WELCOME! IT IS OUR DESIRE TO MAKE YOUR VISIT WITH US A PLEASANT ONE. IN THIS RESPECT, WE DRAW YOUR
ATTENTION TO OUR RULES, REGULATIONS, AND RENTAL AGREEMENT, WHICH GOVERNS OUR OPERATION.
RENTAL AGREEMENT, RULES AND REGULATIONS
Cape May Marina (“Marina”) hereby leases to Owner, the slip and/or other items, on the terms and conditions hereinafter set
forth.

For the purposes of this agreement, the term “Owner” shall include the actual registered owner of the boat, members of
his family, guests, outside labor, agents, or other person using the boat.
The Owner shall abide by the rules and regulations now and hereafter is force as promulgated by the Marina and as from
time to time posted at the Marina.
The parties hereto agree that neither the Marina nor any agent, servant, or employee of the Marina shall be liable for any
loss, damage, or personal injury to the person or property of the Owner, including the boat, its inventory and equipment,
nor to the Owner using the Marina, whether such loss, damage, or personal injury be occupied by fire, theft, Act of God, or
any other cause of donation. Owner hereby agrees to assume full responsibility for personal injury and property damage
arising out of the maintenance, use and operation of his boat in the Marina area or occasioned to the Owner through the
use of the Marina facilities. If is understand that both the Marina and the Owner have insurance with respect to their
responsibility here under. Boat Owner represents that he carries a minimum of $300,000 liability insurance and shall
provide a certificate of insurance.
This agreement is for the use of pier space only and such space is to be used at the sole risk of the Owner. Marina shall not
be liable for the care of protection of the vessel, her gear, equipment, or contents, or for any less or damage of whatever
kind or nature to the vessel, her contents, gear, or equipment howsoever occasioned. Marina makes no warranty of any
kind as to the condition of the piers, walks, wharfs, gangways, or mooring gear and equipment, nor shall Marina be liable
for injuries to the person or property Owner, his agents, employees, or guests from any cause or circumstance.
The Marina at its option may terminate this agreement at any time, if in its sole judgment; the Owner does not adhere to
the rules and regulations of the Marina or conducts himself in a manner detrimental to the Marina or the boat Owners. In
addition upon default by the Owner of any of the terms and conditions hereof, which shall include non-payment of rent or
other charges, or other defaults, the Marina at its options may declare this agreement to be in default and shall have all
rights and remedies available under the laws of the State of New Jersey to recover possession, evict, expel, recover unpaid
rent, and this context shall become terminated without refund to the Owner. Upon terminations, the boat and all
personal property must be removed from the premises within one (1) week it is agreed that the Marina at its option, truly
remove the boat to another yard for storage. The Marina will have a lien on the boat if money is owed and may lawfully
retain the boat until all claims are settled. In either event, regular transient rates will be charged. The Owner agrees to
pay for any and all expenses, including court costs and attorney’s fees in the event any action is necessary to enforce any
terms of conditions of this contract.

This contract may not be assigned by the Owner and the property leased hereunder may not be sublet. If the boat is sold,
this agreement is automatically terminated and the same provisions for removal apply as outlined above unless a new
rental agreement has been agreed to, and signed and paid in full by the new Owner.
Chartering or soliciting for charter or sale is permitted from the premises only upon separate, written permission granted
by the Marina.
If the boat is offered for sales while this agreement is in effect, the Marina must be notified. Prospects will not be
admitted to the dock unless accompanied by the Owner. For sales signs are not permitted.
The Marina reserves the right to use the leased property hereunder when not occupied by the Owner at the Marina’s own
profit and without adjustment in the seasonal rent.
The Marina reserves the right to board and/or move the Owner’s boat if, in its sole judgment, this becomes necessary.
The Marina reserves the right to assign slip according to boat length and beam.
The Marina reserves the right to properly rig and bill the Owner, if he fails to meet specified docking requirements
(minimum requirement – six lines – ½” nylon line).
The balance due to the season slip rental is due and payable upon entry or April 15, 2015 whichever comes first.
Season’s length: April 15, 2015 through October 15, 2015. NO REFUNDS
The running of engines is permitted for warm-up purposes only (5-10 minutes). All must adhere to this restriction
particularly during the early morning hours.
The Marina parking areas are for boat Owners only and are the only areas for the boat Owners to park. No trailers or
boats are permitted in these lots. Guest and second cars should use additional lot areas at busy time.
All docks, finer piers, and parking areas are to be kept clear of gear and accessories. Only Cape May Marina Dock Boxes
are permitted (in designated areas) and must be purchased through the Marina.
No swimming, fishing, or crabbing permitted off the docks, boats and bulkheads in the Marina.
No sanding, scraping or painting of gear on finger piers or docks.
No electric sanding on boats. Minor maintenance by Owner permitted between 9 o’clock a.m. and 5 o’clock p.m. only.
Water faucets located throughout the Marina are for all to use for boat washing and tank fill. No lessee has exclusive use
of a faucet. Hoses must be hung on hangers provided or kept on boat. Hoses must be shut off when not in use. The
washing of automobiles is prohibited.
Restrooms are for Marina tenants only. Access is by way of key card. Key cards will be provided to Owners only.
Trash must be placed in plastic bags, tied, and deposited in the containers provided. Nothing shall be thrown in the water
or on the grounds.
Fish must be cleaned at designated areas only and remains deposited per Marina rules. Nothing shall be thrown in the
water.
No fuel is to be stored or carried on docks. All fueling must be done at fuel dock. No exceptions.
Marine heads must comply with applicable state and federal laws. Restroom facilities are provided ashore.
No service work of any kind by outside contractors shall be done to boats in the Marina except by special provision of the
management.
The final acceptance of any boat for a slip shall rest entirely with Marina Management
All bills must be paid in full before boat is removed from the Marina
Absolutely no hibachi, grills, fires, or stoves are allowed on docks, fingers or grounds of the Marina.
No small boats, rafts, kayaks dinghies of any kind may be stored on docks, fingers, or in slips. One boat per slip.
Do-it-yourself oil changing will not be permitted in the Marina. Oil, oil cans, gasoline or any other flammable substances
must not be disposed of in trash containers. Your contractor must remove oil, filters, batteries etc. for proper disposal.
Disorderly conduct by any Owner, his quests, or crew will not be tolerated and shall be cause for said boat’s immediate
removal from the Marina with no refund.
