and diversity with a high quality of life for all.” The following items would be paid outside of the monthly flat rate: The attorney’s actual cash advances made on the City’s behalf by the attorney at the actual amount of the cash advance, and other ‘soft’ costs as follows: Copier costs, in-state long distance or out-of-state long distance, and mileage for the rare occasions when travel is required at the IRS approved rate The attorney would be able to charge an hourly rate for criminal prosecutions involving preparation time for jury trial and any criminal appeal or other case transfer to a Court other than the City Municipal Court If it became necessary for the City attorney to seek specialized assistance for unique circumstances, then the City would be responsible for the costs of the specialized services. By way of example only, the area of municipal financing is a very technical and specialized area for which the City attorney would likely need to seek the services of a specialized law firm. If needed, the costs and fees for the services of the specialized firm would be paid by the City The attorney would be able to charge an hourly rate for civil litigation on behalf of the City (in those rare instances wherein the City’s insurance does not provide for counsel) The above outline is only suggestions regarding request for qualifications.
